A certificate - 30 issued in accordance with this section shall be in force and effect for four 31 years from the date of issue and shall be renewed each four years 32 thereafter so long as such business shall be conducted and shall lapse 33 and be void unless so renewed. Copies of such certificates shall be 34 available at the address at which such business is conducted and shall be 35 furnished on request during regular business hours, to any person who 36 has purchased goods or services from such business. Violations of this 37 section shall be punished by a fine of not more than three hundred 38 dollars for each month during which such violation continues. 39 110:6. It is DQT understanding that there has been a con^laint lodged against Mr. Smith for operating an aut<Mobile repair service at his dwelling.I would like to submit to you the following facts which I am hopeful will provide some assistance in your investiga tion. Mr.Smith has operated a repair service in connection with his dwelling since he moved in in,I believe,19^9•At that time, the area was zoned as an RD3 district which allowed professional or home occupation.The town by law in force at that time stated that a home occupation includes such things as arts,crafts, service business,antique shops,gift shops,etc. Mr.Smith further filed a doing business certificate with Mr,Sears on May 2U,1972.The by law, in effect diaring 1969,makes no mention of any requirement prior to doing business in an RD3 district.By a special town meeting in August,1972 and approved by the attorney general,in September, 1972,the progessional home occupation section of the by law relating to an RD3 district was eliminated from the by law. I would respectfully suggest that Mr.Smith's business,at the very least presently falls in the area of nonconforming use.I might add that the business has been a continuing oen from it's conception to the present.On the basis of this,I woiad respectfully suggest that Mr.Smith is not in violation of any by law. There may he some question as to what qualifies as a service hiisiness,and quite frankly my investigation into the Massachusetts cases does not state what is a service business.
