The reason for stating the dwelling at 36 Oak Neck Road is now a three unit apartment complex escapes us. The assessor's office, as you mention, does retain records for a certain number of years. A copy of their records for residential property indicates the dwelling at 36 Oak Neck Road was considered a single family occupancy, having three baths and one sink (assuming kitchen sink). The interior of this dwelling was inspected on 5/21/71. This dwelling is also sketched, showing a rambling group of additions. Part of these additions were added by Byron Holway in 1973-74. The building permit #16827t with a completion date of 7/18/74, signifies this dwelling as a single family dwelling, by the building department. When contacted, Norman Nault, of the Barnstable Water Co. informed us that most properties have one service connection. Beyond the service connection, anything could and often did happen. The current building permit #33771 indicates a permit fee of $50.00. The minimum fee for a multi-family dwelling was a $100.00 when we .asked. The current permit also indicates no number of dwelling units, why? Also, if this dwelling is now considered a multi-family dwelling, why did it not go before "Site Plan Review"? Section 4-7.3 (3) of Site Plan Review requires any alteration or reconstruction necessitating additional off-street parking comply with this by-law. Section 4-7.4 (i) also applies! Much of the information we gathered is public information. Why would the building department require a signature for a copy of a public document, a building permit? The Massachusetts State Building Code allows ordinary re- pairs without a building permit. Mr. Bearse, Building Inspector from this : office did observe activity at the site and did stop to investigate. At that time he had an opportunity to review the work in progress and to pose relevant questions. When the permit question was raised Mr. Bearse had al- ready secured some of the information needed, including photographs, but he still needed further clarification. At one time the assessor's office maintained a file with records/information on the older buildings in the Town. However, following the .changeover to computers the files were no longer needed by that department and were dis- carded. The records were.valuable to us since they contained sketches and dates needed to.- provide non-conforming status information. We have, how- ever, been able to obtain information from other agencies. The Barnstable Water Company records indicate that they installed a water line with three(3) services on. September 1, 1920. Mrs. Josephine Cobb writes that she lived at 36 Oak Neck Road and at the house next door for a combined 40 years plus. She states that Stella Cobb, her sister-in-law added the rear section to the main house in the 1940's. Mrs. Cobb' further states: "during the mid 1960's the house was sold to Frank and Barbara Jakielo from New Jersey. They in turn sold it to a local man in the early 1970's". A former owner, Byron R. Holway, noted that in 1975 this was a non-homeowner occupied building with three (3) rental units. The Glenmere Civic Association June 28, 1990 Page 2. A Mortgage Fact Sheet also lists an Armand J. Lemieux as a former owner. Under "Special Instructions" on the sheet a new gas furnace was to be in- stalled in the A frame and. it was to be insulated. It was also noted that Mr. Lemieux was legally blind. A Fact Sheet also noted that in 1985 the building was a "homeowner occupied building with four (4) rental units". Further research reveals that on November 28, 1973 Byron Holway was issued a building permit to add 432 square feet to the main house and 288 square feet for a breezeway and garage. On October 27, 1988 the Department of Public Works issued sewer permit #3074 for a connection showing sewer hook-ups for four (4) units. The basement of the 5th unit contains a built-in fireplace. It is apparent that building activity has been going on at this site over a number of years. Nevertheless, it is my opinion that this is a legal non-conforming use with three (3). living units, dating back to 1920. 'I would further rule that units 4 and 5 have not been authorized by this department - no building per- mits on file to legally establish same and further that the owner/applicant would have to petition the Board of Appeals before work can be completed on any units in excess of three (3) . The property had been foreclosed upon. The Massachusetts State Building Code allows ordinary re- pairs without a building permit. Mr. Bearse,. Building Inspector from this office did observe activity at the site and did stop to investigate. At that time he had an opportunity to review the work in progress and to pose relevant questions. When the permit question was raised Mr. Bearse had al- ready secured some of the information needed, including photographs, but he still needed further clarification. At one time the assessor's office maintained a file with records/information on the older buildings in the Town. However, following .the .changeover to computers the files were no longer needed by that department and were dis- carded. The records were valuable to us since they contained sketches and dates needed to provide non-conforming status information. We have, how- ever, been able to obtain information from other agencies. The Barnstable Water Company records indicate that they installed a water line with three(3) services on September 1, 1920. Mrs. Josephine Cobb writes that she lived at 36 Oak Neck Road and at the house next door for a combined 40 years plus. She states that Stella Cobb, her sister-in-law added the rear section to the main house in the 1940's. Mrs. Cobb further states: "during the mid 1960's the house was sold to Frank and Barbara Jakielo from New Jersey. They in .turn sold it to a local man in the early 1970's". A former owner, Byron R. Lemieux as a former owner. Under "Special Instructions" on the sheet a new gas furnace was to be in- stalled in the A frame and it was to be insulated. It was also noted that Mr. Lemieux was legally blind. A Fact Sheet also noted that in 1985 the building was a "homeowner occupied building with four (4) rental units". Further research reveals that on November 28, 1973 Byron Holway was issued a building permit to add 432 square feet to the main house and 288 square feet for a breezeway and garage. On October 27, 1988 the Department of Public Works issued sewer permit #3074 for a connection showing sewer hook-ups for four (4) units. The basement of the 5th unit contains a built-in fireplace. It is apparent that building activity has been going on at this site over a number of years. Nevertheless, it is my opinion that this is a legal non-conforming use with three (3) living units, dating back to 1920. Mr., John Rodrigues has asked me to relate to you some of the history of this house. I have lived at either 36 Oak Neck Rd . or next door for over 40 years. Stella Cobb, my sister-in-law built the back section onto the main house in the 1940' s. At the time the back section was built on , there already existed an apartment within the main house. The new addition in the back became a third unit after it' s completion . During the mid 1960' s the house was sold to Frank and Barbara Jakielo from New Jersey . They in turn sold it to a local man in the early 1970' s. It was sometime during his ownership that additional apartments were created. The property changed hands once again in the late 1970' s and these new owners allowed the property to run into the ground. I was very pleased when Mr. Rodrigues started to fix up the property . The house was literally in shambles, but he has turned it into a very pleasing and attractive looking building which does nothing but complement the neighborhood. There was some talk that he added on to the house, but this is not so. He added nothing . He took off an "A" frame roof from the back and replaced it with a roofline to match the front portion of the house. As I mentioned earlier, I have lived here over 40 years and I am well aware that there were indeed apartments for many , many years at 36 Oak Neck Rd . I hope I have been helpful to YOU and to John Rodrigues in resolving this situation. Upon request for the permit # of this construction project we found that it did not have a permit. On May 24, the day following our inquiry, a permit was issued. A copy of this permit revealed little or no detail or information and did not contain the required diagram. We respectfully request that you make a thorough investigation of this project to determine first: if it is a five unit apartment complex and secondly: when a variance or special permit was issued for a use inconsistent with RB-i zoning. We would like to know if it meets the criteria outlined in our Town By-Laws for site plan review, Section 4-7.
