The building ofiidal shall inspect periodically existing buildings and structures and parts thereof in accordance with Table 110 entitled Schedule for Periodic Inspection of Exisfing Buildings Such buildings shall not be occupied or continue to be occupied without a valid certificate of inspection. Please complete the application and return it to the Building Commissioner's Office with the P PP g required fee (amount as set on the top right-hand corner);the fee must be paid before the Certificate of Inspection may be issued. Generally periodic inspections are unannounced; however you may feel free to contact us for inspection once the application fee is paid. For your convenience,we will be inspecting common areas, corridors, stairways, community rooms, emergency lights, exit signs to ensure that the batteries and lighting are functional and making sure that the doors work and the exits are clear.You will need to have any fire extinguishers and fire alarm systems inspected and tagged as appropriate a copy the technicians reports onsite for the inspection. If you would like to have your COI application emailed please provide an email on the Certificate of Inspection Application. Previous owners created A fifth,two-bedroom unit,in the basement area. It is this fifth unit that the applicant proposes to permit as an affordable rental unit in perpetuity. In 1997 and in 2000,the previous owner was cited by the Building Commissioner for having the fifth apartment unit. They were ordered to cease and desist its use as a rental unit. The current owner,Mr.Noonan purchased the property in August of 2000 and has not rented the unit. The unit has undergone improvements with the anticipation of receiving a Comprehensive Permit under the Accessory Affordable Housing Program. It is vacant at this time. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals. A public hearing before the Zoning Board of Appeals Hearing Officer was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened on July 11,2001,at which time the Comprehensive Permit was granted with conditions. The Hearing Officer, Gail Nightingale presided over the pubic hearing. The applicant,Thomas Noonan (and his partner,Dan Levesque)were present at the hearing. Also present were Paulette Theresa-McAuliffe,Program Coordinator, Office of Conununity and Economic Development and Art Traczyk,Principal Planner,Planning Division. • Bk 15116 Ps 130 039222 Findings as to Standing: At the July 11th hearing, the Hearing Officer made the following findings of fact as related to the applicant's standing on the request for a Comprehensive Permit in accordance with MGL Chapter 40B. 1. The applicant has submitted the copy of a quitclaim deed recorded in Book 13243,page 306. That deed. transferred the property from Muhammad S.Abraham,Trustee of Daps Realty Trust to Thomas E.Noonan and.Kirsten F.Noonan. The deed was recorded on September 27, 1991. 2. A site approval letter, dated June 29,2001 from Kevin Shea,Director,Office of Community&Economic Development to Thomas Noonan cited that the application was reviewed and found to meet the threshold criteria established for the Accessory.Affordable Housing Program. It cites the subsidizing agent as the Town of Barnstable,Office of Community and Economic Development. The qualifying program is the Community Development Block Grant Program (CDBG). The letter authorizes the applicant to proceed to seek a Comprehensive Permit. Based upon the findings,the Hearing Officer ruled that the applicant has standing for an affordable housing Comprehensive Permit under MGL Ch. 40B and the Town of Barnstable's program for Pre-Existing Dwelling Units in Existing Structures,Article 65 of the General Ordinances. Findings of Fact on the Comprehensive Permit: At the hearing of July 11th.,the Hearing Officer made the following findings of fact: 1. The applicant is Thomas E.Noonan with an address of 44 Carolina Trail,Marshfield,MAS 02050. He is requesting a Comprehensive Permit for the conversion of an accessory apartment unit at 75 Pearl Street, Hyannis,MA, to an affordable rental unit. The unit is a pre-existing unpermitted apartment that existed as early as 1997. The unit,having been documented to exist prior to the November 16,2000 enactment of the "Accessory Affordable Housing Program" qualifies for the program. 2. The unit is a two-bedroom unit of approximately 900 sq.ft.located in the basement of the non-conforming multi-family dwelling. The unit constitutes the fifth unit in the structure. ` 3. The application has been reviewed by Town staff,including an inspection of the units by the Barnstable Housing Authority on May 11,2001. That inspection found that the apartment was,undergoing improvements to bring the unit up to today's standards. It noted only minor items were needed after the repairs are completed. They were window screens;an exterior light;repairs to a light fixture in the utility room and installation of a smoke detector. The applicant is also aware that the Building Division of the Town of Barnstable shall inspect the unit to assure it meets with all state and local building codes prior to the issuance of an occupancy permit. 