This letter is to introduce you to the Accessory Affordable Housing (Amnesty)
Program.
The program is a unique way for our local government to partner with property
owners like you in providing affordable housing in our town while allowing you to
make rental income. You were referred to me by the Building Department because
you own a single-family home with an accessory unit that is not currently permitted
f or use as a f amily apartment; (or you may be the owner of multi-units where there
exists one or more illegal apartments).
Enclosed for your convenience is a program brochure so that you will have the
opportunity to read about the Amnesty Program. Please feel f ree to call and find out
more information on how to participate or to ask any questions that you might have.

Notice of this hearing was given by mail, postage prepaid, to all persons deemed affected and
by publishing in Barnstable Patriot newspaper published in Town of Barnstable a copy ,of
which is attached to the record of these proceedings filed with Town Clerk.
A public hearing by the Board of Appeals of the Town of Barnstable was lield at the Town
Office Building, Hyannis, Mass., at __._Z=45 lX P.li. ___ June 30 ___ ___ 19 83
upon said petition under zoning by-laws.

On June 30 19 83 , The Board of Appeals found
Attorney William G. Howes, III, represented the petitioners who have a purchase
and sales agreement on property at 10 Louis Street, Hyannis which is the site
of the former Greek Church. The purchase and sales agreement is contingent upon
the use of the building for eight apartments. Originally, this was the Grange
Hall and was purchased in 1940 by the Greek Church. Two years ago, the Greek
Church moved and the building has been vacant. The building needs substantial
renovation and repairs and is an eyesore at the present time. The petitioners
plan to invest a. lot ofmoney -into the revitalization of this structure which
will be of benefit to the neighborhood. The site has town water and town sewer.
The Hyannis Fire Chief and .the building inspector have approved the petitioners'
plans. The locus is- in a Business zone which permits apartments and a variance
is needed for the eight apartments since the 5,000 sq. ft. of land for each
apartment is- not -met. More than 20% of the land is' covered by the existing building,
setbacks are not met and the required greenbelt cannot be provided. The twelve
on-site parking spaces will meet the requirements of Sec. M. , paragraph F. , however,
many of the twelve spaces- will be closer to the base of the building than is permitted.
Since the building already exists, the topography of the structure is unique to the
zoning district. It is not possible to comply with all of the requirements of
Sec. M. - Apartments- and a use must be found to fit the building. Mr. Howes said
that apartment use is ideal and, if not allowed, the building will become further
run down, vacant and boarded up. A less desireable use could locate in the building
withltHe. HoarVs approval since the property is in a Business zone. This building
has been on the market for two years" and is a financial hardship to the Greek Church.
Extensive landscaping is going on at their new building in anticipation of the sale
of the old building. There would be less intense use of the property with apartments
than occurred with church use. A petition signed by two hundred people in favor of
the. variance was presented to the Board along with a letter from the Housing Assistance
Board, also in favor.
Father Mourikis, pastor of the Greek Church., said he would prefer a residential use
of the property rather than a restaurant or bar in this former house of worship.
Robert Darien of the Architectural Review Board said apartments would be the best
use of the property and an asset to downtown Hyannis. John Vellone, owner of property

across the street spoke in favor of apartment use at the locus. No one
spoke in objection to the petition, the Board took the matter under advisement
and the hearing was closed.
The Board voted unanimously to allow the conversion of the former Greek Church
at 10 Louis Street, Hyannis, into eight apartment units in accordance with the
plan submitted with the filing. The Board found that topographical conditions
exist on the site, due to the placement of- the building on the lot, which are
not commonly found in the zoning district,and allowing apartment use in this
business zoned district of Hyannis would not cause detriment to the neighborhood
nor derogation of the spirit and intent of the zoning by-laws. Conversion of
the structure shall be limited to eight apartments with twelve on-site parking
spaces as shown on the plan submitted and cited as follows:
