Dear Mr. McCourt,
We have approached a member of the Old King's Highway Regional Historic
District Committee in Barnstable in reference to the certified letters that
we, the undersigned, received from you concerning the placement of our signs
on Route 6A in West Barnstable.
We feel it is disciminatory that these particular signs have been singled
out in infest Barnstable and yet to our knowledge there have been no other
certified letters calling for removal of signs issued in surrounding towns
on Route 6A. We are small businesses and feel we would suffer a hardship
and loss of business if we have to move the signs back. In some cases they
would be obstructed by trees. The tourists could cause accidents looking
for the signs.
We either purchased our properties with existing sign approval or went
through the proper approval procedure via the Old King's Highway Committee
and the Town of Barnstable Sign permit process. Neither committee suggested
that we would also need approval from the state for the -placement of the
sign.
It is our understanding that the Old King's Highway Regional Historic
District in Barnstable has agreed as of September 21, 1994 that they would
pursue a study on whether or not to suggest to the State Highway Department
that some placement of some signs may be more appropriate in the Historic
District if left in their present location.
It is our understanding that a verbal extension has been allowed by you
to those signed below until a review has been made concerning the placement
of signs on. Route 6A by the Old Kings Highway Regional Historic District
Committee in Barnstable.
We would very much appreciate an extension in writing as all of us are
very concerned about the signs having to be removed in three (3) days and
if they are not removed the state will remove them and we will be billed
for the labor.
Please let us know if there is to be an extension and, if so, for how
Jong so that we may be in compliance.

RE: August Carlson House
It has come to our attention that you may have taken some steps toward demolishing the historic
house on your property. These steps may have involved the breaking of windows and chainsawing
portions of the siding. Please be advised that it is illegal for you to take any action toward
demolition of the building.
I am sending a copy of this letter to the Building Department and if necessary the Building
Inspector will order a Cease and Desist. Thank you.

6/29/94 New sign, not to be erected before 7/11/94, was approved by the
old Rings Eighway Regional Historic District Committee.
6/30/94 The approved sign, and another sign stating "Don't buy property on
6A, the 'll take our freedom away. It's "Y not worth Y y itt (see
photo) were installed.
Large "OPEN" flag displayed in window.
Mr. Pinske was supposed to put up the sign after the issuance of a sign permit
on or after 7/11/94. As of this date, he still has not applied for a permit.
I have spoken to Mr. Pinske regarding the placement of his new sign on State
property, the sign which has not been taken off the building, and a purple-
colored artful duck that has been displayed in the yard.
I .have found Mr. Pinske to be arbitrary and his language to be unacceptable.
He indicated during our last conversation that he was going to put up another
sign stating that "The Planning Department sucks".
I do not think that Mr. .Pinske wants to be a good neighbor and his outside
displays certainly do not look attractive in the beautiful, historic Old
Ring's Highway District.

RE: violations
It is now necessary that enforcement action be taken with regards to the
Pinski Art center, located at 1989 Route 6A, W. Barnstable. The Old
Kings Highway approved a certificate of Appropriateness for a sign.
One of the conditions was that the sign over the door be removed; it was
approved but not for the location that it presently occupies. To date
this has not been done. Please order a ceast and desist for the sign
over the door and the one that's not in the correct location.
Also the OKH would like you to check on two other locationse
0�. 1) Sandra Costello, Maggy Lane, a 6 feet stockade fence, we have no.
Certificate on file for that fence.
2) Stanley Rosonbald, 43 Indian Trail, Cummaquid a cage 10 feet in size
in the front of the house.
3) The building on 3010 Barnstable Road a sign almost 20 square feet in
size.

The early houses built by the Finnish immigrants to
West Barnstable are part of their heritage, and it is
important that they be preserved as historical sites
for their descendants.
The contributions that the Finnish settlers and their
descendants have made to the Town of Barnstable are well
documented from 1900 to the present time.

ARCHITECTURAL SIGNIFICANCE Describe important architectural features and evaluate in terms of
other buildings within the community.
This vernacular style , story and a half Cape., has a saltbox style roof on
the south facade to an extended e,ll . The chimney , located on the S .W. side
of the roof at its juncture with the ell , is moderate size and rises to the
height of the roof peak. _ , T.he J-ront door on the north facade is centrally
located and a dormer runs 7 /8ths of the • north roof with 3 windows having
3 /3 medium panes . There is one .window on each upper gable end , 212 large
panes as are most windows on the first level of the house . The house has
a low stone foundation and is located on the north side of6A facing north .
HISTORICAL SIGNIFICANCE Explain the .role owners pl.ayed:in local or state history and how the

August Carlson was one of the early immigrants of many that settled in
West Barnstable from 1895• to 1925 , seeking work and improved living
conditions . Many left Finland to escape forced service in the Russian
army .
He built two houses on the 7 acres he purchased in 1901 . The "West House "
was last owned by Waino Ojala and family who built a new house around it
and then dismantled the Carlson "West House . "