4. The building is connected to the public water supply and to die Town's wastewater treatment facility. There is no concern for on-site septic. 5. On May 29,2001,,the applicant signed an Accessory Affordable Housing Program Affidavit that commits, upon the receipt of a Comprehensive Permit, to the recording at the Barnstable Registry.of Deeds a Regulatory Agreement and Declaration of Restrictive Covenants. That document includes restricting the unit in perpetuity as an affordable rental unit. 6. The applicant understands that the affordable unit will be rented to a person or family whose income is 80% or less of the Area Median Income (AMI) of Bamstable-Yarmouth Metropolitan Statistical Area(MSA) and further agrees that rent(including utilities) shall not exceed the rents established by the Department of Housing and Urban Development(HUD) for a household whose income is 80% or less of the median income of Barnstable-Yarmouth Metropolitan Statistical Area. The Barnstable Housing Authority has committed to the monitoring of this affordable rental unit. The maximum allowable rent for two people for this two-bedroom unit in today's dollars is $929.0.0 including utilities.The tenant's annual income for 2 people cannot exceed$33,400. 8. The project is deemed consistent with local needs because it adequately promotes the objective of providing affordable housing for the Town of Barnstable without jeopardizing the health and safety of the occupants provided all conditions of the Comprehensive Permit are strictly followed. Ruling& Conditions: Based upon the findings a ruling was made to grant the Comprehensive Permit in accordance with MGL Chapter 40B with the following conditions: 1. The grant of this Comprehensive Permit is issued to the applicant,Thomas Noonan for 75 Pearl Street, Hyannis,MA. It is issued to allow for an existing two-bedroom apartment to be an affordable housing unit in accordance with the following conditions: 2. Occupancy of the affordable unit shall comply with the applicable building code of the Town. To the extent permissible by law, the Property owner shall preferably select tenants who are residents of the Town of Barnstable. 3. To meet the requirements of affordability, the cost of housing(including utilities) shall not exceed 30%of the 80% of the median income for a single individual or two people as the case may be for the Barnstable- Yarmouth MSA. Rents and utilities for the affordable unit shall not exceed limits set by the US Department of Housing and Urban Development(HUD). Those limits can be secured from the Barnstable Housing Authority or from the agent of the town implementing this program. Today it is the Program Coordinator. 4. All leases shall have a minimum term of one year. 5. The applicant shall improve the unit with those items specified in the May 11,2001 Housing Inspection Checklist and shall have the unit re-inspected by the Building Division to assure that all necessary improvements are made to meet minimum state building and fire codes. 6. The applicant may select his own tenant(s) provided the tenant(s) meet the requirements of the program as cited above and provided that person(s) income is reviewed and approved by the Barnstable Housing Authority as a qualified individual. The applicant will be required to work with the Housing Authority to provide information necessary to document that the tenant(s) qualify. The unit shall be rented on an open and fair basis. When a vacancy occurs, the unit must be listed as available with the Barnstable Housing Authority and Housing Assistance Corp. The applicant must notify the monitoring agent of a vacancy whenever it occurs. 7. Every twelve months the applicant shall review the income eligibility of those individuals occupying the unit. No later than July 30th of each year, the applicant shall file with the Barnstable Housing Authority a yearly affidavit listing the rent charged and income level of the occupant(s) of the unit. The applicant shall provide the Barnstable Housing Authority any additional information it deems necessary to verify the information provided in the affidavit. Upon any report from the Barnstable Housing Authority that the terms and conditions of this permit are not being upheld, the Zoning Board of Appeals or it's Hearing Officer shall have the ability to hold a hearing to show cause as to wlay this permit should not be revoked. The Authority may charge a fee for the yearly review and monitoring service not to exceed what is normally charged.
