Giangregorio I met with the On Site Maintenance Manger, Bob, yesterday to review a glassed-in area of approximately 144 sq. feet. A vendor has proposed renting this space (month to - month) as a retail use. I am informed that this area has been previously used as a display area for a real estate business, a ticket agency and a lottery/newspaper booth. There is only one means of egress. This area is handicap accessible as the doorway is 42" wide. There is no lav but a restroom is available on the second floor(for vendor use only). This requires approximately 80' of traveling. Utilities are provided to this unit. I discussed this request with Gloria Urenas and Tom Perry, both of whom confirmed the previous uses. It was determined during this discussion that this proposal would be a retail to retail use without abandonment and therefore could be allowed. The needed relief follows: 1. Unit#2 in 1992 had a grandfathered service use"Cobbler's Corner". This use was abandoned and replaced by"Kenmark"which is a retail/service use. 2. Unit#3 in 1992 had a grandfathered health club which was abandoned and replaced by"Kenmark", which is a retain/service use. 3. Unit#23 in 1992 had a grandfathered real estate office use which was abandoned and replaced by "Cape Cod Custom Floor"which is a retail/service use. 4. Unit#27 in 1992 had a grandfathered retail use"Pandora's Closet",which was abandoned and replaced with"Cobbler's Corner",which is a retail/service use. 5. Unit#40 had in 1992 an office use which is now being proposed as a medical clinic. In addition,we note that units#25 and#32 are now vacant. As soon as you line up a prospective tenant,please call us,as due to the restrictions in this district and to avoid any future problems, prescreening is needed. You may, however,apply for special permits for unrestricted retail use on both if you wish to expand the marketability of these two units. In summary,the previous 5 numbered examples require special permits from the Zoning Board of Appeals. I would recommend that Units#25 and#32 also get special permits as I have said. Additionally,any change of any tenant in the future needs to be prescreened by us to avoid any problems. One additional consideration for Units#29-#41 is handicapped accessibility. The uses currently in effect that are open to the public are not accessible. You will have to either provide this access (elevators)or change the uses to office uses that are not open to the public. The plans for the medical unit that you submitted show a Cab Lift unit,and while this meets the criteria for access,it needs a variance from the state before a building permit can be issued. After the site plan was approved, I was contacted by Mr. Marcel Poyant objecting to the plan showing a connector between the properties. He stated he was never contacted and never gave permission for entry onto his property. I then contacted the principals and Fire Chief Farrington and we met on site. Chief Farrington felt it would be advantageous for fire safety to use that entry with a locked chain gate for fire service. However, that would be trespassing. I asked Mr. Craig short, the engineer of the project to eliminate the entry - which he did.
