The expansion of the structure includes the addition of a second floor and an increase in building footprint to accommodate a stairway to the second floor. Flans also show a second story new elevated mechanical platform to the back of the building for air-conditioning equipment. Telephone exchanges are permitted in the Village Business A District as a conditional use under Section 3- 3.5(3A)(F) by the grant of a special permit. This facility does not have the benefit of a special permit and has applied for that relief in Appeal 2001-75. To expand the structure the applicants are seeking variances to Section 3-3.5 Bulk Regulations, setback requirements and lot coverage in Appeal 2001-76. The lot is a pre-existing non-conforming lot in terms of area and lot width. The structure located on the lot is also a pre-existing non-conforming building in terms of lot coverage by building and in terms of front yard setback. The applicant proposes to add a total area to the structure of 1,739 sq.ft. Most of the area will be on the second floor, however, a 20'-4" by 9'-5" stairway area is being added to the first floor. This new area of the building will infringe into the required 10 foot side vard by 4-6", infringe into the 30 foot required total side yard setbacks by R'-h", increase lot coverage from 34%to 39%and the new elevated mechanical platform will infringe into the rear setback requirement of 20 feet some 12'-9". The plans for the expansion were before the Old Kings Highway Historic Districrand approved on January 31, 2001, The Site Alan Review Committee found them approvable on March 26, 2001. With respect to the parking situations, Mr. Alger stated that it is obvious that there exists a serious parking problem in the Village of Barnstable caused mostly by abutting uses,a florist slop, a 48-seat restaurant, a real estate office and a post office with 1.300 post boxes. He also noted that in the immediate area the Cape Cud Commission, with 60+employees is housed. They have rented from the County the area used by the fire district in the reconstruction of the fire station for staging of the addition and they have reached an agreement with the neighboring Dolphin Restaurant for parking of construction vehicles during construction. Appeal 2001-76 - Verizon-Real Estate/Timothy McGonigle, has applied for a Variance to Section 3-3.5(5) Bulk Regulations to permit an existing telephone exchange to add a second floor and expand the building footprint. The telephone exchange use exists today but it does not have a conditional use permit. The applicant is seeking to upgrade and expand the use and structure. The property is shown on Assessor's Map 299,Parcel 030, addressed as 3240 Main Street,Barnstable, MA in a Village Business A Zoning District. Background& Review: The locus before the Board in these appeals is the `New England Telephone Exchange'building located in Barnstable Village. The lot is 0.14 of an acre and developed with a 2,402 sq.ft. 1-story industrial/commercial structure built in 1950. The applicant is seeking to expand the structure and modernize&expand the equipment within. The expansion of the structure include s the addition of a P second floor and an increase m building footprint to accommodate a stairway to the second floor. Plans also show a second story deck to the back of the building that is described as "new elevated mechanical platform". The platform will be used for air- conditioning, needed to cool the equipment rooms. The site was before the Board in 1973, seeking relief to expand the structure (Appeal 1973-54). That appeal was denied. r Planning Division-Staff Report Telephone Exchanges are permitted in the Village Business A District as a conditional use under Section 3-3.5(3A)(F) by the grant of a special permit. This facility does not have the benefit of a special permit and has applied for that relief in Appeal 2001-75. To expand the use the applicants are seeking variances to Section 3-3.5 Bulk Regulations, setback requirements and lot coverage in Appeal 2001-76. The lot is a pre-existing non-conforming lot in terms of area and lot width. The structure located on the lot is also a pre-existing non-conforming building in terms of lot coverage by building and in terms of front yard setback. The applicant proposes to add a total area to the structure of 1,739 sq.ft. Most of the area will be on the second floor,however, a 20'-4" by T-0.5" stairway area is being added to the first floor. This new area of the building will: • infringe into the required minimum 10 foot side yard by C-6" • infringe into the 30 foot required total side yard setbacks by 8'-6" and • the lot coverage will increase from 34%to 39%. • The new elevated mechanical platform infringes into the rear setback requirement of 20 feet some 12'-9". Under the ordinance,this would be considered a structure and would require variance relief from the Board. The side and rear yard infringements would be newly created and therefore require a variance./The lot coverage non-conformity already exists and could be granted by the Board as a special permit to increase a non-conforming aspect. The applicant