The decision of the Board of Appeals, purportedly denying the variance, is dated February 19, 1981; it was time-stamped March 6, 1981 by the Town Clerk's Office., General Laws, Chapter 40A, Section 15 provides that "Failure by the Board (of Appeals) to act within . seventy-five days shall be deemed to be the grant of the relief, application or petition. sought . . .." Although the question has not been directly decided by the Appeals Court or the Supreme Judicial Court, there are three cases in which there have been indications that the language means what it says the failure to act gives the right to the applicant-to'_,.proceed to build according to the plans submitted with the application.
