Assessor' s Map 327 ,Lot 168. In support of this petition, the petitioner presented evidence that the following conditions applied which would warrant relief: The property consists of an 18, 300 sq. ft . parcel of land occupied by a two-story three-unit apartment building. The building had been used as a tenement house for approximately 30 years , and in in 1983 , was converted to an apartment house. The applicant wishes to add a fourth apartment unit which will contain a first floor with living room, dining room, and kitchen, and a second floor with two bedrooms and a bath. The applicant will construct a parking area for 6 cars , and has an approved Site Plan dated April 21 , 1988. _ , The applicant proposes to rent the apartment for $600 per month. The parcel of land, is narrow and deep which makes strict compliance with terms of the bylaw difficult to carry out and still create the improvements proposed. If the petitioner is unable to proceed with the additional apartment unit as proposed, he will be denied the practical and economic use of his property. FINDINGS OF FACT Based on the evidence submitted, the Zoning Board of Appeals made the following findings of fact : BOCK �� PACE 4 4� ! Desirable relief may be granted without substantial detriment to the, public good because: 1 ) Apartments are a permitted use in the PRD zone and the applicant has substantially upgraded the property. 2) There is a need for affordable housing units in the Town , such -as the applicant is providing . Desirable relief may be granted without nullifying or substantially derogating from the intent or purpose of such ordinance or Bylaw because: 1 ) Apartments are a permitted use in the PRD zone. �x 2) The applicant can provide adequate on-site parking in accordance with the requirements of the zoning bylaw. There are circumstances relating to soil conditions , shape, or topography of such land or structures especially affecting such land in that : The shape of the lot is long and narrow and the building location ti-ie Pre=--ent zoning requirements . The shape of the lot and the location of the building does not allow the addition to be located in conformance with the zoning requirements. A literal enforcement of the applicable Bylaw would involve substantial hardship, financial or otherwise to the Petitioner because: The cost of remodelling and maintaining the property in good order cannot be supported by three moderately priced rental apartments alone. Based upon the above findings , the Zoning Board of Appeals , at a public meeting held on June 16, 1988, by a motion duly made and seconded, voted to grant the relief sought . CLERK' , SSAPIS �. h TOWN OF BARNSTABLE ZONING BOARD OF APPEALS '88 JUN 30 P 4 :16 SPECIAL PERMIT DECISION & NOTICE APPEAL #1988-13 RICHARD ARENSTRUP At a regularly scheduled hearing, held on February 25, 1988, and continued in order that the petitioner might apply for a Site Plan Review, notice of which was forwarded to all interested parties pursuant to Chapter 40A of the General Laws of Massachusetts, the petitioner, through his attorney, Thomas Horton, requested a special permit in accordance with Section 3-2.1 (i) of the Town of Barnstable'9 Zoning bylaws for the property located at 50 Yarmouth Road, Hyannis. In a Professional Residential District. In support of this petition, evidence was presented that the following con- ditions applied which would warrant the grant of a Special Permit. Section 3-2. 1 (1) (i) of the Town of Barnstable's zoning bylaws, Multi- family dwellings (apartments) allows a maximum lot coverage of up to fifty per cent (50%) of the gross area of the lot or combination of lots by the grant of a special permit by .the Board of Appeals. The Petitioner is seeking to construct a fourth apartment unit as an - addition to the existing three apartment building located on the parcel. Assessor's Map 327, Lot 168, is narrow and deep which makes strict com- pliance with the terms of the bylaw difficult to carry out and still create the improvements proposed. The proposed additional apartment would be in keeping with the intent of the bylaw and would not be a detriment to the neighborhood. Off street parking requirements will be met. The additional apartment unit will be built in accordance with the approved site plan. ' DOOK G748PAGE 0119 Based on the evidence presented, the Board found that: 1. That the use is a permitted use in the PRD zone. 2. The applicant can provide onsite parking in compliance with the require- ment of the zoning bylaw, and has an approved site plan. 3. That the proposal as submitted is within the intent of the zoning bylaw and will not be detrimental to the neighborhood. Based on the findings, at a public meeting held on June 16, 1988 the Zoning Board of Appeals voted by a 5 to 0 vote to grant the Special Permit being. sought.
