Our concerns are: 1: We understand the owners of Red Wing lane will not let them use Red Wing lane for access. 2: I believe that they are planning to use a right-of way across our property. This right-of way is located in an area designated as wetlands. This was a concern when we built. 3: If they were to use our land as an access, we would want them to install the driveway in the middle of the right of way. I believe they are planning to install it to the West at the edge of the 50 foot right of away. 4: They are also required to go through Historical as they are to the North of 6 and in the district. You asked how I liked the fence? I am sure we will get used to it, we were a little surprised'when it went up. I don't know if you knew we were against a fence going up at this time. At the meeting we had suggested that you wait until your house location and plans were finalized before the fence went up. It's your land and you should be able to do what you want with it. Enough about the fence! I am sure you are excited about building. On two different occasions I have talked to Debbie, and requested that we get together on the driveway planning. I mentioned to George,that I had talked to the state about the so-called wet lands. They thought we could over turn the findings of the local conservation commission. I understand that George went to the state and verified my findings. We will be glad to work with you on getting the driveway approved. Our only concern is that it be placed as far to the east as possible. As you might be aware, when your father built the Clinger's driveway it was built to the extreme easterly side of the fifty-foot right of way. I would expect the same for your driveway over our property. This would give both of us the most privacy when you are using the driveway. If you walk the area to the east you will find it very flat most of the way. Of course it would be great if you could use Red Wing Lane for access. The other concern we have is the expense we had to go through to build the over 800 feet of driveway to the south of the fifty-foot right of way. As you know, we went to a great amount of trouble and expense in getting approval, and building the driveway. We also had to acquire additional land at 6A before we could get a curb cut from the state. We would expect that you would pay your share of the development costs of the driveway from our property to 6A, and also share in the maintenance of the driveway. I hope that we can work things out, and you do not have to go through the aggravation and extra expenses we went through to build our home. . DEFINITION OF HOMEOWNER Person(s)who owns a parcel of land on which he/she resides or intends to reside, on which there is,or is intended to be, a one or two-family dwelling, attached or detached structures accessory to such use and/or farm structures. A person who constructs more than one home in a two-year period shall not be considered a homeowner. Such "homeowner"shall submit to the Building Official on a form acceptable to the Building Official,that he/she shall be responsible for all such work performed under the building permit. (Section 109.1.1) The undersigned"homeowner"assumes responsibility for compliance with the State Building Code and other applicable codes,bylaws,rules and regulations. HOMEOWNER'S EXEMPTION The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions of this section(Section 109.1.1-Licensing of construction Supervisors);provided that if the homeowner engages a person(s)for hire to do such work,that such Homeowner shall act as supervisor." Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q; Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application, that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used by several towns. You may care t amend and adopt such a form/certification for use in your community. I was told that our Old Kings District certificate has expired. This is why I was so determined as to not let our building permit expire. Section 6 of the Old King's Highway Regional Historic District Commission states that " All certificates issued pursuant to this Act shall expire one year from the date of issue, or upon the date of any building permit issued as to the work authorized by said certificate, whichever expiration date should be later." This means that if you had honored my extension as I believed I had applied for in my letter of June 29, 1998,the certification would still be in effect and I would be able to get my new permit as you requested me to do. It is a shame that I have to have another hearing before the Historical Commission My wife and I would like you to reconsider your position on our extension letter dated June 29, 1998. We were of the understanding that our present permit was good through February 6, 1999. I ant enclosing for your convenience a copy of a pertinent plan of land and deed with respect to the property and its access. Lot #5, the subject property, has no rights to access and egress on Red Wing Lane. All property rights and obligations concerning Red Wing Lane are owned. by the properties on the easterly border of Red Wing Lane in the vicinity of Lot#5. Access to this parcel is therefore purportedly according to a 1.5' wide right of way over the Lot which abuts Route 6A now or formerly of Stephen C. Jones, Trustee in Plan Book 335, Page 24 at the Barnstable Registry of Deeds. Access to Lot #5 is provided over Lot #4 by a 50' wide easement running on the easterly border of Lot #4. Access to Lot #4 is purportedly pursuant to the 15' wide right of way over the southerly Lot which is referred to as now or formerly of Carlton H. Bourne, now or formerly of Stephen C. Jones, Trustee. The original grant of the 15' wide right of way was of an undefined way as set forth within the deed from Carlton H. Bourne to Manual L. Goulart and Emily A. Second, in 1987 when this subdivision occurred, wasn't there a mm mum width requirement 20' for a ri h which,would mean that the su sion s ould not have received approv . Third, I believe your records would reflect whether or not this subdivision plan was submitted ANR (approval not required). If this is so, then wouldn't there be a seven year limitations period for grandfathering purposes by which Mr. Munsell could use the ways in the subdivision plan? This seven year period would have lapsed in 1994. Prior to pursuing any action that might be available to my client, I would appreciate receiving your insight as to the buildability of Lot #5 in light of the issues that I have addressed above.
