Parking lots must comply with all Town of Barnstable Ordinances and Regulations and shall meet the requirements of zoning, including the site plan review process. A detailed plot plan of the premises specifying the area to be used for parking must be submitted with the application. The plot plan must be approved by the Fire Chief and the Town Engineer before the license shall be approved. A copy of the plot plan shall be retained by the Town Engineer and a copy shall at all times be available for inspection on the premises by any town officer. All vehicles shall be parked in spaces as shown on the approved plot plan and no vehicle shall be parked so as to block the exit or entrance of any other vehicle. NO PARKING LOT SHALL BE OPERATED WITHOUT A VALID LICENSE ON THE PREMISES,* 2. A statement of the current maximum daily rate shall be posted conspicuously on the lot. The rate statement must be visible to a customer from the street at all times. The posting of the maximum daily rate shall be in clearly readable block letters 12 inches high and 6 inches wide with a 1 inch stroke. There shall be a minimum of 1 inch of clear space between all numbers and a minimum of 1 1/2 inches of clear space between the outside of the numbers and any other lettering. It the lot uses more than one entrance, each entrance must comply with this section. 3. A notice shall be posted conspicuously on the premises detailing who to contact in the case of emergency. Said information shall contain a telephone number where a person authorized to conduct the business of the owner may be reached during those hours that the lot is not manned. The same information must be legibly printed on the back of all receipt tickets given to customers. 4. A notice shall be posted conspicuously detailing when a refund may be due a customer and further explaining how to apply for a refund in the event the lot is not manned at the time of return of the customer. Customers intending to use a service, such as a boat line or sightseeing, which is cancelled or sold out or otherwise not available, and return to the parking lot within one hour of parking and inform the attendant of the cancellation or nonavailability of the intended service may be charged a maximum of two dollars ($2.00). The same information must be legibly printed on the back of all receipt tickets given to customers. 5. No parking lot operator or employee shall accept payment from a customer without issuing a receipt. Each receipt must contain the name and address of the lot, the date of the transaction, the maximum daily rate, the number of days paid for, and the total dollar amount charged. It has a mansard roof. On the front of the house is a porch supported by four columns . The columns have no styling with the exception of simple grooves. The outer walls are of cement covered by green-colored, uneven tar shingles . 'The windows are -2/ -- -'Twin dormers extend from the front. There is a porch added to the back. Beyond the house on what once were gardens and a grazing field are other cottages of the Hilltop Cottage complex. iISTORICAL SIGNIFICANCE (explain the role owners played in local or state history and how the building relates to the development of the community) When Captain Clarence Howard Allyn died in 1932, it signified the end of an era for Hyannis. The age of the sea captain, the very men who played so great a role in the development of Hyannis had passed on with Captain Allyn. He was truly the last Hyannis sea captain. Clarence Howard Allyn was born in West Barnstable in 1848 and received a common school sducation. He began his sea career by working on coastal vessels out of Cotuit. He then was master of the schooner HATTIE BAITER as well as of the ships IMPOSTER, GOLD HUNTER, and TITAN. His last voyage was on the TITAN which was wrecked in a tropical storm In the Gulf of Mexico. As a captain, Allyn visited many parts of the world , and held a particular fondness for Japan. Allyn married Pheobe Crowell,_ the widow of Captain Allen Crowell. Allyn had served as a mate to Captain Crowell until his death. Following the wreck of the TITAN, Captain Allyn retired from the sea and settled in Hyannis around 1890 at this residence which his sister Sylvia had purchased from Julia H. Hooper. Sylvia, in turn, sold the residence to her brother. He owned a meat business as well as having part interest in the freight and trucking business until his death. Nathaniel B.H. Parker wrote this of Captain Allyn:. "A splendid type was he and an outstanding one, in this writer's estimation, of the Cape Cod boys who with only the rudiments of an education in the schools at home have, through the broadening education in all parts of the world, with the keen observation of a New England Yankee, coupled with the characteristics which may make of a sea captain, a master of men, molded into one to whom life has taken on a deeper and deeper meaning" . Construction Proposed: Land improvements to accommodate increased number of cars. Procedural Provisions: Section 5-3.3 Special