Attorney Alva stated in the absence of a(new) civil complaint he does not know how to respond. The Judge stated that a complaint had been filed with the court and held up a copy. He instructed Attorney Alva on how to obtain a copy from the court/clerk and noted that in his opinion this is a simple zoning case.The judge continued the matter for one week in order to insure that all parties had the same information and would be prepared to proceed at the next hearing on May 12th. RA advised that we received Mr.Stones request,generously accommodated it by amending the language per his note but he has not requested an inspection in order to close out the permit. The onus is on the applicant to do so. It was arranged that Bob will inspect the basement today at 2PM so that that piece of the complaint can be closed. Subsequently,Attorney Alva advised the Court that Mr.Stone was unable to secure the services of an engineer (a required part of the agreement from 2/17/221)and none of the engineering firms are returning his calls except for DownCape. They charge$2,200.00 and Mr.Stone only gets$1,200.00 a month. He will need a payment plan if he signs with them. RA reminded the court that the financial burden is not for our consideration. We provided an alternative option — remove the structure. As Mr.Stone clearly wants to maintain the hoop house and not relocate it or remove it,he must file with the ZBA as he previously agreed to. No one has discretion to issue a variance in order for the hoop house to remain other than the ZBA. He either removes it or signs a payment plan and moves head with the engineering required for the ZBA variance application. The Court agreed and provided Mr.Stone with a one week continuance to produce a signed engineering agreement while the town will utilize that week to consider injunctive relief if necessary. FYI—I have a real problem with Mr. Marotta's"removal" of the semi-truck..... he had the cab and chassis removed and left the 30' box(80%of the truck) in a heap on site. That has to go.... He is gaming us and the court. Please let Mr.Alva know that this is our last effort with housing court....and that we plan to ask our Legal Department to take the matter over. He should know that we are going to make a formal appeal to the court to move this to a judge in 14 days unless there is a permanent and complete resolution. If need be we will ask legal if they think it's appropriate to go to Superior Court to get an injunction. I will be there on Wed. The following uses are permitted in the RC-1 and RF Districts: M Single-family residential dwelling (detached). Violation: Operation of barbecue/catering business and storage of associated equipment Case Facts: Marotta formerly operated a restaurant on Thornton Dr. Hyannis, a beach concession stand in West Barnstable and assisted his children in operating • a cafeteria at the Savant building on Perseverance Way, Hyannis. Marotta continues to operate a barbecue/catering business at one time identified as Porky's Barbecue. The restaurant equipment, trucks, trailers,smokers and other commercial devices are stored in and around the yard of Marotta's single family home. There is no permit on file with COMM FD for the storage of propane. A permit is required for propane storage exceeding 42 Ibs capacity. A typical residential back yard barbecue tank is 20 lbs. The property file contains complaints concerning commercial activity back to 1998. More recent complaints during the summer of 2018 required multiple inspections between July and Oct, 10/16/2018 A notice of violation was hand-delivered by the Building Commissioner • Brian Florence to Vito C. Marotta. F • 11/30/2018 - Mr. Marotta failed to appeal the Notice of Violation within the 30 days in accordance with Chapter 40A Section 15. Mr. Marotta did not seek zoning relief. No attempt to mitigate the conditions of the property has been made. 01/08/2019 During the course of three months, the Building Commissioner viewed the subject site on numerous occasions in order to assess the status of the continued violation or compliance effort. No attempt to comply up to and including this date has been found and the conditions and circumstances that resulted in the compliance order remain unabated. • • i Summary of Material Facts Vito C. Marotta Property: 28 Hamblin Hayway, Marstons Mills Violation: Vito Marotta operates a traveling/ portable food concession and catering business under a few different names throughout the Commonwealth including Porky's Barbecue and Grill. Mr. Marotta traditionally been known to operate a concession at fairgrounds including the Barnstable County Fair but has also caters for private functions. There is no commercial location associated with a business operation under Mr. Marotta's name. The storage and volume of commercial equipment found on the residential property has been the subject of a long list of complaints. At one time the preparation and smoking of meat from this location was also alleged. The current state of the property reflects a haphazard method of storage reminiscent of hoarding. The yard and its contents are visible to the abutters resulting in numerous complaints being generated over the course of many years. A notice of violation was most recently issued on 10/16/18 and was served and received on Oct. 22, 2018. Mr. Marotta has not appealed that notice and has failed to pursue any