An Extension of time for Bearing of the comprehensive Permit was executed between the applicants' representative and the Board. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter.40A. The hearing was opened November 20,2002, continued to December 11,2002,and to January 22,2003,at which time the Board found to grant the comprehensive permit Board Members hearing and deciding this appeal were Gail Nightingale,Ron S.Jansson,Thomas A.DeR.iemer, Jeremy.Gilmore and Chairman,Daniel M.Creedon. Attorney Michael J.Princi represented the applicant Also present during the hearing were John McShane and Steven C.Hayes,Architect During the hearing of this comprehensive permit extensive testimony and information was given by the applicant,abutters and town agencies. For,a detail of the proceedings, copies.of the hearing minutes are available at the Town Clerk's Office ' and at the Office of the Zoning Board of Appeals. FINDINGS OF FACT AS TO STANDING: At the January 22,2003,hearing,the Board made the following findings of fact as related to the applicants' standing on the request for a comprehensive permit in accordance with MGL Chapter 40B. 5 Town of Barnstable-Zoning Board of Appeals-.Decision and Notice Comprehensive Permit-2002-133-"Southside Village, 1. The applicant is John McShane,Trustee of Southside Realty Trust According to a copy of a Declaration of Trust establishing Southside Realty Trust signed by John McShane on May 01,2002,and recorded at the Barnstable Registry of Deeds in Book 15590,page 48 on November 20,2002,the trust as a limited dividend organization under MGL Chapter 40B and limits profits to no more than 20%. A copy of a recorded declaration has been submitted to the file. According to a submitted copy of the Schedule of Beneficial Interest,John McShane is identified as having 100%of the beneficial interest in the trust The trust address is P.O.Box 429,Osterville,MA 02655. 2. The applicant-has secured a commitment for funding of.the proposed affordable housing project Barnstable County HOME Consortium. A project eligibility letter dated October 04,2002,has ben iisssued to the applicant form Paul Ruchinskas,Affordable Housing Specialist with the Consortium: The letter was issued pursuant to 760 CMR Section AThe HOME Investment Partnership Program is a qualified funding source under MGL Chapter 40B. Although the funding program only requires a 30-year commitment to affordability,the applicant has offered to protect the home in perpetuity as affordable. 3. With reference to control of the site,a Quitclaim Deed recorded November 20,2002 in Book 15950 as Page 52 documents the transfer the property from John J.McShane and Gaile McShane as Trustees of S.M. The applicant for this comprehensive permit is John McShane,Trustee of Southside Realty Trust,a limited dividend organization,created to sponsor low and moderate-income housing. 2. The project is located on two vacant parcels totaling 1.35 acres and is to be accessed from Route 28, Falmouth Road. The locus is zoned Residential B and Residential RD-1. The entire site is within the.GP Groundwater Protection Overlay District and the western half is in th District e Resource Protection Overlay 3. The applicant has requested the comprehensive permit,in accordance with MGL Chapter 40B, for fourteen (14)attached condominium units to be developed within 4 buildings on the 1.35-acre site. 12 are to be two- bedroom units and 2 are to be three-bedroom units.Sizes range from 918 sq.ft. two-bedroom units to 1,232 sq. ft three-bedroom units. Four of the units are to be ground level one-story special need units and 1.0 are to be two-story units.AIl 14 units,are to be affordable dwellings, 4. The four special need units are to be designed for handicapped persons. Two of the special need units are to be two-bedroom and the other.two are to be three-bedroom. The units are intended for clients of the Department of Mental Retardation and are to include on-premises live-in assistance for the clients 5. Of the 14 affordable units;2 units are to be committed to households at or below 50%of the area median i n come. income and the remaining 12 units are to be committed to households below the.80"/0 of the area median . 6. Upon completion of the development,the units are to be converted to condominiums'and all 14 transferred together to the Housing Assistance Corporation,a regional not-for profit housing organization,which will own and manage the units as affordable housing. 7. The applicant has a.track record of developing affordable housing in the region and the Barnstable Housing Committee has expressed support for the proposal and development The ultimate end owner of the Town of Barnstable-Zoning Board of Appeals-Decision and Notice Comprehensive Permit-2002-133-"Southside Village., development will be Housing Assistance Corporation,who is committed to providing affordable housing. They have committed to renting the'units to qualified persons and households. The Barnstable Housing Authority has previously,testified to this Board that there is a serious deficiency in affordable rental family housing within the Town of Barnstable. This development will provide affordable rental housing for families. 