I Barre Pinske do request the removal of the existing Historic house located at 1989 Rt. 6A W.
Barnstable MA.
It has become apparent that the placement of the parking to the rear of the cottage has jeopar-
dized the use of the large existing nonconforming use building I have renovated into an art
gallery. Under the following conditions I would consider moving the structure to the left of the
parking area.
1. Permission be granted to me by the ZBA for a house to be built on the top of the hill in the
rear of the property.
2. The Historic house be renovated by one or all of the concerned groups, or a group established
for that purpose, who in turn would also maintain it and use it for some purpose. The group
would only be concerned with the structure and have no say in the landscaping around the
building. There would be no septic but the large buildings facilities would be made available
except in the winter.
3. A sign stating Barnstable Historic District be placed along Rt. 6 before exit#6, Rt. 132..
If those who feel the structure has value are not willing to invest in it I would like to put the
structure up for sale for$1.00 to be removed to another sight. My neighbors next to the Paxtons
which is directly to the right of my property and across the street have stated an interest. Their
property abuts 6A.
Please realize the necessity of the structures removal and allow me to continue to develop a

successful use for the large structure.

It has come to the attention of the staff serving the Zoning
Board. of Appeals that a demolition permit has been
requesting for a building located on the above referenced
site. This site is subject to Special Permit #1992-11
issued by the Zoning Board of Appeals with conditions and
all references .made by the applicant in securing that
Special Permit.
The applicant represented in his application to the Board
that;
"Construction will be limited to restoring the cottage, . . .
as shown in plans submitted . . . .
Condition No. 3 of the Special Permit specifies that;
"All the work shall be done in accordance with the approved
site plan" .
That site plan shows the existence of the structure for
which a demolition permit is now being sought.
It is the staff's opinion that the proposal to demolish the
residential structure located on this site would constitute
a change in the plans approved by the Zoning Board and a
change in the conditions issued by the Special Permit.
It is recommended that prior to the issuance of any
demolition permit a modification of the Special Permit
#1992-11 be sought and approved by the Zoning Board of

13 My reasons for applying for a Special Permit are as follows;I Barre Pinske,seek to
acquire a special permit to change the current use from the present non-conformng
use as a warehouse storage facility,to a non-conforming retial art center, as an attempt to
upgrade the existing property. It's my intent to create an art center that is complimentary
to the neighborhood,the Route 6A Historic District,and the Cape Cod arts community. The
building and cottage at this location,often described as an eyesore by those I've shared my
ideas with, has intrigued me for some time. I have worked to the best of my ability in
completing all the requirements prior to applying for this permit. I am convinced, hope to
convince you ,and than show you,that I can make this location a special place that we all
can be proud of. I would like to communicate the relief requested here relates to current
questions of what this property is, and what this property will become. The RTC will
liquidate this property.Whether or not a better use would come about is an unknown.I can
assure you, I will give 110% of my talent to create a use (described in question#10) and
encouraged by the Cape Cod Commission Regional Policy Plan section 3.1.4.(included in
proposal), by beautifying the landscape and in renovating the existing structures to a higher
and better use. During the last four years I have lived at and operated the Giving Tree
Gallery at 550 Route 6A in E. Sandwich. During that time my partner and I made visual
improvements much to the delight of our neighbors and the community.I enjoy Cape Cod
and I am proud to be a part of the Route 6A historic District.Please allow me the opportunity
to live, work, and raise a family at this location, and to share my talents with my new

