Information and Instructions
Massachusetts General Laws chapter 152 requires all employers to provide workers' compensation for their employees.
Pursuant to this statute, an employee is defined as"...every person in the service of another under any contract of hire,
express or implied, oral or written."
An employer is defined as"an individual,partnership,association, corporation or other legal entity, or any two or more
of the foregoing engaged in a joint enterprise,and including the legal representatives of a deceased employer,or the.,
receiver or trustee of an individual,partnership,association or other legal entity,employing employees. However the
owner of a dwelling house having not more than three apartments and who resides therein,or the occupant of the
dwelling house of another who employs persons to do maintenance, construction or repair work on such dwelling house
or on the grounds or building appurtenant thereto shall not because of such employment be deemed to bean employer."
MGL chapter 152, §2SC(6)also states that"every state or local licensing agency shall withhold the issuance or
renewal of a license or permit to operate a business or to construct buildings in the commonwealth for any
applicant who has not produced acceptable evidence of compliance with the insurance coverage required.".
Additionally,MGL chapter 152, §25C(7)states"Neither the commonwealth nor any of its political subdivisions shall
enter into any contract for the performance of public work until acceptable evidence of compliance with the insurance
requirements of this chapter have been presented to the contracting authority."
Applicants
Please fill_out the workers' compensation affidavit completely,by checking the boxes that apply to your situation and, if
necessary,supply sub-contractor(s)name(s), address(es)and phone number(s)along with their certificate(s)of
insurance. Limited Liability Companies(LLC)or Limited Liability Partnerships(LLP)with no employees other than the
members or partners,are not required to carry workers' compensation insurance. If an LLC or LLP does have
employees,a policy is required. Be advised that this affidavit may be submitted to the Department of Industrial
Accidents for confirmation of insurance coverage. Also be sure to sign and date the affidavit. The affidavit should
be returned to the city or town that the application for the permit or license is being requested, not the Department of
Industrial Accidents. Should you have'any questions regarding the law or if you are required to obtain a workers'
compensation policy,please call the Department at the number listed below. Self-insured companies should enter their
self-insurance license number on the appropriate line.

Please be sure to fill in the permit/license number which will be used as a reference number. In addition,an applicant .

policy information(if necessary)and under"Job Site Address"the applicant should write"all.locations in. (city-or
town)."A copy of the affidavit that has been officially stamped or marked by the city or town may be provided to the
applicant as proof that a valid affidavit is on file for future permits or licenses. A new affidavit must be filled out each
year. Where a home owner or citizen is obtaining a license or permit not related to any business or commercial venture
(i.e. a dog license or permit to burn leaves etc.)said person is NOT required to complete this affidavit.

The current exemption for"homeowners"was extended to include owner-occupied dwellings of six units or less and
to allow homeowners to engage an individual for hire who does not possess a license,provided that the owner acts as
supervisor.
DEFINITION OF HOMEOWNER
Persons)who owns a parcel of land on which he/she resides or intends to reside, on which there is, or is intended to
be, a one or two-family dwelling, attached or detached structures accessory to such use and/or farm structures. A
person who constructs more than one home in a two-year period shall not be considered a homeowner. Such
"homeowner"shall submit to the Building Official on a form acceptable to the Building Official, that he/she shall be
responsible for all such work performed under the building permit. (Section 109.1.1)

applicable codes, bylaws, rules and regulations.

State Building Code Section 127.0 Construction Control.
HOMEOWNER'S EXEMPTION
The Code states that: `Any homeowner performing work for which a building permit is required shall be exempt from the provisions
of this section(Section 109.1.1 -Licensing of construction Supervisors);provided that if the homeowner engages a person(s)for hire to do such.
work,that such Homeowner shall act as supervisor."
Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q,
Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly
when the homeowner hires unlicensed persons. in this case,our Board cannot proceed against the unlicensed person as it would weith a licensed
Supervisor. The homeowner acting as Supervisor is ultimately responsible.
To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application,
that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used by
several towns. You may care t amend and adopt such a fom✓certification for use in your community.

