Jones represented the petitioner who is seeking a variance to use an existing barn as an art gallery which would be operated by his wife on an "appointment only" basis. Mrs. McCubrey would be the sole employee and presently fills orders for art prints which she receives in the mail'. The proposed use would simply be an extension of the use Mrs. McCubrey is now carrying on. The property . in question is across the street from the MadDuck Restaurant which was formerly the Bacon Farm. The Zoning Appeals Board granted permission to convert the barn into a residence in .1974, however, the petitioner found this conversion too costly and the permit was not utilized. Appeal 1974-52 also allowed the subdivision of one lot containing the barn and nursing home into two lots; one lot containing the barn and the second lot the nursing home. In 1978 the petitioner asked the Zoning Board of Appeals for permission to establish an art gallery ,in this same barn and the Board found that a variance should have been requested rather than a special permit and did not allow the appeal since it had been improperly filed. The petitioner can provide parking for 20 cars on-site and ,they would like a small sign for their patrons. The barn is infested with termites ..and is in a state of disrepair. There would be no exterior changes made to the barn with the exception of adding some windows in the rear. This barn was built in the 1800's and has historical significance. Allowing the petition would upgrade the property and preserve an historical building which would be in keeping with the spirit and intent of the zoning by-laws and would not cause detriment to the neighborhood. No one spoke in favor of the petition and Ed Elliott, pastor of the Unitarian Church across the street from this property,said that he did not necessarily object to the petition but felt that allowing the use of the barn as an art gallery might be setting a commercial pre- cedent for the area which is now residential. The Board' took the matter under advise- ment. The Board voted unanimously to grant the petitioner a restricted variance to establish an art gallery in an existing barn on route 6A, Cummaquid. The Board found that the proposed use of this structure, if limited to appointment only clients, would not be detrimental to the neighborhood and would preserve an historic building which other- wise might eventually .be demolished. Attorney Stephen C. Jones represented Petitioner. Although a lot containing two buildings is allowed to subdivide under the subdivision control law, since, in this case, there is a non-conforming use on the locus, which is to be maintained, and the lot to contain the dwelling, conforming use will be nor-conforming in size, there is A question as to whether or not the Building Inspector could issue a building permit for the conversion of the barn to a single family dwelling on a lot with insufficient frontage. Therefore, Petitioner seeks a variance to allow single family residence on lot with less'than 10% insufficiency in frontage and sufficient square footage. In order to convert barn to residence for Petitioner and his family, it is necessary to subdivide locus into two lots,_ one with nursing home (non-conforming use) on lot contain 30,000 square feet and having 125 feet of frontage (conforming lot), and the other containing barn on lot with 241,000 square "feet but only 115 feet of frontage. This insufficiency of frontage is less than 10% and due to unique situation of abutting a private way, which Petitioner has been unable to purchase, this would not cause undue clustering of buildings and, therefore, would not be detrimental to the area nor in derogation of the by-law. In addition, the conversion of this barn to a residence, without substantial exterior change, would assure continued maintenance of same and preserve an historic landmark, thereby benefitting the public good. The Board found that this was a,minimAl request; that to allow a large piece of property like this to stand and be used as a barn only with less than 10% under the required frontage would be a hardships of at is unique to the area and would not be detrimental to that area nor in derogation of the Barnstable Zoning By-Law. Therefore, due to the rainimal nature of this request, the Board voted unanimously to grant this variance to convert barn to residence on lot with insufficient frontage. Under the Zoning Bnabling Act in place when decision 1.974-52 was made, there was no time limit within which the variance must be exercised other than, perhaps, "radically changed conditions at the locus, including changes bxought about by revisions of a zoning ordinance or by-law" , see Hogan v, Hayes, 474NE2d1158 (1162) , Copy enclosed. In that case, the Court, in dictum, suggested that a variance issued prior to the effective date of Chapter 808 of the Acts of 197:5 (in Barnstable that date was November 5, 1977) , probably has unlimited life subject to the above cited radical changes possibly terminating the rights granted thereunder. .In ZBA case 1996-35 which concerned itself with the 'use of LOT I the issue of lot size and division of ownership of LOTS 1 and 2 was raised by the Board, decision 1974-52, was reviewed and the Board satisfied itself on those issues. If the increase in the dimensional requirements in :1977 was the "radical change" referred to in Hogan v, Hayes, then possibly an argument could be made that the variance in 1974-52 had lapsed by the time the plan was endorsed in 1976, although the plan was endorsed within a year after the effective date of the current .Zoning Act . However, the Zoning Beard of Appeals has blessed the subdivision as set forth above in its 1996 decision and the intended use of LOT 2 is a conforming use, i . e. residential both of which would argue against a "radical change" , The relief granted in decision 1974-52 was to divide the land and convert the Barn into a single family residence , The relief has been partially exercised by the submission and endorsement of the 1978 plan and the remaining relief of conversion to a single family residence is what is now planned. The property is addressed as 3401 Route 6A, Barnstable, MA. The locus of this appeal is shown on the Assessor's Maps as Map 299/Parcel 44-1. The property is located in the RF-2 Zoning District which allows single-family residences and accessory uses by right, with rental to lodgers, golf courses, stables and family apartments allowed as conditional uses. The property currently is the site of the Village Haven Rest Home. It has been the site of a rest home since 1965 and prior to that was a guest house since 1956 (information from Barnstable Historic Preservation Department.) The building is shown as two and a half stories with a total of 5,488 square feet. The amount of the addition will total 2, 050 sq. ft. (1,025 sq. ft. per floor x two stories.) The Petitioner has bought plans for the proposed Assisted Living Facility to Site Plan Review, which reviewed his proposal February 29, 1996. Petitioner's plans have also been approved by Old King's Highway Historic District. The building appears to have last been remodeled in 1980 based on Assessor's records. