Town of Barnstable Zoning Board of Appeals Decision and Notice Appeal Number 1998-49 -Pizzeria Uno Variance to Section 4-3.7(1) and Section 4-3.7(3) -Signs in Highway Business Districts Summary: Granted with Conditions Applicant: Pizzeria Uno Property Address: 574 lyanough Road (Route 132), Hyannis Assessor's Map/Parcel: Map 311, Parcel 023.001 Area: 1.26 acres Building Area: 7,599 sq.ft. Zoning: HB Highway Business Zoning District Groundwater Overlay: GP Groundwater y ate Protection District Standing: The owner of the subject property is Uno Restaurants, Inc. They have submitted a notarized form allowing Barlo Signs Company of Hudson, NH to apply for relief before the Zoning Board of Appeals. Background: The property that is the subject of this appeal is the Pizzeria Uno restaurant located at 574 lyanough Road (Route 132) in Hyannis. It is located in a HB - Highway Business Zoning District. The applicant wishes to erect two new illuminated wall signs that would replace the existing wall signs. The two proposed signs would be identical and would each measure approximately 59.5 square feet in area. Currently, there are three signs located on the property; one freestanding sign off lyanough Road and two wall signs on the south and east sides of the building. The freestanding sign is 45 sq. ft. in area and the existing walls signs are approximately 29 sq. ft. in area for a combined square footage of about 103 square feet. There is a sign permit on file in the Building Division for the freestanding sign. There are no sign permits on file for the two existing wall signs. The applicant is requesting a variance to Section 4-3.7(1) and Section 4-3.7(3) of the Zoning Ordinance to permit a total of 3 signs at this location which would exceed the maximum square footage allowed. Section 4-3.7(1) only allows each business a total of 2 signs. Section 4-3.7(3) states "The total square footage for all signs of each business shall not exceed ten percent(10%) of the area of the building wall facing a public way or one hundred (100) square feet, whichever is the lesser amount." Any increase in square footage or the number of signs above this amount must have an approved variance from the Zoning Board of Appeals. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on February 12, 1998. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened April 01, 1998, at which time the Board granted the request with conditions. Hearing Summary: Board Members hearing this appeal were Ron Jansson, Gene Burman, Gail Nightingale, Richard Boy, and Chairman Emmett Glynn. Aaron Spenser, Chairman of Uno Restaurant Corporation, represented himself before the Board. Town of Barnstable-Zoning Board of Appeals-Decision and Notice Appeal Number 1998-49-Pizzeria Uno Variance to Section 4-3.7(1)and Section 4-3.7(3)-Signs in Highway Business Districts Mr. Spenser reported that the Pizzeria Uno Restaurant would like to expand their restaurant and the new sign they wish to display does not meet the requirements of the Zoning Ordinance. The site is allowed two signs totaling not more than 100 square feet. There is a 45 sq.ft. free standing sign on the site, which will remain. Subtracting that amount from the allowance, the other single sign can total not more than 55 sq.ft. The applicant submitted to the file color photographs and drawings on six(6) sheets. Sheet#2 contains traditional signs on other Uno Restaurants to be used for comparison. Sheet#3 is the sign they are requesting. Mr. Spenser explained the size of the sign and different ways the sign can be measured (as shown on Sheet#6). The Town of Barnstable Zoning Ordinance requires a rectangle be drawn around the highest/widest part of the sign and then measure the square footage. When done that way, the total is 129.6 sq.ft. He explained if the sign were divided up and measured as two signs the total would be 52.5 sq.ft. and in compliance with the Zoning Ordinance requirement of not more than 100 sq.ft. total. The Board explained that although other towns may measure signs differently, it is not done that way in the Town of Barnstable. He must adhere to the sign code regulations of this town. The applicant is requesting a Variance and the Board asked Mr. Spenser to address Variance Conditions pursuant to Chapter 40A, Section 10. Mr. Spenser indicated this is a national company and they are seeking to portray their trademark sign as it is displayed in other areas of the country. The section of the sign that reads: "Chicago Bar&Grill" is significant. To just have the part of the sign that reads: "Pizzeria Uno"would not explain to the public that this restaurant is more than just a pizzeria- it is a full service restaurant. Mr. Spenser also reported that the building itself is over 60 feet from Route 132, a busy highly traveled road. A smaller sign would be for the passing motorist to see on this busy road due to the topographic placement of this building on this site. Public Comments: No one spoke in favor or in opposition to this appeal. Mr. Spencer clarified that this will be the only sign on the building. The only other sign on the site will be the 45 sq.ft. free standing sign that is currently in place, which was recently replaced. Findings of Fact: At the Hearing of April 01, 1998, the Board unanimously found the following findings of fact as related to Appeal No. 1998-49: 1. The property that is the subject of this appeal is the Pizzeria Uno Restaurant located at 574 lyanough Road (Route 132) in Hyannis, MA as shown on Assessor's Map 311, Parcel 023.001. It is located in an HB- Highway Business Zoning District. The area is 1.26 acres of land which is currently occupied by a building that is approximately 7,600 sq.ft. in overall area. 2. Historically, on this site there have been several restaurants that preceded the current owner of the property - Pizzeria Uno. 3. Pizzeria Uno is a nationally recognized food chain which relies, in large part to promote its product, on its trademark name, being "Pizzeria Uno Chicago Bar& Grill". 4. The structure on the site sits back approximately 60 feet from Route 132. 5. The property currently has one free standing sign consisting of 45 sq.ft. in area. 6. Under the Town of Barnstable Zoning Ordinance the total amount of allowable signage for this area is not more than two (2) signs consisting of an aggregate amount of 100 sq.ft. 7. The petitioner is seeking to construct a facade sign consisting of a small "Pizzeria Uno" and letters "Chicago Bar&Grill"' on the facade of the building. When measured by the Building Commissioner per the Zoning Ordinance that facade sign would equal approximately 130 sq.ft. 8. The size of the letters in the sign and the sign itself is a factor that is mandated by the fact that the building sits back in excess of 60 feet from the traveled portion of Route 132, a high speed access road. A smaller sign would not be visible. Pursuant to Chapter 40A, Section 10, these are certain conditions pertaining to topography which create the hardship for which relief is being sought by the Petitioner. 2 Town of Barnstable-Zoning Board of Appeals-Decision and Notice Appeal Number 1998-49-Pizzeria Uno Variance to Section 4-3.7(1)and Section 4-3.7(3)-Signs in Highway Business Districts 9. The relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Decision: Based upon the findings a motion was duly made and seconded to grant the Petitioner the relief being sought with the following terms and conditions: 1. The wall sign shall be constructed as is shown on Sheet#3 titled "Street Elevation" 1/4" = 1' 0" dated January 07, 1998 and to be located on the brick facade with a total length of 30' 6" reading "Uno Chicago Bar& Grill". Sign dimensions are represented on Sheet#6 upper left hand corner. This is as was presented to the Zoning Board of Appeals during this hearing and is included in the files. The sign is to be installed during the reconstruction of the building as is shown on Sheet#3. 2. The sign is to be illuminated as proposed and no portion of the illumination shall extend beyond the boundary lines of the property into the traveled way. 3. There shall be no other signage allowed on building including the canopies that now exist or are proposed to exist on the building. The Vote was as follows: AYE: Gene Burman, Ron Jansson, Richard Boy, Gail Nightingale, and Chairman Emmett Glynn NAY: None Order: Appeal Number 199849 has been Granted with Conditions. This decision must be recorded at the Registry of Deeds for it to be in effect. The relief authorized by this decision must be exercised in one year. It is located in an HB -.Highway Business Zoning District. The applicant wishes to erect two new illuminated wall signs that would replace the existing wall signs. The two proposed signs would be.identical and would each measure approximately 59.5 square feet in area. Currently, there are three signs located on the property; one freestanding sign off lyanough Road and two wall signs on the south and east sides of the building. The freestanding sign is 45 sq. ft. in area and the existing walls signs are approximately 29 sq. ft. in area for a combined square footage of about 103 square feet. There is a sign permit on file in the Building Division for the freestanding sign, a copy of which is attached. There are no sign permits on file for the two existing wall signs. The applicant is requesting a variance to Section 4=3.7(1) and Section 4-3.7(3) of the Zoning Ordinance to permit a total of 3 signs at this location which would exceed the maximum square footage allowed. Section 4-3.7(1) only allows each business a total of 2 signs. Section 4-3.7(3) states"The total square footage for all signs of each business shall not exceed ten percent(10%)of the area of the building wall facing.a public way or one hundred (100) square feet,whichever is the lesser amount." Based on evidence submitted at the hearing, the Zoning Board of Appeals made the following findings : ( 1 ) That the proposed addition would not increase traffic on Route 132 , which is over capacity. (2) That the parking is adequate for the use as per the Selectmen's findings . (3) That the restaurant is a pre-existing use which is now permitted by special permit in the Highway Business Zone. (4) That the proposed restaurant use will not generate more traffic than the previous fast-food restaurant , but may generate less traffic, or generate traffic after the peak traffic volumes on Route 132 . (5) That the proposed use will be no more detrimental than the previous use, namely the fast-food restaurant . Based on these findings , at a public meeting held on March 2, 1988, the Board of Appeals unanimously voted to approve the special permi.t requested.