has rolled them together in the variance request. The plans for the expansion were before the Old King's Highway Historic District and approved on January 31, 2001. The Site Plan Review Committee found them approvable on March 26, 2001. Special Permit Findings: -The granting of a Special Permit requires the following finding of facts to be made by the Board: • that the application falls within a category specifically excepted in the ordinance for a grant of a Special Permit, • that after evaluation of all the evidence presented,the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. • that a site plan has been reviewed by the Site Plan Review Committee and found approvable. Variance Findings: In consideration for the Variances, the applicant must substantiate those conditions unique to this lot that justify the granting of the relief being sought. In granting of the Variance the Board must find that: • unique conditions exist that affect the locus but not the zoning district in which it is located, 2 Planning Division-Staff Report • a literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise to the petitioner, and the relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Suggested Conditions: If the Board should find to grant the special permit—Appeal 2001-75 -for the telephone exchange use, it may wish to consider the following condition: Use of the site is restricted to that of a Telephone Exchange facility only. . In consideration for the special permit request the use already exist on the site and the issuance of the permit would not necessarily grant its expansion if the Board were to further condition the permit to what exists today. To expand the use as planed and presented the variance request are necessary. Should the Board find that variance conditions exist; it may wish to consider the following conditions for Appeal 2001-76: 1. The hearing was opened July 11, 2001, and continued to September 05, 2001, January 23, 2002, and to March 06, 2002, at which time the Board .n found to grant the special permit and variance with conditions. Both the variance and special permit requests were heard together. Board members deciding this appeal were Gail Nightingale, Thomas A. DeRiemer, Jeremy Gilmore, Randolph Childs and Ron S. Jansson. Attorney John Alger represented the application before the Board. Also present was Tim McGonigle on behalf of Verizon and Gary Moneyhun,Architect. At the opening of the hearing, Mr. McGonigle explained that the proposed expansion is in response to the growing demand for long distance telephone service and the needs to meet that demand as well as to up-date equipment. Architect, Gary Moneyhun, stated that the Historic Commission has approved the plan, as has the Site Plan Review Committee. The one story Cape,will be expanded by adding a second floor. A mechanical platform will house condenser units in the rear. The question of employees and parking arose. The applicant explained that there is only one employee, however, technicians are there on occasions for short periods of time. The expansion is for equipment, not technicians. The issue of parking in the village was discussed. Discussions regarding the appropriateness of the use at this location were held, questioning if the site could accommodate the expansion, or is it time to seek an alternative location. The Board's suggested that the applicant may wish to seek an alternative location for the use. The applicant remarked that the cost of moving the facility would be prohibitive. Charlie Petano,real estate construction manager for the New England area said the cost to move a central office is huge. The applicant discussed the driveway area and it was noted that the driveway is owned by the applicants and no written easements exist. The applicant committed to keeping the driveway open. Public comment was requested. Robert Kelley spoke on behalf of the Dolphin Restaurant noting the parking problem. The Chairman noted that letters were received from the Barnstable Civic Association and from Robert D. Stewart noting concerns for the traffic,parking problems and safety in the area The Board noted that the parking issue must be resolved. It was cited that the ordinance as related to telephone exchange permits 3 full time employees and there is a need for 3 parking spaces. The hearing was continued to allow the applicant to explore options related to parking. At the March 06, 2002,hearing,the applicant presented a memorandum to the Board in support of the applications. Mr. John Alger cited that this facility is the nerve center and economic hub of Verizon service to the community- a critical and permanent part of the Verizon network in the Town of Barnstable. He stated that telephone service was.established in Barnstable in 1911. In 1954,the original Community Dial Office building served 592 subscribers. In the last few decades, an explosion of new technology has resulted in continual changes to better serve customers. Telephone service in the area increased from 3,060 subscriber lines in 1974 to 5,600 subscriber lines in 1984. Electro-mechanical switching equipment existed until December 