Once again It's been brought to our attention you are "allegedly" being disturbed.
#1 We've now have been made aware you"disapprove of our tenants walking up the
sidewalk and stairs to there Rooms"here at the Inn?
#2, You've also made comments that our dogs are barking uncontrollably and Snidely
Commented to your land lady(Cindy) and your neighbor(Kim)you intend on filing
"More Complaints with the Town thereby using them to get to Us?"
After your last round of Complaints(on or about August 14th of this year) we
Immediately Hand Delivered and Posted Notice for Each of our Tenants to respect our
neighbors(Not naming You personally of course)requesting them to Please Try and be Extra
Quiet!.
All our tenants have complied to accommodate your schedule of sleeping during the day
along with everyone's lives here in our neighborhood. I'm Absolutely Positive this is one
of the Most Respectable and Quietest Inns in Hyannis.;
Additionally: Following that event we next had a visit from the Barnstable Animal Control
Department with a Complaint our dogs were "constantly barking?"
They explained Exactly what needed to be done to Curtail Any Possibility of"Nuisance
Dog Barking" from our dogs. We then proceeded to followed there instruction To The T!
Our dogs do Not Nuisance Bark, they never have and I'd be the first one out the door if
they did to Stop them at Once!
It's now been Almost Exactly 28 Days from your last Barrage of Complaints to both the
Town about our tenants staying at the Inn and Animal Control Office regarding our dogs.
On 08/17/02 we forwarded what I believe was a Very Nice letter of Explanation and
Apology Personally to You describing Exactly what we do here to Accommodate All our
Neighbors so as Not to Disturb or Disrupt Any of there lives along with a Copy of the
Notice we provided for our Tenants to go by.
I'm sure you recall I extended,You the Opportunity-to Place a call to us Any Time 24-7 if
you were being disturbed by Anyone or Anything here. I included our phone number and
offered to Over.Extend myself to satisfy Your"Complaints."
To,date we have not heard from you Once yet we were made aware yesterday your
attempting to Manufacture Even More Felonious and Unsubstantiated Complaints?

Yesterday both Cindy Piknick and her Second tenant Kim(who by the way live on both
sides of your rented cottage 15 feet from your door) expressed that your once again
attempting to disrupt our facility here with Complaint's of being Disturbed.
This time you claim by people walking up the stairs here at our Inn to go to their Rooms.
And our dogs"Allegedly"Barking None Stop Again?
MS. Parks, I'm Disabled. I spend 90 percent of each and every day here at our Inn Flat on
my Back or doing little jobs around the yard when I'm well enough. I'm right next to our
dogs All day Every day. I would Certainly be Aware of Any"Nuisance Barking" going on.
After our last visit from Animal Control this past August I Immediately purchased Bark
Collars for three of our dogs. The other two had Voice Box Surgery to prevent them from
barking above a Whisper! We are in Complete Compliance with the By-laws set forth here
in Barnstable County regarding dogs.
We have been in business here for at least 22 years(and expect to be here for 22 or more!)
We've had dogs for most of those 22 years. You're the first neighbor who's ever made
such Complaints of people walking up our stairs or dogs "excessively barking".
MRS. Cindy Piknick(your landlady)has stated to us on Numerous Occasions she's never
heard any dogs barking here. Kim at 92-B, your other neighbor(Cindy's Second Tenant) lives
15 feet from your cottage and is Clearly More Exposed to our dogs also has had No
Complaints!
Not One Tenant living here at our Inn has complained about dogs barking!
The State run facility sitting directly behind our property(where many of the residence
suffer from nervous conditions)have complained Not Once!
Our other neighbors MR. Powel on the opposite side of our property has Never
Complained in 22 years!
The Blue Jays, the Air Airplanes,the Fire Engines, the Ship Ferry Horns and the Church
Bell at St. Francis are much Louder than Any of our dogs could possibly be.
Might I suggest the Only three things that I think might help this situation:
Consider forwarding us your weekly sleeping schedule so we don't feed our dogs during
Your resting/sleeping time frame. We have No Idea when your Sleeping or Up?That's the
Only time I can imagine you could possible hear any of our dogs making a fuss while
awaiting their feedings.
Second: Midol might ease your discomfort each 28 days Cycle. I recall my Mom also
having Severe Problems each month with Cramps, Sleepless nights ect. She too was often
bother by little things that No One else Ever Noticed or Even heard!
Third: Swimming for Exercise, Her Doctor suggest this Therapy for her and it helped the
Condition Immensely over her later years.
Other than that I have nothing else to suggest or offer. We've been in business here for 22
years and as I previously expressed I don't foresee us closing our doors anytime soon!
There is but One Remaining Avenue to be taken if this mater is not be resolved between
us.
If these Unfounded and Unjustified claims continue to be filed by You with the Town
Departments and their forced to continuously return here to reconfirm your claims as
Invalid we will be left with No Option but to file Charges against You for Harassment,
hindering and disrupting our ability to conduct normal business here.
We will ask the Courts (and I truly believe we already have Substantial Evidence to
Confirm our Claims) to Secure Restitution/Compensation from You for lost income due
to tenants vacating our Inn prematurely! This all Solely due to there not being able to
enjoy a normal stay at the Inn because of your Nuisance constant Complaints.
Again, I'll Extend the Offer to work with you in resolving any"logical problems" we have
the possibility of controlling here. There is Nothing to be done about people walking into
and out of our Inn or dogs sitting peacefully and Quietly in there dog houses!
Often I'm awaken by Blue Jays or Fire Trucks but I'm not about to call the Autobahn
Society or the Fire Department Complaining! Some things we must simply adjust to when
choosing to reside within such Close Proximity of each other. Or, move out into the
woods somewhere but the Blue Jays will surely be there too!
Again I hope this has helped you understand Our Position and Opinions here and I truly
hope we can work together, become Neighborly and Co-exist.
Ultimately I see this as being the only Logical Option! I certainly hope you also agree?