zoning relief available to.him. You should be aware that there is a long history recorded in our file and Regulatory staff has responded to the site multiple times, sometime accompanied by COMM Fire, police and Health. Background The property owner, Mr. Marotta formally ran a restaurant on the corner of Thornton Dr and also operated the Sandy Neck concession. He no longer is in business at either location but apparently his adult children are operating the cafeteria at Savant located 75 Perseverance Way, Hyannis. Mr.. Marotta's property contains an unorganized collection of dead or neglected restaurant equipment, trailers, propane tanks and other misc items of various material. The entire property is visibly lacking in maintenance and grooming and in comparison to the abutting properties, it is an insult to one's eye. In addition to the business aspect, Mr.. Marotta has been accused of attaching Maine plates to the various food vendor trailers and equipment whenever it is necessary for him to use and move his equipment. We know he serves barbeque at the county fair every year but he also does private functions as well. The neighbors accused him of smoking meat at home for public consumption. Mr. Marotta simply responds that he is cooking for his family. 2014 This year I notified Falmouth (the county fair is located under their jurisdiction) about the complaint that Marotta smokes the meat from his home. Falmouth responded to the site and spoke to Mr. Marotta at the fair last week. He, of course denied that he was cooking at home. Don D.(Heath) spoke to the Falmouth inspector himself after viewing the subject property from the caller's home and seeing all the equipment in the back yard. Falmouth is aware of our concerns but still found there was nothing for them to address at this time. At least they are now informed and will remember our concern every time a permit is sought in their jurisdiction. You should also be aware that I went to court in March 2014 for a citation written for operating a business in a residential zone. I was blindsided when Mr.. Marotta claimed to be operating at 75 Perseverance Way (I later found out it is under his kid's name and revised business name which was why I was unaware). The magistrate stated that I proved only that Mr Marotta is a hoarder and I did not issue a citation for hoarding. Mr. Marotta was found not responsible. Assessment At this point, my hands are tied. I cannot issue citations for hoarding and I cannot prove he is cooking for public consumption from his home. I cannot make him clean up his yard and I cannot make him a good neighbor. I can say with great certainly that I would not want to live next to him either. Mr. Marotta is well versed in the walking the proverbial line. While I believe the complaint has merit, I was unable to prove it to the magistrate's satisfaction. In my opinion, given the recent dismissal we will have to rely on Health to address the hoarding/attractive 7/28/2014 Page 2 of 2 nuisance/rodent issues that are part and parcel to the complaint concerning food preparation and storage of food service equipment. The abutters have supplied photos of large rodents. However, we must be mindful that this is as difficult to prove as the business aspect was for us. COMM Fire has also been involved and I remember a concern being noted over the volume and manner of propane storage on site. These issues also concerns us but are not within my ability to address. With regards to the illegal attachment of plates, please find an excerpt of an email sent to the Chief and Deputy concerning this allegation on July 2, 2014. In response, I was informed that Sgt. McKenna would check the vesicles. Excerpt: ... I received a call again from the neighbors on Hamblin's Hayway concerning#28(Vito Marotta). He is the barbeque guy that operated out of the former Murph's Recession on Thornton and last year had the Sandy Neck concession (and not this year). He is also said to be operating out of Savant but I heard this may no longer be true either. What I do know is that he is always at he fairgrounds for the County fair. I received a complaint today that.he is once again attaching Maine license plates to whatever vehicle needs to be moved. The neighbors are besides themselves and are screaming that Vito gets away with everything. I explained that this issue is outside of my jurisdiction as it would be a criminal offense to illegally attach plates and not a zoning violation. 1 did say I would channel the information to the proper agency for review. The caller says that between 4:30 and 6:30 every evening Vito &family prepare to relocate various vehicles to wherever they are booked. You may catch them attaching the plates so they can move the subject vehicle to its temporary location for the duration of the special event. If you can have someone check this and provide a visible response, the neighbors would be very grateful. They are disheartened at the moment and claim that no one is listening to them or trying to help... Conclusion As you can see, staff has clearly not ignored the complaints. We in fact pursued remedy with through court but unfortunately lost. We are willing to continue our efforts to get Mr Marotta to clean up property but our ability to address matters to the point of successful closure is severely limited and this understandably translates into a very frustrating situation