1983 when it was converted to an Electronic Switching System. Presently this facility is serving approximately 9,500 Network access lines and 340 Trunk lines. The existing building is a one-story structure with 2,030 total square feet. Over 95% of the available space is in use. Due to a lack of available land,the building cannot expand horizontally.A second story addition will house the new equipment;replacing first floor equipment that will be removed for additional growth. This high-tech equipment requires a carefully controlled central office environment to keep operating 24 hours a 2 day, seven days a week.Verizon will be installing heating and air conditioning equipment to control temperatures inside the central office. He noted that Verizon is committed to an FBI mandate to have the Barnstable Switch program updated by 12/31/02 to meet the requirements of the Communications Assistance.Law Enforcement Act(CALEA). This update will require replacement of the switch processors and includes the need for additional floor space not available today. With respect to the parking situations,Mr.Alger stated that it is obvious that there exists a serious parking problem in the Village of Barnstable caused mostly by to abutting uses, a florist shop, a 48-seat restaurant, a real estate office and a post office with 1,300 post boxes. He also noted that in the immediate area the Cape Cod Commission,with 60+employees is housed. He stated that at present there is only one permanent employee at this facility. Upon completion of the construction there will be no permanent employees, only an occasional one for service work at the building. The petitioner's plan shows five parking spaces that are private to the phone company. In consideration of the parking issues during construction the petitioner has rented an office in the Barnstable Tavern building that will be the construction office during the project and will provide parking for the employees out of the area. They have rented from the County the area used by the fire district in the reconstruction of the fire station for staging of the addition and they have reached an agreement with the neighboring Dolphin Restaurant for parking of construction vehicles during construction. The Chairman noted that two.letters of support have been submitted to the file. There were from Cape Cod Community Collage president Kathleen Schatzberg and from Cape Cod Technological Council,Inc, Spyro Mitrokostas,Executive director. Attorney Frederick Mycock spoke on behalf of the Dolphin Restaurant and noted they were satisfied with the arrangements made. Findings of Fact: At the hearing of March 06, 20012 the Board unanimously made the following findings of fact as related to Appeal 2001 —75 for a telephone exchange conditional use special permit. 1. The property is addressed as 3240 Main Street,Barnstable,MA and is shown on Assessor's Map 299 as Parcel 030. It is a Village Business A Zoning District. 2. The applicant has applied for a Special Permit under Section 3-3.5(3A)(F), Conditional Use Telephone Exchange. The telephone exchange use exists today but it does not have a conditional use permit. The applicant is seeking to upgrade and expand the use and structure. 3. The special permit being requested is that of a conditional use permit only to allow what exists today. Ii is not being issued for the expansion of a non-conforming use. 4. That the application falls within a category specifically accepted in the ordinance for a grant of a Special Permit, 5. That after evaluation of all the evidence presented,the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. 6. That a site plan has been reviewed by the Site Plan Review Committee and found approvable. 3 r Decision: Based on the findings of fact, a motion was duly made and seconded to grant Appeal 2001-75, for the telephone exchange use,with the following conditions: 1. It is located in a.Village Business A Zoning District and an AP Water Overlay District and is on town sewer. Project Proposed: Verizon proposed to construct a second floor addition to the existing 3240 Main Street (Route 6A) Central Office, in order to provide needed space within which to house upgraded telephone equipment to keep pace with rapidly growing demand for local long distance and data services as well as requirements for increased local phone competition. In addition to the second floor of 1,739 square feet, there is proposed a 20'4"x9'0.5" stairway area impinging on the side line requirements and an elevated mechanical platform in the rear extending 12'9" into the 20' rear set back. History of the Building,Description and the Work to be Performed The nerve center and economic hub of nearly every community served by Verizon is the company's central office. All of the phone lines in the community converge on this building, making it a critical and permanent part of Verizon's network in the Town of Barnstable. Tens of thousands of calls—voice, data, local and long distance calls—flow through this building daily at the speed of light. Calls are funneled into the central office through underground cables. They then travel