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on February 6, 1996. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened on April 10, 1996 and continued to April 17, 1996, at which time the Board found to grant the appeal with conditions. Board Members hearing this appeal were Richard Boy, Emmett Glynn, Tom DeRiemer, Gene Burman, and Acting Chairman Ron Jansson. Attorney Michael Ford represented the Petitioner, Stephen Austin, who was also present. Attorney Ford submitted a Memorandum in support of this appeal and stated that Mr. Austin has a Purchase -I Zoning Board of Appeals-Decision and Notice Appeal Number 1996-35-Austin and Sales Agreement for the property which is owned by A.G.E. Real Estate Trust, Karen Lynch, Trustee,._ The property is the current location of the Village Haven Rest Home, a 25 bed rest home facility which is no longer in business. The applicant wants to convert the present nursing home use to an assisted living facility and reduce.the number of beds from 25 to 20. There is no parking area currently laid out for the rest home. The reduction of beds will be in keeping with the parking requirements set by Site Plan Review. The project has been approved by Site Plan Review and has obtained a Certificate of Appropriateness for the addition from.the Old King's Highway Historic District Commission. An Order of Conditions has been issued by the Conservation Commission. Attorney Ford stated that at Site Plan Review there was still an issue of the amount of parking for the building. The five spaces on the plan are for staff only. Although the occupants of the facility are not allowed to have cars, there is still a need for parking for any visitors that might come to the site. The Petitioner has obtained written permission for the use of the 40 car parking lot at the Church across the street on Route 6A. The only other concern at Site Plan Review was the need for an established referral system in place for the residents. Mr. Austin has a letter from the Cape Cod Hospital stating their willingness to be available to accept referrals for residents that are in need of 24 hour nursing service. Attorney Ford explained the difference between a nursing home and an assisted living facility. A nursing home and an assisted living facility have different levels of care, but both are governed by statutory and regulatory regulations. As an example, in an assisted living facility each room has to be provided with a private half bathroom. The entire building will be brought up to state code inside and outside including new doors and windows. Attorney Ford stressed that there is a need for this type of facility and this will be an improvement to the area and in no way detrimental to the area. Building Commissioner Ralph Crossen agreed the project has Site Plan Review approval and their only request was that the facility itself not be locked due for safety reasons. Board Member Ron Jansson asked Attorney Ford about the lot size and any division of this lot and the neighboring lot. Mr. Ford was unsure about any division and stated he would review the history of the lot. There is also a question regarding ownership of the two lots. Mr. Ford stated he would provide the Board with information regarding the history at the continuance'of this appeal. Due to the unresolved issue regarding the unpaid.taxes, and the question of common ownership to the adjoining lot and if there are any Variances on the parcel, Appeal Number 1996-35 was continued to April 17, 1996 at which time Attorney Ford stated that the taxes have been addressed and Mr. Ford submitted a copy of an ANR plan from 1978. The lot that contains the subject property was in conformance within this ANR plan and there was a Variance granted for the adjacent lot that contained the barn (*1974-52). The public was requested to testify. No one spoke in opposition and no one spoke in favor of this appeal. FINDINGS OF FACT: Based upon the testimony given during the Public Hearing on Appeal Number 1996-35 for a Special Permit, the Board unanimously found the following findings of fact: 1. The Property is located at 3401 Route 6A, Barnstable, MA on Assessor's Map 299, Parcel 44-1, in an RF-2 Residential F-2 Zoning District, a GP -Groundwater Overlay Protection District, and an AP-Aquifer Protection District. This building is serviced by town sewer and town water. 2. There is.a total of two and one half stories with a total of 5,488 sq. ft. The amount of the addition will total 2,050 sq. ft. (1,025 sq. ft. per floor x two stories). 3. The Applicant is seeking a Special Permit under Section 4-4.5 Nonconforming Use, to allow the change of a nonconforming use, a nursing home/convalescent home (25 beds) to another nonconforming use, an Assisted Living Facility (20 beds). These uses are very similar under the Zoning Ordinance. 6. The new use will be less intense as the number of beds is being reduced from 25 beds to 20 beds. 7. While there is an addition to the site, that addition is only to allow the applicant to meet the new requirements under the CMR for an Assisted Living Facility where each room has to be provided with a private half bathroom for each unit, equipped with a lavatory and a toilet. The additional space is necessary to meet this particular requirement. The Petitioner has obtained all the necessary approvals from the Old Kings Highway Historic District Committee and the Conservation Commission for such an expansion. 8. The proposed change in use would not be substantially more detrimental or objectionable to the neighborhood, nor in derogation of the spirit and intent of the Zoning Ordinance. 9. The residents will not be allowed the use of motor vehicles. MOTION: Based on the findings, a motion was made and seconded in Appeal Number 1996-34 to grant the Special Permit being sought with the following conditions:. 1. No resident of the facility may have a car. 2. The proposed addition is to be built as per plans submitted entitled Site Plan of Land in Barnstable, MA for Mr. Steven Austin dated January 25, 1996. 3. The number of beds will be reduced from 25 beds to 20 beds. 4. The Petitioner must comply with all provisions of the Site Plan Review Committee. 5.
