Jones,Inspector DATE: 4/17/02 RE: Complaint, 3512 Main Street,Barnstable This office received a complaint from Robert Mazzola of 3512 Main Street, Barnstable, Unit 6, about work being done without permits. The following units were given permission by the Old Kings Highway Historic District Committee on December 12, 2002, permit number 2001-246, to replace five (5) windows with approved doors and to match existing steps: Conathan—Unit 1; Johnson—Unit 2; Copon/Murphy—Unit 4; Topar—Unit 7, and Acher—Unit 9. The owner of Unit 7 has an express building permit#59238 issued on February 20, 2002. I measured the platform and steps and they are in compliance. I measured Unit 9 platform and steps (Acher), and it is not in compliance. The platform is 48" x 60" with steps. There is no building permit for this work, and I posted a stop work order. It does not meet the OKH permit and there is no building permit issued. It is my understanding that all platforms and steps are to meet the OKH permit that was issued to them. In some situations the platform can be lowered where only one step is needed. Conathan (Unit 1) and Johnson (Unit 2)have not started work. Michael Walsh resides with me at Windswept Farms, 3512 Main Street Unit#2, Barnstable, MA 02630. At the time Michael moved in with me all Trustees had been notified and this move was accepted by all of the Trustees, Walter Topor, Helen Seward and Roger Capone. Michael Walsh is employed by Hyannis Saab and is the Manager for their used car division, Bourne Bridge Motors in Pocasset. One of his responsibilities is to move cars from one car lot to the other. Mr. Walsh is authorized by the dealership to drive home different cars, which could be a different car each night. These cars do have the dealer license plate on them. Mr. Walsh does not conduct any kind of business on the premises. All of his car sales are done at the dealership. The three complaints you have received, I am sure, came from Robert Mozzola, Jacqueline Young and Audrey Olmstead. They are chronic complainers and well known to all of the Trustees. The Trustees have received numerous complaints from the above in regards to the above complaint and they have found them unsubstantiated and rejected these complaints on more than one occasion. Rather than testing the elevator-block walls, I would want to see the second and ..third floor blocks removed. I am concerned about the fact that the elevator will be in constant use and the best testis to rebuild the above mentioned area. It .also appears that the properly compacted floor area under the concrete slab is sound. We will have. to wait until the saturated debris is re- moved for further evaluation. Buildings which have had such concentrated fire and smoke damage always seem to maintain a smokey odor, and -in this case possibly the concrete floor which of course is of porous aggregate. Mr. Jack Ashley to determine what effects the fire of 11. November 1981. . had on the ability of the structural frame to support design loadings. Our observations follow. The roof rafters and supporting bearing walls, beams and posts. are. gone or severely scorched in the central three-quarters of the building. The roof areas that remain, adjacent to each gable end wall. are unsupported and severely damaged. The lofts and third floors have collapsed in the central three-quarters of the building along with. their supporting stud bearing walls. . The second floor is similarly missing. and severely damaged in the central two-thirds of the building. Easterly and westerly exterior stud bearing walls have fire damage from the second floor to roof and shows lateral and transverse rotations from their plumb lines .to the foundation line. North and south gable end walls show fire damage from the second floor line to the roof.. The northerly gable end studs are missing or damaged in its central portion from the first to .third floors. The northerly and easterly single story shed structures remain. but have evidence of heat and smoke intrusion :in the rafter-ceiling plenum. Supporting interior stud bearing walls, beams and wood posts`_are partially scorched. Exterior north and east stud bearing .walls show. no indications. of fire damage. However, there is evidence of water intrusion, to a level with the window sill lines. The southerly main entrance portico roof structure and supporting columns have not been damaged. The masonry elevator shaft shows evidence of having been subjected to severe heat and is smoke stained. Isolated mortar block. joints may be pulverized when hammered. r -2- December 2, 1981 The Centerville Corporation Concrete floor slabs on fill, framed concrete floor slabs and beams, and exterior concrete foundation walls have not been damaged as a result of the fire, except in the north stair hall area where pul- verization of the concrete floor slab has occured. Our observations and investigations of the damage to the structural frame lead us to conclude that. the timber structure has been subjected to varied degrees of fire, heat , smoke and water influences. Since, in my opinion, the capability of the remaining wood structure to resist external design forces is questionable the entire remaining wood frame shall be removed. to the