The current exemption for"homeowners'was extended to include owner-occupied dwellings of six units or less and
to allow homeowners to engage an individual for hire who does not possess a license,provided that the owner acts
as supervisor.
- DEFINITION OF HOMEOWNER
Person(s)who owns a parcel of land on which he/she resides or intends to reside,on which there is,or is intended to
be,a one or two-family dwelling,attached or detached structures accessory to such use and/or farm structures. A
person who constructs more than one home in a two-year period shall not be considered a homeowner.' Such
"homeowner" shall submit to the Building Official on a form acceptable to the Building Official,that he/she shall be
responsible for all such workperformed under the buildine permit. (Section 109.1.1)
The undersigned"homeowner"assumes responsibility for compliance with the State Building Code and other,
applicable codes,bylaws,rules and regulations.

Note: Three-family dwellings containing 35,000 cubic feet or larger will be required to comply with the
State Building Code Section 127.0 Construction Control.
HOMEOWNER'S EXEMPTION +
The Code states that: "Any homeowner performing work for which a building permit is required
shall be exempt from the provisions of this section(Section 109.1.1 Licensing of construction Supervisors);
provided that if the homeowner engages a person(s)for hire to do such work,that such Homeowner shall act
as supervisor."
Many homeowners who use this exemption are unaware that they are assuming the responsibilities of
a supervisor(see Appendix Q,Rules&Regulations for Licensing Construction Supervisors,Section 2.15)
This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed
persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed
Supervisor. The homeowner acting as Supervisor is ultimately responsible.
To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,
as part of the permit application,that the homeowner certify that he/she understands the responsibilities of a
Supervisor.. On the last page of this issue is a form currently used by several towns. You may care t amend
and adopt such a form/certification for use in your community.

You quote in your letter Chapter. 40A, Section 11 as it refers to
variances or special permits. I have no difficulty with the method as
described or the procedure. However, Section 15 of Chapter 4OAi Appeals
Procedure, also makes, reference that Board of Appeals decisions must also
be made within the prescribed time of seventy-five days after the filing
of an appeal. Failure by the board to act within said seventy-five days
shall be deemed to ..be the grant of the relief, application or petition
sought. In this case, the board did not act within the prescribed time.
Before issuing this permit Town Counsel was also consulted, and as
a result, a permit wqs issued and in my opinion, legally. It is not my
intention to rescind the permit.

Dear Joe:
This is in response to yoIrletter of September 2nd, 1981 regarding the above
matter. I have reviewed the file on the application of Mr. Gill for a variance. It
appears that he filed the application for the variance in this matter on Decen ber 3,
1980. The decision of the Board of Appeals, purportedly denying the variance, is
dated February 19, 1981; it was time-stamped March 6, 1981 by the Town Clerk's Office.,
General Laws, Chapter 40A, Section 15 provides that "Failure by the Board (of
Appeals) to act within . seventy-five days shall be deemed to be the grant of the
relief, application or petition. sought . . .." Although the question has not been
directly decided by the Appeals Court or the Supreme Judicial Court, there are three
cases in which there have been indications that the language means what it says the
failure to act gives the right to the applicant-to'_,.proceed to build according to the
plans submitted with the application. Those cases are Yaro v: Board of Appeals of
Newburyport, Mass. App. , 410 NEW 725- 'Fitchburg Housing Authority v Board of Appeals
of Fitchburg, Masse. App. 406 NE2d .1006; Spalke v: Board Of 'Appeal8 'of Plymouth, Mass.
App. 389 NEW 788; Brow.L v. Board of Appeal8 of 'ninchester, Mass.` App. 396 NE2d 1014.
Consequently, I believe that Mr. Gill is entitled to a building permit. It is
entirely conceivable that the abutters may object to this construction and upon learn-
ing of the issuance of the permit, by the ccnn-enceTmnt of construction or otherwise,
formally request you to enforce the zoning bylaw under Section 7 of Chapter 40A, in
which case they would be entitled to appeal under Sections 8 and 17 of Chapter 40A.
