The subdivision was mostly constructed by 1973. There are letters in the file indicating that Sentry Bank took back ownership around 1982 of most of the subdivision that had not yet been built. Cobblestone Road (the last road in the subdivision to be constructed) was constructed in 1982. Coral Way Lot number 54 has frontage on Cobblestone Road (which is paved) and on Coral Way (which is gravel). In 1982 there were 4 lots with some frontage on Coral Way. Apparently Sentry Bank did not own these 4 lots. It appears that these four lots were turned over to lawyers as partial payment for work they performed on the subdivision. The file contains a letter dated August 14, 1985 from Attorney Michael Princi indicating that the Planning Board had voted to release two of the lots (nos. 56 and 57)from covenant and also signed an approval not required plan combining lots 56 and 57 into one lot. At this time a note was placed on the ANR plan that the owner of these two lots (now one lot)would not have any rights over Coral Way. RECOMMENDATION: I have no objection to the release of developer's lot numbers 54 and 55 from covenant providing the owners of these two lots sign and record the "S"form for their lots regarding Coral Way which was never constructed to subdivision standards. Upon that finding,the applicant through their representative requested and the Board granted a withdrawal without prejudice. Board Members deciding this appeal were,Ron S.Jansson,Jeremy Gilmore,Randolph Childs,Richard L. Boy and Chairman Daniel M. Creedon. Attorney Bruce P. Gilmore represented Marietta Murphy who was. also present at the hearing. Mr. Gilmore stated that Marietta and husband Ken purchased the lot 46 years ago for their retirement. The lot remained vacant until they retired at which time a builder was hired and they had hoped to proceed with the construction of a home on the lot. Unbeknownst to them the builder was not licensed. A series of unfortunate personal and business events followed. Only recently a neighbor William Rickey,who is a licensed builder stepped in to assist the applicant and finishing of the home. Attorney Gilmore noted that although de minimis, the Building Inspector required a variance be obtained. The Board questioned if a variance is needed.
