HOMEOWNER'S EXEMPTION The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions of this section(Section 109.1.1-Licensing of construction Supervisors);provided that if the homeowner engages a person(s)for hire to do such work,that such Homeowner shall act as supervisor." Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q, Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the pemut application, that the homeowner certify that he/she understands the responsibilities of a Supervisor: On the last page of this issue is a form currently used by several towns. A business certificate ONLY REGISTERS YOUR NAME in the town (which you must do by M.G.L. -it does not give you permission to operate-you must get that through completion of the processes from the various departments involved. �IGNI�IFSA PRO VAL FORA BUSINESS ORFIFIGAT�PNLY M T $ i t_i _ A i ,£ if TOWN OF BARNSTABLE1 ZONING BOARD OF APPES A SPECIAL PERMIT (A DEC I S I ON AND NOTICE PETITION NO. 1989- 17 PETITIONER: PETER AND CLAIRE WATTS At a regularly scheduled hearing of the Zoning Board of Appeals, held on March 9, 1989, notice of which was published in the Barnstable Patriot and notice of which was forwarded to all interested parties pursuant to Chapter 40A of the General Laws of the Commonwealth of Massachusetts, the Petitioners, Peter and Claire Watts, requested a Special Permit under Section 3- 1 . 1 3A, for six (6) lodgers in one multiple unit dwelling located on Assessor's ,,Map '317, -Lot 8, Cindy Lane, Barnstable MA in an RF-2 zoning district: The petitioner is seeking a Special Permit to operate a Bed and Breakfast enterprise for six (6) lodgers in a two story single-family residential dwelling containing four bedrooms and two baths on the second floor. The dwelling is located on Cindy Lane, a dead-end cul-de-sac road which runs south off of Route 6A approximately across from the Cape Cod Art Association in Barnstable. It is not in a Zone of Contribution. There is Town water on the site. The petitioner does not intend to make any additions to the existing dwelling. There is a two car garage and area within the existing driveway and front side yard to provide for off-street parking. A site plan has .been submitted but has not been approved. Attorney, Charles Sabatt, appeared to represent abutters opposed to the petition. Mr. Sabatt suggested that the Bylaw pre-supposes that in order to have adequate capacity to accommodate six people the dwelling would have to be made up of multiple-units. That is not the case in this application before the Board. Mr. Sabatt also discussed the increase in traffic that would be generated by this petition, the possibility that the applicant, who presently resides in Forestdale, may not reside in the dwelling, the lack of approval of the site plan and requested that the Zoning Board of Appeals deny the petition for Special Permit. Ten abutters spoke in opposition to the petition. r Chairman Jansson, made known to the applicant the information required for site plan review and the need for proper submission and clocking in of the application which it has been established was not done, in the office of the Town Clerk. He requested that the applicant submit a letter extending the time frame in which the Board has to act and warned him of the necessity of denial of the petition if these several points were not carried out. FINDINGS OF FACT: Based on the evidence submitted the Zoning Board of Appeals made the following findings of fact: The applicant has not submitted a letter extending the time frame in which the Board has to act. The application was not submitted properly in that it was not clocked in at the office of the Town Clerk. A site plan review and approval has not been received by the Board. Testimony presented at the Public Hearing by abutters Indicate that the proposed use would increase traffic on the narrow dead-end street and would be substantially detrimental to the existing quiet residential neighborhood. Based on the above findings, the Zoning Board of Appeals, at a meeting held on April 6, 1989, by a motion duly made and seconded, voted to deny the issuance of a Special Permit.