through a large distribution frame where they are sent in digital form to a switch, which automatically routes the calls to their destination. It is also important to note that these central offices are a critical component in routing emergency 911 calls. Telephone service was established in Barnstable in 1911. In 1954 the original Community Dial Office building serving 592 subscribers, was cut into service converting a part of Barnstable/West Barnstable from a Manual (Operator Assisted) System to a Dial System. In 1960, the first addition to the original building was completed. In 1968, due to continued growth, a second addition was completed, bringing the building to its present size. t In the last few decades, an explosion of new technology has resulted in almost continual change in Verizon central offices to better serve customers. Noisy mechanical switches of the 1950's were replaced 20 years later by electronic switching equipment, which in turn have been replaced by digital switching technology. The demands for 1 ' c telephone service in the area served by the Barnstable facility were such that the capacity increased to 3,060 subscriber lines in 1974 and 5,600 subscriber lines in 1984. Electro- mechanical switching equipment existed until December 1983 when it was converted to an AT&T Electronic Switching System (#5ESS), presently serving approximately 9,500 Network access lines and 340 Trunk lines. The Barnstable office is a one-level structure with 2,030 total square feet. Currently, over 95% of the available space is in use. The office is closed to Collocation with requests pending. Due to a lack of available land, the building cannot expand horizontally. A second story addition will house the new equipment, replacing first floor equipment which will be removed for additional growth. The addition of masonry construction will match the existing structure and is designed to blend harmoniously with other like buildings in the village. The proposed new digital equipment is employed in similar exchanges throughout the Verizon footprint. All of this high-tech equipment requires a carefully controlled central office environment to keep operating 24 hours a day, seven days a week. Verizon will be installing leading edge heating and air conditioning equipment to control temperatures inside the central office. In every market it serves, Verizon is the company that consumers, businesses, government leaders and competitors rely on to move information anywhere, anytime. Fulfilling this mission requires a continuous evolution in technology in Verizon's central offices and expansion of these facilities to meet the needs of today's and tomorrow's customers. In support of that mission, Verizon is committed to an FBI mandate to have the Barnstable #5ESS Switch program updated by 12/31/02 to meet the requirements of Communications Assistance Law Enforcement Act (CALEA). This update will require replacement of the switch processors and includes the need for additional floor space not available today. Description of Project This switching station will have a second floor added to the front "cape style" section and above the adjacent flat-roof section. The original foot footprint will eexpanded b Jp to accommodate a new stair to this second floor. A metal grate platform at the rear will accommodate the air conditioning condensers. Finishes will match existing materials: brick siding; wood trim, vinyl clad wood windows, steel doors, vinyl shutters; asphalt shingles, the building's new proportions to be similar to two-story structures in the same area. Board of Appeals Action Sought Under Appeal 200.1-75, Special Permit, the petitioner seeks a special permit to operate the telephone exchange as a conditioned use under the provisions of section 3-3.5 paragraph 3A, item F. The building has heretofore existed as a nonconforming use but is a conditionally permitted use under the Village Business A District. To the extent 2 possible, under the provisions of section 4-4.4 2), the petitioner seeks a special permit to allow the construction and the increase of the nonconformity by the addition of the second story and the further encroachment into the side and rear yard setbacks. Under Appeal 2001-76 the petitioner seeks, under provisions of section 5-3.2 3), a variance to the sideline and rear line set back and maximum lot coverage as set forth in section 3-3.5 5) Bulk Regulations, to allow the construction of a legal stairway to the second floor and a raised platform in the rear. Discussion -Upon consideration.of the project, it is immediately obvious that there exists a serious parking problem in the Village of Barnstable caused in part by the abutting property consisting of a florist shop of approximately 600 square feet, a 48 seat restaurant of approximately 800 square feet, a real estate office of approximately 400 square feet and a post office with 1,300 boxes of about 900 square feet and a vacant section of approximately 800 square feet with only 14 parking spaces in total. In addition, there exists in the immediate area the Cape Cod Commission with 60+ employees and no private parking as