Neither Carolyn nor I have indicated that the dumpster's present location was or is acceptable to us. It remains close to our property where odors will continue to be a problem, preventing us from enjoying sitting outside. In my initial communication I did state, "The dumpster could easily be situated at the end of the driveway/parking area."that would put it at the other or southern end of the parking spaces. Our relations with Mr. Ethier did not get "off to a difficult start" as you suggested, but were friendly and cordial, this despite his blasting punk rock music every time I or one of my family came to examine 445 South Street before purchasing it. A practice that can be verified by the two realtors who accompanied us, and which ended after we closed on the property. Had Mr. Ethier been cooperative we wouldn't have reason to contact the town seeking relief. When we first noticed the smell of dead animal several summers prior to this one. He admitted to putting a racoon (and prior to that a skunk) he had killed in the dumpster, and that it would be emptied within two weeks. We tried several more times to reason with him to get the dumpster emptied sooner, got nowhere, than contacted the town. We had our property surveyed, in part to determine if his 8' high, chain link fence (installed without a permit) was on our property, a section of which was less than 1' from our garage. The survey showed that most of the fence bordering our two properties was on our property. During the survey, Mr. Ethier admitted to the surveyor that the fence was close to the garage because of a large tree straddling the property line, and to put the fence on the other side of the tree would have caused him to lose the use of a bit of land. With the surveyor's stakes in place, we asked Mr. Ethier to move his fence off our property. He refused, claiming that the fence was on the property line. After several attempts at gaining his cooperation over a period of months, we engaged the services of an attorney. Mr. Ethier ignored our attorney's communications, and we eventually had that portion of the fence on our property removed. Mr. Ethier than came onto our property and destroyed half the shrubbery between our properties on the western border, and attempted to install more chain link fence. The building inspector, Mr. L then got involved and issued a Stop Work Order for the fence. Mr. Ethier chose to ignore the order and proceeded to continue installing his fence, but was stopped with the aid of the police. After that he and we submitted applications to install fencing to the Hyannis Main Street Historic Waterfront District. The committee rejected Mr. Ethier's application and accepted ours. All the time and money involved in this matter was unnecessarily spent because there wasn't and isn't a need for a fence, but if there must be a fence we want it to be attractive. There are other problems we continue to experience from Mr. Ethier's less than neighborly demeaner. He installed five sets of spotlights, all or which shine on our property and into our home. I've had several conversations with him about these wherein I indicated a willingness to assist him redirecting the lights so they illuminate his property, but not ours. His response has been to state, "I shouldn't have to change my configuration". Mr. Ethier keeps a significant portion of his property covered in rubbish. Mr. Ethier built his shed about 8-1\2' from our property contrary to the zoning setback of 10'. While we have not spoken to Mr. Ethier in many months, Carolyn and I continue to be good neighbors. When Carolyn notice suspicious behavior by someone on hi property, she sent Mr. Ethier a text to alert him to potential trouble. When some people moved in behind a small barn on 439 South Street, I contacted the police, and Carolyn contacted the property owner. You and Mr. Calabro have been subjected to offensive odors of garbage decomposing during the heat of summer in a dumpster located unreasonably close to your house(even if it complies with the letter of the law)and you have been deprived of convenience and comfort in your own home. TO: Building File FROM: R Anderson RE: 445 South Street, Hyannis Responded to complaint about storage of commercial equipment on this site. Caller says equipment comes and goes. This property is a multi-family dwelling with a garage converted to a cottage; there is zoning relief on file for this. A couple of years ago the owner cleared the rear yard which had previously been considerably treed and contained dense greenery. The property owner(Jason Ethier) is chipping wood to spread over the middle of the area where it is very muddy due to the lengthy rainy season this year. He is also planting trees along the southern most property line and also around the easterly side One unregistered vehicle was parked behind and obscured by the perimeter fence. No other unregistered vehicles were found on site. The owner stated that no construction equipment is stored here at night. Certainly, there was no evidence of employee parking. I took three photos on this date showing the clearing, the unregistered vehicle (a converted bus with expired registration) and a photo of the chipper. I found no zoning violation on this date.