8. According to the pro forma presented in the application, the developer will be selling the development to the Housing.Assistance Corporation for a sum of$1,730,000. That is the projected cost of the development including developer's fee and overhead. The developer's fee and overhead represents 11.5% of the total, cost and is within the 20%profit limitation imposed on a.limited dividend organization and in the requirements of CMR160. The sum to be paid by the Housing Assistance Corporation represents$117,000 per two bedroom and$163,000 per three-bedroom unit Those per unit costs are considered affordable for the Bamstable/Yarmouth Metropolitan Statistical Area. 9. According to the Department of Housing and Community Development Chapter 40B Subsidized Housing Inventory of October 01,2001,the Town of Barnstable has 953 affordable housing units.or 4.70%of the housing stock. The goal of MGL Chapter 40B,the Local Comprehensive Plan and the Regional Policy Plan is to provide 10%of the housing stock as affordable. 10. The median family income for a 3-person household in the Barnstable-Yarmouth SMA was$50,875 as of October 01,2001. The 80%group would be those.3-person households making less than$40,700. To meet the requirements of affordability,the cost of housing(including utilities) should not exceed 30%of the 80% or$12,210 per year or$1,017.50 per month. 11..Land.use surrounding the site is dedicated to a mix of uses. To the east is Founders Court,a multi-family. affordable housing development. To the west are commercial offices,across Route 28 is institutional and to the south are single-family homes. Public transportation already exists on the roadway and public water and Town sewers are available. Schools are also within walking distance: 12. The applicant is aware,that the proposed connection will have to be approved by the Town of Barnstable Engineering Division and will require DEP and MEPA permits..The Town Engineer has written to MEPA stating that the connection of the fourteen units will be insignificant In addition,the location of the sewer line within the tight-of-way of Route 28 requires Mass Highway approval. Ile applicant has not yet received any response back from MEPA that the proposed hook-up would be insignificant : 13. The Local Comprehensive Plan promotes"the provision of fair,decent and safe affordable housing,for rental or purchase,which meets the present and future needs of the low-to-moderate income residents." The end.owner and manager of the development will be Housing Assistance Corporation,a regional non- profit organization committed to providing fair,decent and safe affordable housing: 14. The Town has undertaken an aggressive role in providing needed and suitable housing for its residents : through the Housing Plan adopted by the town council on January 3.1,2001.. One of the goals of the affordable housing component of the town's comprehensive plan and the town's housing plan,is to encourage developers to approach the town in the early stages of a development to assure that the proposal meets the town's local housing needs. This affordable housing proposal has been a.cooperative effort developed between the applicant John McShane,the Housing Assistance Corporation and the Town. Over ,a period of months,.they have collaborated to mold a proposal to accommodate the needs of the residence of the town. The cooperative effort in this instance has created what could be termed a"friendly Chapter 40B furthering the impletuentation of the Housing Plan of the Town of Barnstable: 15..The Board has received several reviews by town agencies,numerous letters and heard testimony from the applicant,abutters and concerned citizens. The comments generally favored the affordable housing development but did point out issues and concerns that the Board must address if the permit were to be I granted. Town of Barnstable-Zoning Board of Appeals-Decision and Notice Comprehensive Permit-2002-133-"Southside Village" The Engineering Division noted the permits required for connection with the Wastewater Treatment Facility but also noted the processing capacity of the plant and the need to review and investigate the Marks Path Pumping station and its ability to handle additional flow. A later communique also notes that proper plan from a licensed contractor will have to be approved • The Planning Board expressed concerns with the proposed density,ingress and egress safety and the .limited open space and recreation areas. • The Town Manager in his review of the Project Eligibility noted concerns for the Town's treatment plant being'at capacity with respect to discharging of effluent,the need for a landscaping plan and a maintenance program and the expectation that the units.be committed to affordability in perpetuity_The Board feels confident that it can issue conditions with this permit that will address those concerns. 