Donahue, Esq. Mr. Donahue stated that the Petitioners were seekin3 permission to remodel an existing garage for apartment usee.. He stated that the property had been used for rental apartments since 1947, prior to the adoption of any zoning in this area. The existing' building has four (4) dwelling units and it is the Petitioners► intention to. convert the garage into a three O Y room apartment consisting of a living room., bedroom, kitchen and bath. There is to be no change in the exterior of the builaixgp-• The Attorney said that there was sufficient parking on the premisesand there was also parking across the street,, which the. Petitioners had permission to use. . It was the Attorney' s opinion that the proposed conversion, of the garage was a reasonable extension of the present use. It was the opinion of the Board that the conversion of the garage would not be detrimental to the area. The present building was originally a part of a larger rental complex and had been used for apartments for many years prior to zoning. Explained that the COI inspections will inspect for the number of units found and that inspector makes no judgment on the grandfathering of units. A unit must be legally created to be grandfathered. Clearly, this unit was created after the ZBA decision. Explained that only the ZBA can change the number given. He can appeal our decision to the ZBA to over turn the opinion of this unit being illegally created (but his own application in 1971 hurts him) or he can appeal to amend the number of units in which case he would need to bring that unit up to code. He asked how long the process it—I advised he say that it averages 6 months. He said he would'be in Fla. Building staff was notified and asked to research the property but given an invalid address (#28). Staff was unsure of the actual location which delayed our progress. Once I verified that the subject property is actually 32 Dartmouth, I had Brenda call the owner to arrange for an annual COI inspection explaining that we needed to gain admittance to every unit. An appointment was arranged without hesitation. I contacted Lt Cosmo to join us as he was previously notified too late The owner purchased the property in or about1968 and filed an appeal (1971-7)with the ZBA to convert a garage with an existing bathroom and laundry room into another rental unit, approval of the proposal would result in 5 units. Public hearing held on 3/24/1971. All subsequent changes in footprint or any intensification in use therefore requires additional review and relief.