well as the district attorney's office, which has limited private parking. The petitioner has one permanent employee and upon the completion of the construction, will have no permanent employees but will have telephone trucks on occasion for service work at the building. The petitioner's plan shows five parking spaces which are private to the phone company and do provide adequate parking for employee trucks. In consideration of the parking issues during construction your petitioner has gone to extraordinary means to establish construction areas and parking which will not further exacerbate the problem. First they have rented an office in the Barnstable Tavern building which will be the construction office during the project and will provide parking for the employees out of the area. Second, they have rented from the County the area used by the fire district in the reconstruction of the fire station for the storage of materials needed in the construction and finally they have an agreement to rent parking spaces from the Dolphin Restaurant for additional onsite parking. All this is being done in an extraordinary attempt to try to not restrict the flow of traffic around the building and into the current existing parking lots. As to the building itself, the petitioner has taken particular pains to maintain the integrity of the existing structure by using the same materials used in the previous building, matching brick siding, wood trim, windows, doors, shutters and shingles and maintaining the existing proportion. The proposed work has been approved by the Kings Highway Historic District. Variance Conditions The lot consists of.6,479 square feet and the existing building covers 34% of that space. The remaining space is parking areas and driveway areas to access the rear of the property and the parking lots in the back and side areas. 3 There currently exists on the property a 1983 vintage AT&T electronic switching system and it is proposed to replace it with new digital equipment that is used in all the other surrounding exchanges. Because of the nature of the communications industry, it is impossible to shut down the service while the switches are being replaced and there is insufficient area to install the new equipment in the existing area. An expansion is, therefore, required. Once the new equipment is put in, the old equipment can be removed and that will leave adequate room for expansion for the indefinite future. The purpose of the zoning bylaw reads, "The purpose of this ordinance is to promote the health, safety, convenience, morals and general welfare of the inhabitants of the Town of Barnstable, to protect and conserve the value of the property within the town, to increase the amenities of the town, and to secure safety from seasonal or periodic flooding, fire, congestion or confusion,". Therefore, to allow the update of the phone services at this facility will promote the public health and safety in that it will provide the ability to meet the requirements of the Communication Assistance Law Enforcement Act as required by an FBI mandate, and allow for collocation, the opportunity for competitors to operate out of the system, which is now not possible due to the confinement and will allow the petitioner to keep up with the evolution of technology and to be available for the increased requirements of telephone and high speed data services today. There currently exists thousands and thousands of wires running into the existing building through underground vaults. The presence of this network as it now stands constitutes a unique situation that prevents this facility from being constructed in any other location and the denial of this permit would prevent the upgrade of the system which would be detrimental to the health, safety and welfare of the citizens of Barnstable. A literal enforcement of the provisions of the zoning ordinances would involve substantial hardship not only to the petitioner but to the citizens of Barnstable limiting the ability to provide future enhanced services to the local residential and business community. The relief can be granted without nullifying or substantially derogating from the purposes and intent of the zoning to protect the citizens of Barnstable but is in.fact for the public good and not in substantial detriment thereof. 4 Gilmore has a hard time understanding hardship. He would have spread renovations out, made some specific changes, wouldn't it have been better to have come first to the Board. She was only going forward if the renovations came out the way she wanted. Copeland said the Town Council has already set rules — shouldn't change. Creedon said his reading of the regulations of manner in which you can do this is so restricted that it can't be done. The Special Permit can only be issued only if conditions are met, and it goes with land, not owner. Connolly asked if can she terminate the permit? Nightingale—no. Findings: 1. That the granting of the special permit requested would be detrimental and out of character of the neighborhood, 2. That there are no unique conditions in the neighborhood, that there is no hardship. VOTE: The Board voted unanimously in favor of accepting the Findings and the request for a Special Permit was denied Without a special permit to operate a bed and breakfast, there is no need for variances on parking or use of a dwelling built after 1970. The petition does not meet qualifications of a special permit. Ralph Copeland left the meeting at 10:15 PM.. Verizon/McGonigle Appeal 2001-75 Verizon/McGonigle Appeal 2001-76 These Appeals will be heard together. Appeal 2001-75 Verizon Real Estate/Timothy McGonigle, has applied for a Special Permit under Section 3-3.5(3A)(F), Conditional Use Telephone Exchange. The telephone exchange use exists today but it does not have a conditional use permit. The applicant is seeking to upgrade and expand the use and structure. The property is shown on Assessor's Map 299, Parcel 030, addressed as 3240 Main Street, Barnstable, MA in a Village Business A Zoning District. Appeal 2001-76 Verizon Real Estate/Timothy McGonigle, has applied for a Variance to Section 303.5(5) Bulk Regulations to permit an existing telephone exchange to add a second floor and expand the building footprint. The telephone exchange use exists today but it does not have a conditional use permit. The applicant is seeking to upgrade and expand the use and structure. The property is shown on Assessor's Map 299, Parcel 030, addressed as 3240 Main Street, Barnstable, MA in a Village Business A Zoning District. The locus before the Board in these appeals is the "New England Telephone Exchange" building located in Barnstable Village. The lot is 0.14 of an acre and developed with a 2,402 square foot, 1 story industrial/commercial structure built in 1950. Tim McGonagle is here on behalf of Verizon, he is not the applicant, Verizon is the applicant McGonigle said the proposed expansion is in response to the growing demand for long distance telephone service, Verizon seeks to expand its capacity to meet needs. The building use will not change, occupancy will not change and the design is consistent with neighborhood. The Architect, Gary Moneyhoney, stated that the Historic Commission has approved the plan, as has the Site Plan Review Committee. The one story Cape with a brick veneer is expanding vertically because there is no site left for horizontal expansion. The expansion will straddle the existing building with steel, add a second floor, new roof, all while keeping the facility operational and not getting the equipment wet from weather A mechanical platform will house condenser units in the rear, they are now very visible from Route 6A. He is continually looking at plans and wants to amend the petition because he sees a need to encroach an additional 10"-11" on each side of building to make it happen. Jansson said there is a total added 1,450 sf and one employee. Why are there so many phone trucks there? Answer - technicians are only there for short times. The expansion is for equipment, not technicians. Jansson noted an expansion project was denied in the past. Parking is horrible, where will they park when you double the size of the building. You must provide parking for business. There is always more than one vehicle, cones are used for parking. Response - Verizon has spoken to crews, aware of problem, using Dolphin Restaurant parking, have spoken with the Smiths (owners). Only during installation should it be a problem. Jansson said trucks are all over and causing problems. He is inclined to grant relief but wants problem resolved. Parking space needs are determined by square footage. Traczyk said if it's an industrial use, 4 spaces are needed Boy asked if the Board has a copy of Site Plan Review approval and he read the ordinance on telephone exchanges — it references 3 employees at one time, screening of parking, therefore it should have parking for three employees. Applicant said it is time to say site no longer fits our needs and we need to expand. Jansson said he does not see that conditions are met for a variance. The architect noted that the driveway is used as parking and Jansson asked if isn't it dedicated to public use? If there are no rights, then it can be used as parking. The architect said there are no easements. There is another drive on other side of restaurant. Childs asked if there is an existing second floor—no. Creedon said assume there is a great hardship to relocate, is there any uniqueness to the lot? There would be substantial financial hardship, what is uniqueness. Answer - all the other phone facilityunderground cables come into that building, as the were built over the ears. Bo — g g Y Y Y almost agrees that it is time to move,but is flexible. They must adjust parking. The architect replied that he tried to design the bulk of the building to look and size of other street buildings, no visual impact to neighborhood. Boy asked why stairway? Code. Boy said it would be easy without exterior stairs,just need a special permit. The telephone exchange is permitted as conditional use. It's use is a legal pre-existing use. Charlie Petano, real estate construction manager for New England said costs to move a central office are huge—it has only happened