16. In the past,the Zoning Board of Appeals,in granting comprehensive permits under Chapter 40B has relied upon representations that the subsidizing agency involved would be responsible for monitoring the development's continued compliance with the requirements.The Board has discovered that contrary.to representations made,in several instances there has been no monitoring performed by the subsidizing agency and that several of the subsidy programs are no longer in existence. The Board is gravely concerned that the purposes of Chapter 40B will be seriously thwarted unless there is an effective,long-term monitoring component contained within each comprehensive permit it grants. The Board's goal in establishing such a monitoring mechanism is so that regardless of the fate of the subsidy program or agency, the citizens of the Town of Barnstable will be assured that the units dedicated to income eligible individuals are so utilized in perpetuity. .17. In light of the threatened loss of affordable housing units within the Town of Barnstable and throughout Barnstable Countydue to "expiring uses",and in,view of the Town's current deficit in affordable housing units,it is consistent with local needs for the Town of Barnstable to ensure the long-term affordability of ul�u�ate income: It is the specific finding of the Board that the proposals set aside all 14 units in perpetuity as affordable. Two of the units shall be committed to affordability at 50%of the median income level and the other 12 units to individuals or households whose income is 80%or less of the median income in the area of Barnstable-Yarmouth Metropolitan Statistical Area(SMA). 18. The proposed development was shaped through the cooperative efforts of all involved, to conform with the town's comprehensive plan,housing plan and the town's housing needs as further identified by the Barnstable Housing Authority and the Barnstable Housing Committee. Said units are 100%affordable and provide much needed rental housing to a range of income levels. It also offers housing for the special needs population,which is an underserved group identified as in need of housing in the town's local comprehensive plan. This proposed development was recognized in the town's housing plan. A Regulatory Agreement and individual deed riders,reflecting the above restrictions,shall be prepared by the applicant,approved by the Town Attorney and recorded at the Registry of Deeds by the applicant against the property and the individual units at the time the property,is transfer to the Housing Assistance.Corporation. Such restrictions shall take priority over all financing documents related to this project 12. Upon completion of the development,the units are to be converted condominium and all 14 transferred to the Housing Assistance Corporation,a regional not-for profit housing organization,which will own and manage the units as affordable rental housing. The.Cdndominium Master Deed,Declaration of Trust, (herein after"the Documents'),and Bylaws shall be reviewed by the Town Attorney's Office for consistency with this comprehensive permit and for any provisions that would adversely affect.the longterm affordability of the units or would jeopardize the requirement that the units be affordable in perpetuity. Said documents shall be duly recorded in the Barnstable County Registry of Deeds. A conformed copy of such recorded documentation shall"be forthwith provided to.this Board: None of the Documents shall be modified or amended in any way.or manner so as to negate the terms and conditions of this decision. 13. In the renting of these units,the Housing Assistance Corporation shall be subject to the 26%limitations imposed by MGL Chapter 40B on profit from the rental of the units and to all conditions of this comprehensive.permit The units are to remain rental affordable units for a minimum the first ten years. No unit maybe sold individually from the 14 units without the prior permission from the Board If the Board grants permission to sell said units,said units shall be sold only as affordable units (2 at 50%of the area median income and below and 12 at 80% or below of the area median income) to qualified individuals with the requitement that they be owner occupied and restricted affordable units in perpetuity. 1 p. This Comprehensive Permit is granted with the condition that the proposed development is to be funded through the Barnstable County HOME Consortium and is contingent upon that final approval and funding. If the funding source changes,the applicant shall be required to notify the Board for a modification of this permit 19. The Barnstable Housing Authority,shall be responsible for reviewing all information submitted by the applicant and requesting any additional information that they deem necessary to assure that the applicant is in compliance with all the terms of this permit Upon any report to this Board from the Barnstable Housing Authority that the terms and conditions of this permit are not being upheld,The Zoning Board of Appeals shall have the ability to hold a hearing to show cause as to why this Comprehensive Permit shall not be revoked. The applicant shall pay the yearly monitoring fee normally charged by the Board for Comprehensive Permits which is 1125/per unit,per year. This fee may be reviewed by the Barnstable. Housing Authority every 2 years and increased as needed. In addition to monitoring of the affordable units and tenants,the Barnstable Housing Authority shall also annually review the management and upkeep of the development to assure that the overall project is properly managed and maintained. 21. This Comprehensive Permit is issued to the applicant John McShane,Trustee of Southside Realty Trust and to the successor owner the Housing Assistance Corporation. It shall not thereafter be transferable without the prior written approval of this Board 22.
