DEFINITION OF HOMEOWNER: Person(s)• who owns a parcel of land on which he/she resides or intends to re- side, on which there is, or is intended to be, a one or two family dwelling, attached or detached structures accessory to such use and/or farm structures. A person who constructs more than one home in a two-year period shall not be considered a homeowner. Such "homeowner" shall submit to the Building Official on a form accerptable to the Building Official, that he/she shall be responsible for all such work performed under the building permit. Assessor's Map/Parcel: 010/003 & 004 Zoning: RF - Residential F District Zoning overlay District: GP - Groundwater Protection Applicant's Request: Special Permit - section 4-4.2 - Change from One Non-Conforming use to Another, to modify an existing special Permit #1983-20 to permit the premises to be used for Office or Retail use. Procedural Provisions: Section 5-3.3 special Permit Provisions. Background: This decision concerns the petition submitted by Ronald J. Mycock on behalf of Charles and Sharon Maher, requesting to modify a 1983 Special Permit, #1983- 20. That special Permit allowed the Mahers to craft and sale doll houses and doll house miniatures on the site. They are seeking now the allow the premises to be used for office or Retail use. special Permit #1983-20 is issued to two lots #3 & #4, totaling 1.1 acres. The property is developed with a 936 sq.ft. principal structure, a 600 sq.ft. garage and a 240 sq.ft. carport (1,776 total gross sq.ft.) . The permit provided for one additional employee on-site. Procedural Summary: The application was filed in the offices of the Town Clerk and at the Zoning Board of Appeals office on September 22, 1992. A public hearing duly noticed under M.G.L. chapter 40-A was opened on October 08, ,1992 and continued to October 22, 1992 at which time the hearing was closed and a decision was rendered by the Board. The petition was heard by Board Members: Gale Nightingale, Ron Jansson, Dexter Bliss, Luke Lally and Chairman, Richard Boy. Ronald J. Mycock represented the petition before the Board. He discussed the history of the site and the activities on the land. In 1983, the special Permit was issued in conformance with the Zoning at that time, which was BL-C, ,Appeal No. 1992-59 Decision and Notice Business Limited C District. That distri t permitted small retail businesses common to a residential districts" by the ance of a Special Permit prom the zoning Board of Appeals. The Mahers were issued a special Permit with conditions as described above. They operated that business from 1983 to 1991 and during the last three years (from 1989) have marketed the site for sale. During this time, it became apparent that the existing use with its restrictions may not be economically viable today. This is the reason for todays request to modify the existing Special Permit to permit office or retail use. The applicant cite t a t eh structure does not cont is n a kitchen and would not be considered .a residential dwelling without one. He also noted that surrounding land uses are retail business. The site plan titled "sketch Plan for Ronald Mycock, located on Route 130, Mashpee, MA" and dated August 24, 1992 was discussed. The applicant cited that the plan was approved with conditions by Site Plan Review (Number SP-17- 92) and that no expansion of the existing structures was proposed. The parking for 14 cars is what exists today. The Board questioned the applicant on the exact nature of proposed offices or retail uses that are contemplated. They also questioned what exactly was approved in site plan review - office or retail and if two uses can be permitted on-site in accordance with the Zoning ordinance. The public was invited to speak on the merits of the proposal. No one spoke in favor or in opposition to the petition. The Board decided to continue this mater to the meeting of October 22 to permit the applicant to detail his proposed uses of the buildings and to allow the Board to review the petition. At the meeting of October 22, the applicant Mr. Mycock agreed that the special Permit with limitations to general office use was acceptable to the owners of the property. The Board discussed to who the Special Permit is to be issued. FIND OF FACTS: Base upon the evidence submitted and the Testimony given at the public hearing on Appeal No 1992-59, The zoning Board of Appeals found: 1. The petitioner currently holds a special Permit granted by the Board in Appeal No. 1983-20. 2. Under the terms and conditions of the Special Permit,. the petitioner is entitled to operate the retail sales of doll houses and miniatures on the property. 3. zoning of the property has changed from the date of the granting the Special Permit, from BL-C, Business Limited C District, to an RF, Residential F District. Appeal No. 1992-59 "Decision and Notice • 4. The proposed use of the premis=aSofficeis, within the existin footprint of the buildings, wotantially moredetrimental to the neighborhoo 5. The petitioner has an approved site plan with conditions imposed by Site Plan Review Committee. 6. No evidence has been presented to the Board to indicate that a change from retail use to office use is objectionable to the surrounding neighbors. No one objected to the applicant's proposal during the hearing. The vote on the findings was as follows: Aye: Ron Jansson, Dexter Bliss, Luke Lally and Chairman, Richard Boy Nay: Gale Nightingale Conclusion: Accordingly, based upon the findings, a motion was duly made and seconded that Appeal No.1992-59 for a modification of an existing special Permit (#1983-20) be granted to changing the current use from small retail use to office use, subject to the following conditions: 1. The use shall be office use only, limited to not more than two (2) separate offices. 2. office use shall exclude banking, medical, chiropractic medicine and any other office use which shall generate amounts. of traffic greater than what the existing roadway can handle, as determined by the Building Commission. 3. There shall be no more than six (6) persons employed on the property at any one time, and' a total of ten (10) parking spaces provided. 4. The existing structures shall not be expanded beyond the existing footprint, nor the existing height. 5. Parking shall be as set forth in the approved site plan, titled "Sketch Plan for Ronald Mycock, located on Route 130, Nashpee, MA" and dated August 24, 1992. 6. The petitioner shall comply with all of the recommendations of the Site Plan Review committee as stated in the letter of .September 21, 1992 (Site Plan Review File 17-92) which contains three conditions as follows: I 1. all requirements of the Board of Health; 2. all requirements of the Conservation commission; and 3. the driveway shall be widened to sixteen (16) feet. 7. The two lots, 3 and 4, shall be considered and united as one. Appeal No. 1992-59 Decision and Notice 8. Nothing shall be done on the property which shall impact the GP - Groundwater Protection overlay District. 9. No curb cut permit shall be permitted onto Route 28. The vote was as follows: Aye: Ron Jansson, Dexter Bliss, Luke Lally and Chairman, Richard Boy Nay: Gale Nightingale Order: Appeal No. 1992-59 to modify and existing special Permit has been granted with Conditions.