Permit Background: This decision concerns the petition submitted by John and Rita Moda, for a Modification of an existing Special Permit #1975-51. The applicants are requesting that the number of permitted car parking, commonly termed "lawn parking", be increased from the original 19 cars provided for in the previous Special Permit, to 60 cars. The applicants have submitted a plan titled "Site Plan of Proposed Parking Lot at 76 South St., Hyannis - Barnstable, MA, for John & Rita Moda", originally dated May 2, 1990 and last revised dated June 18, 1992. Procedural Summary: The application was filed in the office of the Town Clerk and at the Zoning Board of Appeals office on May 28, 1992. A public hearing, duly noticed under M.G.L. Chapter 40-A, was opened and closed on June 25, 1992, and a decision rendered on July 23, 1992. The Hearing was held in the First Floor Conference Room of the School Administration Building. The petition was heard by Board Members; Gloria Urenas, Luke Lally, Ron Jansson, Gail Nightingale and Chairman, Dexter Bliss. The applicant was re resented .before the Board by Attorney John Alger. The applicants, John and Rita Moda, were also present during the proceedings. Attorney Alger open his remarks citing that this is an appeal for a single site and is not to be confused with- the overall problems associated with Decision and Notice Appeal No. 1992-42 parking in the area nor in terms of non-conforming uses or illegal uses occurring at other sites. This site has the benefit of a Special Permit #1975-51 originally permitted in 1975 under the zoning for the area at that time. In accordance with MGL Chapter 40 A, Section 14, the applicant has the right to seek to Modify that Special Permit. Attorney Alger summarized the history related to the development of this activity on the site, noting that the property was purchased in 1940 by the applicants and has been their principal residence since that time. They have maintained their livelihood through the rental of cabins and apartments and, since 1973, through providing of parking to serve the Steamship Authority boats to the islands. The parking facilities were legally established in accordance to the 1975 Zoning Bylaw and the use has remained uninterrupted since its inception. Issuing of parking licenses, requires approval from the Selectman,s office and more recently the Town Managers office on a yearly basis. The Town of Barnstable has consistently issued a licences to the applicants. That license provided for the parking of 41 cars in 1990 and for 69 cars in 1991. It was not until 1992 that the licenses was reduced, back to the original 19 cars. This has prompted the applicant to seek a modification of the existing Special Permit to allow for the parking of additional cars. The Board discussed the situation with Attorney Alger. The site was previously zoned as Business Limited District which permitted private parking lots by Special Permit. It was rezoned to PRD - Professional Residential District. The 1975 Zoning Bylaw provided for private, nonresidential parking in the area. The Board discussed the on-site needs of parking to satisfy the five rental units and the two apartment units on the site. They also discussed the nature of the turn-overs in parking and it was established that 75% of all parking remain overnight or longer. Many parking customers are repeat customers from the previous years. It is also not unusual for a car to park for several weeks while the owner is on the island. Several neighbors spoke in support of the petition. They were Diane Dietz, Beverly Skende, Mrs. Bouchard, Jim Redanz, Mr. Joseph, and Mrs. McEvoy. Most of those in favor of the proposal are abutting neighbors and cited the need for parking, its history of being established and its nature of the area in serving the needs of the Steamship Authority. Those in opposition included; Audrey Loughnane, Barbara Flynn speaking for the Glenmere Civic Association, Clark Boydston speaking for the Hyannis Civic Association and Mr. Tovino representing the Steamship Authority. Mrs Loughnane cited that the parking lots were not in conformance to the Town s plans for the area. Mrs. Flynn presented photographs of other parking lots in the area that she cited as illegal uses. Mr. Boydston discussed the desire not to have Use• Variances granted and Mr. Tovino suggested that with expanded Steamship Authority parking lots, privately operated lots are not needed. The Board clarified some points related to the publics concern over the parking situation in the neighborhood. The Board noted that the Steamship Authority parking lots are exempt from zoning, that the request before them is Decision and Notice Appeal No. 1992-42 for a modification of an existing Special Permit and not for a Use variance. The Board also documented and that the parking of 19 cars at this site is a legal permitted use. Attorney Alger summarized his appeal to modify the Special Permit. He reiterated that this is a single site owned by the Modas that is the subject of concern