780 CMR the Massachusetts State Building Code, Ninth Edition Chapter 1 - Section 110.7
which reads:

Background
In application No. 2016-016, South Sea Village, Inc. sought a Conditional Use Special Permit to operate
a restaurant in the.Highway Business District and to modify Special Permit No. 1987-107,as modified by
Special Permit No. 1990-044; to remove the prohibition on take-out service. According to the Applicant,
the proposed restaurant will be called "Jasmine Blossom", an "Asian fusion restaurant specializing in
Thai, Japanese, and Chinese cuisine." The proposed restaurant operators have six other locations
throughout Massachusetts.
The subject property is a 126 acre lot on Route 132/lyannough Road and Hinckley Road in Hyannis. It
Is improved with an 8,598 gross sq.ft commercial restaurant building,currently.vacant. The structure was
constructed in 1973 as a Denny's restaurant; it was expanded in 1987 and has,housed:a variety of family
restaurants, most recently Uno's Pizzeria. The structure is nonconforming to front yard setbacks in the
HB District. It is served by public water and sewer. There are 88 accessory parking spaces.
The expansion of the preexisting nonconforming building was permitted by Special Permit No. 1987-107,
which includes a condition that the restaurant would be "a family-style, sit down restaurant without take-
out facilities, [with] a maximum of 218 seats and no bar seats." That condition was modified by Special
Permit No. 1990-044 to allow a maximum of 36 of the 218 total seats to be bar seats. The condition

Procedural &Hearing Summary
Special Permit Application No. 2016-016 for the operation of a restaurant in the Highway Business
District and modification of Special Permit No. 1987-107, as modified by Special Permit No. 1990-044
was filed at the Town Clerk's office and the office of the Zoning B6ard of Appeals on February 1, 2016. A
public hearing before the Zoning Board of Appeals was.duly advertised .and notice sent to all abutters
and interested parties in accordance with M.G.L Chapter 40A. The hearing was opened on March 23,
2016 at which times the Board found to grant the Special permit subject to conditions. Board members
deciding on this appeal were Brian Florence, Alex M. Rodolakis, George Zevitas, David A. Hirsch,
and Matthew Levesque.
The Applicant, Mr.Wong,was represented by Attorney Steven Pizzuti before the Board. Attorney Pizzuti
reviewed the history of the property and stated his client has not proposed any changes to.the exterior of
the building or to the site. There are no changes to the number of restaurant seats proposed,except that
10 of the bar seats would now serve a sushi bar. Attorney Pizzuti stated the property is located in the HB
District, where a Conditional Use Special Permit is required for all uses other than offices or banks. Al
uses permitted in the 5 District are permitted In the HB District with the grant of a Special Permit. The

Applicant seeks a Conditional Use Special Permit to continue use of the property as a restaurant.
Further, the applicant seeks to modify conditions of the previous Conditional Use Special Permits to
remove the prohibition on take-out service. Attorney Pizzuti stated the take-out element of the restaurant
is essential to its business plan.. The Board Chair requested public comment and no one spoke.
Findings of Fact
At.the Hearing on March 23, 2016.the Board voted and made the following finds of fact in Special Permit
• No.2016-016,a request for a Conditional Use Special Permit to operate a restaurant in the Highway
Business District and to modify Special Permit No. 1987-107, as modified by Special Permit No. 1990-
044,to remove the prohibition on take-out service.
1. In Application No. 2016-016,South Sea Village, Inc. has requested a Conditional Use Special Permit
to operate a restaurant with take-out service at 574 lyannough Road, Hyannis.
2. Section 240-25(C)(1)of the Zoning Ordinance allows any use permitted in the B District with a
Conditional Use Special Permit. A restaurant is permitted in the HB District with a special permit from
this Board.
3. Further,the Applicant seeks to modify the conditions of Special Permit No. 1987-107 to remove the
prohibition on take-out service.
4. The use of the property as a restaurant was 'established as-of-right In 1973 and became
nonconforming with the adoption of the Highway Business District in 1983. The.Board issued Special
Permit No. 1987-107 to allow the operation of a family restaurant with 218 seats and for expansion of
the preexisting nonconforming structure. That decision was modified by Special Permit No. 1990-
044,which allowed 36 of the.218 seats to be bar seats. ti
5. The operation of a restaurant by South Sea Village, Inc. and the removal of the prohibition on take-
out service would not substantially affect the public health,safety,welfare, comfort or convenience of
the community.
6. The Applicant has obtained approval from the Building Commissioner to designate five existing
parking spaces for take-out parking spaces. No other changes to the capacity, building or site are
proposed.
7. After an evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the
Zoning Ordinance and would not represent a substantial detriment to the public good or the
neighborhood affected.
8. The proposed use of the property will not substantially adversely affect the public health, safety,
welfare,comfort or convenience of the community.
9. The proposed commercial use and reuse of the existing building.are consistent with the Local
Comprehensive Plan,which designates the area as a Regional Retail Center.

square feet to the north and east sides of an existing 5,000

snows parking spaces for 83 vehicles. The existing structure is

TOTAL: 83 spaces
Recommendation: The proposed use will most likely generate less
traffic than a fast food restaurant. The existing parking lot is
well-designed and can accommodate 83 cars. The landscape plan is
most attractive.
It is recommended that the application be approved for a maximum

In support of this petition, the Pe tioner presented
evidence that the following conditions applied which would .

The applicant presented plans showing a 2700 square- foot-
addition to an existing restaurant buiding on Route 132,
formally occupied by Denny's.
The applicant stated that the building was constructed in
1973 with a 56 foot setback from Route 132 in conformance
with the Zoning Bylaw. Since then, a 60 foot. setback from
Route 132 has been established.; the building .does not
conform and is therefore a non-conforming structure. The
applicant wishes to extend the building maintaining the same
setback.
Parking for' 83 spaces is shown on a site plan.
The applicant proposes to use the property as a sit-down,
family style restaurant similar to Blooms on Route 2.8 in
Yarmouth. There will be a maximum of 218 seats and no bar
seats.
Based on evidence submitted at the hearing, the Zoning Board
of Appeals made the following findings :
( 1 ) That the proposed addition would not increase
traffic on Route 132, which is over capacity.
(2) That the parking is adequate- for the use as per
the Selectmen's findings.
(3) That the restaurant is a pre-existing use which
is now permitted by special. permit in the Highway .
Business Zone.
(4) ' That the proposed restaurant use will not generate
more traffic than the previous fast-food
restaurant, but may generate less traffic, or
generate traffic after the peak traffic volumes
on Route 132.
(5) That the proposed use will be no more detrimental
than the previous use, namely the fast-food
restaurant.

Based on these findings, a Public meeting
2, 1988, the Board of Appeals unanimously voted to approve
the special permit requested. In granting the relief
sought, the Zoning Board of Appeals has imposed the
following conditions, the breach of which shall invalidate