once, in Maine, there is a$5-7 million value in equipment, logistics are impossible. The expansion of the town has created the need. The time frame is 6 years. If they must relocate,there would be massive digging of cable, loss of service. The switch they are expanding is high speed access, data lines, local and long distance service. The demands of community demands expansion of facility. Jansson replied the needs will probably grow but cannot be foretold. Where do we draw the line? Co-locate in another area? Creedon asked- have you looked at acquiring additional land? Answer- don't know. Nightingale asked where will be air conditioners? Answer- inside, condensers to be relocated to mechanical platform in rear of building, away from Route 6A, no more noise. Boy asked about the loading dock— it's a fuel tank—condensers will go over. He asked - what is setback? 23.5' rear setback, Code is 20' Verizon will need all sidelines variances, parking, screening, looking for six variances. Public Comment: Robert Kelley spoke on behalf of the Dolphin Restaurant. Parking is a problem but is talking with Verizon. They are trying to be a good neighbor. The parking lot is a post office pass thru. There can be no construction in the summer. Parking is very tight. Equipment in the alley cuts down on use of the driveway. The Dolphin owns much of the rear parking lot, allows use in day, exclusive use at night. The parking is necessary to meet restaurant seating requirements. We are not against the addition, we know it is needed, but we want consideration as to what's going on. Discussions are on-going, doesn't want permit issuances to end negotiations. There were no other comments. for or against the application. Boy commented that the financial aspect is astronomical, but parking must be resolved in writing. Jansson felt it should include parking variance. The applicant asked if can he apply for special permit on conditional use aspect. Yes, the code is not met with 2 spaces. As the code on telephone exchange permits 3 full time employees, there is a need for 3 parking spaces, no other code known. Gilmore asked how do you deal with uniqueness? Boy said there is no land. And the cost to relocate is out of reach. There is a code under all other uses - but no determination has been made by the building commissioner. Boy said 3 spaces will be good, moving would not be realistic Gilmore said minituration may be an answer, but we can't precipitate the future. Creedon suggested a continuance to explore others options The hearing was continued to September 5 at 7:30 Jansson then read a letter from Attorney Patrick Butler regarding Aunt Sarah's House and a question on whether it was necessary to come before the Board again for a reduction in the number of proposed units, or was this a deminimus issue. Appeals 2001-82, 83 &84 Cape Cod Five Cents Savings Board members assigned: Dan Creedon, Dick Boy, Ralph Copeland, Tom DeRiemer, Ron Jansson, Alternates present: Randy Childs, Jerry Gilmore Attorney Meyer Singer, represented the petitioner. Mr. Singer explained the revised site plan that was submitted to the board, which has been approved by that committee. Mr. Singer submitted a letter of approval from site plan dated August 31, 2001, and a letter of support from two Quaker Road abutters, Great Western Trust and Rosebud Trust, Additionally, Mr. Singer submitted a letter from Vanasse and Associates, transportation engineers and planners, who had been requested to review the bank expansion plan. Mr. Singer explained the changes that were made to the plan, effecting traffic flow, and the removal of three parking spaces. Dorr Foxx of the Cape Cod Commission did review the proposal and informed Mr. Singer that the proposal does not need Cape Cod Commission review. Barnstable Building Commissioner, Peter DeMatteo, explained that he had reviewed the proposal, and with clarification from the commission, agreed that the proposal was under 10,000 sq.ft. Members of the board discussed with Mr. Singer pedestrian traffic and safety issues that need to be taken into consideration in granting a permit. Mr. DeRiemer and Mr. Singer discussed the drive-thru window and the entry and exits. Mr. Singer used the presentation charts to illustrate the flow of traffic and discussed left turn in and out with the members of the board. Mr. Creedon suggested that the curb-cut be moved back on Quaker Road, and stated that he could not support a proposal with a curb-cut as close to Route 28 as shown on the plan. Mr. Creedon expressed his concern over the possibility of vehicles queuing on Route 28. Members of the board discussed their safe and traffic concerns with Mr. Singer and continued the hearing to safety 9 9 November 7", 2001 to be taken up at 7:30PM be executed between the developer and the Barnstable Housing Authority, the Monitoring Agent. The applicant shall use the Regulatory Agreement and Deed Restriction model developed by the Town's Legal Department. Both documents shall stipulate that affordable units will be affordable in perpetuity, and include language establishing an expanded notification procedure for re-sale.