to the Board. The other sites identified as illegal uses are not to be confused with this particular one. The applicants have complied with all required Town reviews and regulations necessary. The Board requested Attorney Alger to respond to the nine (9) criteria suggested in a Memorandum dated June 24, 1992 from the Planning Department via Site Plan Review. A copy of which is in the file. Attorney Alger cited that the applicant could conform with the points numbered as followed: 1 - requiring a 20 foot setback to the parking, 5 - requiring new site plan be approved which incorporates the conditions of the Board, 6 - approval of signage, 7 - additional landscaping be incorporated into the plan, 8 - non-intrusive outdoor lighting, and 9 - no parking within 8 feet of the buildings as per the recommendation of the Fire Department. The Board continued hearing of this case until July 09, 1992, to permit the Board to review documents related to the appeal and to permit the applicant and Site Plan Review Committee to clarify points raised by the Planning Department. The public testimony was closed and the continuance was for the receipt of that information from Site Plan Review and the Planning Department. At the July 09, 1992, meeting one of the Board Members was not present who heard this appeal. The appeal was continued until July 23, 1992. At the July 23 meeting, an alternative to the parking plan was submitted by the Planning Department, titled "Moda Parking Alterative Site Plan" and dated 7/7/97. The Department also submitted a letter to the Board from Robert Schernig, Planning Director, un-dated. The plan was presented to the Board to illustrate the proposed conditions recommended by the Planning Department. The plan proposed a reduction in the requested parking to 54 cars. It also proposed that the entire area of parking be paved and the surrounding open areas be landscaped. The Board and Attorney Alger discussed the alternative. Both Attorney Alger and the Board objected to the extent of asphalt pavement proposed in the alternative, especially given that this is a seasonal use. Finding of Fact: Based upon the evidence submitted and testimony given, at the hearing of June 25 and July 23, 1992, the Zoning Board of Appeals unanimously finds, as follows: J Decision and Notice Appeal No. 1992-42 1. The applicant holds a valid Special Permit #1975-51 for the parking of 19 cars on the premises at 76 South Street, Hyannis, MA. 2. Through the years, the Board of Selectmen and the Managers office of the Town of Barnstable has authorized an increase in the total number of vehicles to be parked on this site, peaking at a 1991 total of 69 cars. 3. The Modification of the existing special Permit, would not be in derogation of the spirit and intent of the zoning ordinance, nor detrimental to the neighborhood if certain conditions were imposed in the granting of the modification requested. 4. The granting of relief sought would not be detrimental or objectionable to the neighborhood affected, in view of the fact that there has not been any evidence presented to the Board to establish that as a fact. In the opposite, abutting property owners have spoke in favor of this lawn parking and do not find it objectionable. conclusion: Accordingly, based upon the findings, a motion was duly made and seconded that, Appeal No 1992-42 be granted, subject to the following terms and conditions: 1. The-total"maximum number of vehicles to=be parked`on-this--lot at--any one time—shalf--6-54 vehicles. �_ 2. The requirements of 'Site Plan Review, as set forth in this petition, be complied with all terms and conditions of Site Plan Review No. 05-92 as per the June 15, 1992 letter from the Building Commissioner and as per the enclosure to that letter titled "Site Plan Review Staff Comments SP-05-9211. A copy of which is contained in the file. 3. The six spaces existing that .are closest to South Street shall be eliminated and that area shall be grassed. Along the border of South Street several mature broad leaf trees shall be planted so as to screen the area from the surrounding neighborhood. 4. Request that a Cape Cod. type picket or split rail fence be established in that particular area and to be no higher than four (4) feet in height. 5. The improvements shown on the Plan entitled "Site Plan for Proposed Parking Lot" dated May 2, 1990 and revised to June 18, 1992, shall be complied with by the petitioner. 6. The petitioner shall comply with as many of the landscape provisions illustrated on the "Moda Parking Alternate Site Plan", prepared by the Planning Department, as practical and provided that those landscape improvements do not interfere with the Site Plan approved by Site Plan Review and modified as per those conditions above. The Decision and Notice Appeal No. 1992-42 applicant shall submit a revised site plan incorporating all of the conditions imposed by the Zoning Board of Appeals. The vote was as follows: Aye: Gloria Urenas, Luke Lally, Ron Jansson, Gail Nightingale and Chairman, Dexter Bliss.