foundation level by means of crane and clam shell . Salvagability of non-structural members shall be determined by others after the timber construction . has been removed. Samples of mortar and concrete masonry units from the elevator shaft shall be tested in random locations by a qualified, licensed testing laboratory to determine that working stresses are within allowable limits. Cores shall also be taken from the concrete slabs in areas where heat was extreme and similarly tested. Masonry and concrete materials that do not meet applicable strength criteria shall be removed. Alger represented the petitioner, Architectural Conservation Trust of Massachusetts (ACT) and introduced Messrs. Martin Adler, Andy Burns, Rick Lamb and Charles Tseckares; all of whom are associated with the project which is to convert an existing non-conforming exhibition hall on route 6A in Barnstable into 13 single-family condominium units. ACT is a private, non-profit organization and its purpose is to preserve buildings with historic significance by identifying economically feasible uses for them. The building in question was formerly used as the exhibition hall for the Barnstable County Agricultural Society and was constructed in 1862. This building has been used for light industrial uses and its last use was as a storage area for fishing nets and related equipment. The Mass. Historical Commission has determined that the building has historic significance and is in the process of nominating this building for the register of National Historical Buildings. The building is owned- by the Bass River Savings Bank. Atty. .Alger said that the highest and best use for the property is for a 13 single-unit condominium with all exterior construction done in such a manner. that the building will be restored to its front etc. Federal grant money may be original appearance with pillars on the available to the petitioners in the form of a low interest loan which must be re-paid. The Cape Cod Planning and Economic Development Commission was contacted by the Mass. Historical Commission who in turn, contacted ACT. A history of ACT and its functions was explained by Andy Burns, .their business manager. Mr. Carl Fraser asked if this use would set a precedent for the area. He questioned the possibility of his hooking into the sewer when it is brought to the site of the proposed condominiums. Mr. Burns said this would be looked into and suggested that Mr. Fraser contact the Barnstable Dept. of Public Works on this matter. Atty. Alger. said that allowing the proposed use would not set a precedent since each petition before the Board is judged on its own merits and due to the uniqueness of the property' in question, the conditions present on this petition could not be duplicated on another appeal. Mr. Scott Himstead spoke in favor of the petition and said his one question concerned the parking in front of the building and screen- ing the tennis courts. Mr. Rick Lamb, the landscape architect for this project,. said the front parking will be limited to seven units and the tennis courts will be screened. There will be no commercial use made of the tennis courts and their use will be for condominium owners and their guests. In the front of the building, next to 6A, there will be a 2 ft. earth berm with plantings. Mrs. Gladys Reed spoke in favor of the petition and represented the Cape Cod Art Association. Dr. Ringler, president of the Barnstable Civic Assoc. spoke in favor of the condominium use. Mr. Rockwood Clark of the Cape Cod Planning and Economic Development Commission explained the process by which they (CCPEDC) had become involved in this project. Mr. Basil Edwards spoke in favor. of the petition and said he felt, however, that the use should be restricted to six units only. Atty. Alger said that generally, condominium units are occupied by adults and since the largest unit they would have in the building would have two .bedrooms, there will probably be 26 adults in total occupying this condominium and six houses with an average of four people to each house would result in '24 persons in total. Since the number-of persons occupying either private residences which could be built at the locus and the number of persons occupying the condominiums would be about equal; the advantage of the condominium use would be that coverage of the total land area would be far less thus preserving open space which might otherwise be covered by houses, garages, roads etc. Mrs. Judith Barnett spoke in favor of the petition. - Mr. William Larkin spoke in objection and said that the mortgage holder, Bass River Savings Bank, was trying to unload a bad investment and the property is a white elephant. He questioned the financial hardship to the bank and said that in this case hardship could not be proved. Mr. Richard Arms was opposed and said he , lives within 200 ft. of -the property and the building is nothing but a shell and not, worth preserving since it would have to be almost entirely rebuilt. Mr. Arms said there is an existing easement across the property to the water. In his rebuttal, Atty. Alger said there is a 15 ft. right of way and an easement to the .telephone company on the property and in answer to Mr. Arms' objections, Atty.
