That special permit added 2 bedrooms on the second floor of the house that was attached to the motel and was,conditioned they were not to be rented and only for owner occupation. At some point, the motel was converted to Patriot Apartments for which documentation only recognizes the existence of 6 units and possibly a 7th, however it,is not clear if this 7th one is the owner's unit which is being rented. Sometime before the conveyance to the present owner in 1997, 2 basement apartments were created without a building permit. They recently flooded with sewage and it was discovered that they were not legally created (no building permit, relief, or CO). They will need some revision to meet code. The owner cannot pull BPs to restore the 2 basement units as of right. There are at least 2 illegal apartments, possibly 3, which the owner may want to seek legalization under amnesty, the 3rd being the owner's unit allowed in the SP that ended up getting rented instead. If given amnesty, the whole building would then have a total of 9 units, which may all be counted toward affordable. The owner does have other options, however the density is already over SP provisions without the basement apartments included and variances are hard to get from ZBA. RE: 121 South St. Hyannis I have been acvised by Jamie Cabot that the "StakWell" from Bilco might not meet the 780 CMR requirements for a proper and legal escape well. I have spoken to Gail from Bilco who mentioned that it satisfies sec. 310.4 of the UBC and the IRC 2009 Building code for basement egress. Gail from Bilco said that you can call their Engineering Dept. and they would be able to answer any questions you may have about non compliance 780 CMR. They may be reached by phone#(800) 854-9724. However, I do realize that you are a very busy man and if you need to make sure certain requirements of 780CMR are met, I would be more than happy to do the research or get the documentation to satisfy your questions. Jamie did mention the use of their"Escapeweli", however, there are a few reasons I chose the "Stakwell". Both wells cover the UBC and IRC codes. The Stakwell allows me the different depths that I may need for the proper size window. Most of all the Stakwells come with a cover that is approved by the UBC and IRC codes. This cover would protect the well from snow, rain, and debris. It also can protect someone from falling into the window well. I do realize that I still may need to fence in the area for safety reasons if it dose not meet your approval. The "Escape Well" does not have a cover to protect the opening from the.elements. I have always worked with the Town and most of all the safety of my tenants comes first. I am also aware that I have to apply for a building permit. I wish to apologize if we got off,to a poor,start. .I hope you realize, that I am not trying to by pass the law, I am just trying to 4'the best I can for my tenants, to keep their rents at an affordable rate and safe. I have also reviewed Chapter 40A Section 7 of the Massachusetts General Laws relative to the enforcement of zoning by-laws. ,It would appear to me that the 10 year rule relative to the enforcement of the zoning by-law as set forth in the second paragraph of section 7 would allow the continued use of the property as currently exists. The property at one time back in the 60's was a motel and was later converted to the apartment use. I would appreciate it if you would advise me what documentation or evidence you would accept to show that the existing building and use has been there for more than 10 years and therefore falls within the protection of section 7. There appears to be a strong need for the type of housing being provided at this property and I am hopeful that this approach can maintain the status quo.