for the abutters. He said there was a minor violation of a computer and a TV outside and he has mailed a certified letter to the owner of 28 Hamblins hayway (Vito)to clean those items up. A little history on these properties; this has been an ongoing neighbor battle for a very, very long time (over 15 years now) involving several different inspectors over the years. I was not involved with this latest complaint investigation, however, I have been there several times over the years. Mr. Grenier files complaints against Vito, we go out and investigate the complaint. When we are at Vito's property, he complains that Mr. Grenier has lots of violations (too many bedrooms, stuff built with out building permits, renting out rooms, etc.) Vito has been cooperative in the past and allowed us to view his property for violations. Vito does have a lot of"stuff'on his property, which appears to be what is upsetting Mr. Grenier. Until recently, this was not a violation, however with the new junk ordinance which I am not familiar with yet, it sounds like TV's, computers and sinks cannot be kept outside, which were the only violations observed and cited by Donald last week. As for Vitos complaints about Mr. Grenier, it appears Mr. Grenier has denied access to the inspectors to investigate the alleged complaints about his property. Vito complains that we constantly go to his house on complaints, but nothing is ever done about his complaints on Mr. Grenier. I'm not sure if Vito is aware that the inspector was denied access by Mr. Grenier to investigate the alleged violations. Vito has alleged in the past that Mr. Grenier has connections in town, and if I recall correctly, Vito mentioned something to do with the fire dept, and I told Vito that we investigate all complaints, it does not matter if they have connections or not. I do find it odd that someone filing complaints against someone then refuses to allow Town Inspectors to investigate complaints at their property, however he has that right and if the Town does not seek an administrative search warrant, nothing will be done about that complaint. I've explained to Vito in the past that we investigate all complaints. Who knows, maybe Vito is not cleaning up his"stuff' because nothing is done about Mr. Greniers alleged violations or maybe that is just Vito's lifestyle and he will continue to live like that. Attached please find the order letter from Donald Desmarais regarding the latest complaint. Vito was given 15 days to remove the TV, Computer and sink outside. Typically, after the certified letter is signed by the owner, dated and returned to us, the inspector will follow up on the order letter after the deadline. Sometimes it takes a little longer to follow up depending on the inspectors scheduling, especially in this case where there is no public health threat,just an aesthetic violation. Staff has reported to the site on numerous occasions to confirm the conditions and activity reported and subsequently to follow up on the progress promised by Mr. Marotta and his son. In 2012, I was informed by Mr. Marotta and/or his son that the property was for sale and was being marketed as a short sale property. In the absence of a sale,the property was likely to be foreclosed. I reported to the site on Friday 8/3/2012. There appeared to be at that time at least an effort to re-organize or dispose of some of the items in the front yard and driveway. Lt Martin MacNeely noted the haphazard storage manner of an excessive number of propane tanks. Later, it was confirmed that a certificate had been granted for the tanks without an expiration date. This is no longer the practice. Currently, all certificates have an expiration date and a residential limit is applied. Additionally, the storage of multiple units inside and around a shed in the back yard failed to meet the safety recommendation for safe and proper storage. It was the general consensus of all inspectors that the true nature at the root of the complaints is a hoarding issue. Because, the hoarding includes commercial activity and equipment, the operation of a business must be addressed first. Mr. Marotta once operated a restaurant in Independence Park and a concession stand at Sandy Neck. He was also a known to have a BBQ trailer at the Barnstable County Fairgrounds every summer. He no longer has a restaurant and recently lost the bid for the Sandy Neck concession. I am afraid that these factors will mean more commercial activity occurring at the house and with no where else to relocate his equipment additional complaints will resume in the spring. The primary item of concern is the haphazard storage of propane. I believe COMM researched his permit and intends to work with him to reduce the amount and provide proper storage. Currently, his permit is excessive and permits in that capacity are no longer issued in residential settings. I believe COMM will revoke the existing permit for failure to follow proper storage requirements and subsequently issue a permit in a reduced amount. The owner is to contact the COMM FD directly for that inspection to take place. I am in communication with COMM concerning this matter and have been coordinating with Martin MacNeely so we all have the same information, updates and concerns. I can better inform you after Friday regarding the current status but the bottom line is theses residents appear to be hoarders.