Petitioner : Barre Pinske
Summary of Relief Sought:
At a regularly scheduled hearing of the Zoning Board of
Appeals , held on February 20, 1992, notice of which was duly
published in the Barnstable Patriot, and notice of which was
forwarded to all interested parties pursuant to
Massachusetts General Laws Chapter 40A, the petitioner ,
Barre Pinske, has appealed to the Zoning Board of Appeals
and petitioned for a Special Permit, to change an existing
non-conforming warehouse use to another non-conforming use
that of an art center, pursuant to Section 4-2. 2 of the
Zoning Ordinance.
The applicant's site is shown on Assessor' s Map/Parcel
Number 216/38, more commonly addressed as 1989 Route 6A ,
West Barnstable, MA and is zoned RF Residential District.
The following Board members heard this petition : Gail
Nightingale, Betty Nilsson, Luke Lally, Gene Burman and
Chairman Bliss.
Summary of Evidence:
The petitioner, Barre Pinske, presented his petition before
the Board. Mr Pinske discussed the history of the project
and stated that a Site Plan was approved for this proposal
by the Site plan Review Committee. Mr. Pinske also stated
that he appeared before the Old King's Highway District
Committee (OKH) . The OKH granted him an informal approval
for the proposed changes to the building. Mr. Barre Pinske
stated that some alterations were done to the original Plan
that had been approved by the OKH. Mr Barre Pinske also
stated that he will be appearing before the OKH next week.
Mr Pinske further stated that he will apply for a curb cut
permit to the State DPW after obtaining a Special Permit
from the Board.
The Board questioned the hours of the art center operation
and Mr. Pinske stated that normally an art gallery business
is seasonal . It is not like a normal business with posted
hours . He owned a Gallery on Route 6A in East Sandwich and
had formal business hours from 9 - 6.
The Board discussed the parking area and reviewed the Plans .
Mr. Pinske stated that he intends to utilize stone retaining
walls and landscaping in the parking area.
The Board discussed the runoff from the locus onto Route 6A
and property to the north. The Board reviewed the Plan and
the location of catch basins . Mr. Pinske stated that all
the storm water run-off will be retained on the property.
The Board questioned the applicant regarding legality of the
existing non-conforming use.
Mr . Pinske provided the Board with a copy of the Assessors 's
Field Card, dated 1989, indicating the use of the building
as a warehouse within the past five years .
The Board asked the applicant about the use of each floor of
the building
Mr. Pinske responded that the garage area will be his work
space, the lower level will house his personal work and the
upper level will be used to display other artists works that
he will be marketing.
The Board questioned the proposed lighting on the site.
Mr. Pinske responded that he will build the lights in a way
so that they will not reflect light to the side properties .
Mr. Pinske explained that the lights will provide a full -
moon affect in order to provide safety in the parking area.
Mr. Pinske summed up -his presentation by saying that he has
worked very hard on this project and hopes that the Board
will find in favor -of his project.
The following people made comments regarding this petition :
Mrs. Messer, who has resided in the area for 25 years ,
commented on the noise that emanated from the building with
its former use as warehouse. She also spoke on behalf of
her next door neighbor, Ms . Corsa. She and her neighbor are
in favor of this petition. -
Andrew Ojala spoke in favor of the proposed use.
Mr . & Mrs . Paxton, close abutters , spoke in support of the
petition and hoped that the Board will grant approval to Mr.
Pinske.
Helen Wirtanen stated that she is not- really speaking in
favor or against but commented that the existing building is
an eyesore and anything would be an improvement.
Melody Ojala spoke in favor of the petition.
Mr . Joseph Daluz, the Town of Barnstable Building
. Commissioner, commented .that a Site Plan was approved for
this site, with three conditions as enumerated in a letter
to the Board.
Finding of Facts :
At the meeting of the Zoning Board of Appeals held on
February, 20, 1992, the Board made the following finding of
facts as related to Application # 1992- 11 :
1 . That the petitioner has received a site plan approval in
accordance with Section 5-3 .3 (2) (C) of the Zoning Ordinance,
with three conditions .
2 . It has been established that there has been a non-
conforming use on the premises within the past five years .
3 . The proposed use would not be more detrimental to the
neighborhood affected than the existing warehouse use.
4. The proposed change is from one non-conforming use to
another non-conforming use.
The vote was as follow:

Based upon the positive findings, a motion was duly made and
seconded, the Board voted to grant the petitioner a Special

ADDITIONAL INFORMATION FOR MAKING AND FILING AN APPLICATION
FOR A CERTIFICATE OF APPROPRIATENESS
The four categories for which a Certificate of, Appropriateness is required are: (application for demolition or removal is a
separate form).
1. EXTERIOR BUILDING CONSTRUCTION (new or existing buildings): An application is required for any exterior of a
building to be erected or'altered including windows, doors, siding, roof, light etc., that will be visible from any public street,
way or public place. The following scale drawings are required in duplicate with application: plot plan (if addition —show

existing buildings in outline), floor plan and elevations. Also required are snap shots of existing buildings, where additions or
alterations are to be made. No plot plan is required for addition or alteration which does not touch the ground.
2. EXTERIOR PAINTING: An application is required for any portion of a building, structure or sign,to be painted'that is
visible from a public street, way or public place. Color samples must be attached to these applications. An application is not y'
required when repainting existing colors, changing to white, or using colors approved by the Town Historic District Committee.
3. SIGNS OR BILLBOARDS: An application is required for any sign or,billboard to be erected within the District, with the
fol lowi ng'excepti ons:
a. Existing signs or k illboards on November.27, 1974 shall have until November 27, 1977 to secure an approved Certificate
of Appropriateness.
b. Temporary signs for use in connection with any official celebration or parade or any charitable drive as long as they are
removed within three days of the event. Certain other temporary signs that the Committee feels does not detract from
the Act may be allowed with the-prior permission of the Committee.
c. Real Estate signs of not more than '3 square_ feet in area advertising the sale or rental of the premises on which they are
erected or displayed.
d. A single sign of not more than. 1 square foot in area showing the name, occupation or address of the occupant of the
premises on which they are erected or displayed in a residential zone.
4. STRUCTURE: An application is required to build or alter any structure within the District which is defined by the Act as a
combination of materials other than a building, sign or billboard, but including stone walls,41agpoles, hedgss, gates, fences, etc.
GENERAL REQUIREMENTS
5. Work on projects requiring approval shall not be started until the Certificate of Appropriateness has been filed with the Town
Clerk by the Committee. Approval is subject to the 10 day appeal period provided in the Act.
6. No changes shall be made from the original approved specifications without advance approval of the Commission on an
amended application filed with the Committee. '
7. A separate application must be filed with each project requiring a Certificate of Appropriateness.
8. Under heading of "Detailed Description of Proposed Work" give detailed data on such architectural features as: foundation,
chimney, siding, roofing, roof pitch, sash and doors, window and door frames, trim, gutters —leaders, roofing and paint color.

Pinske Art Center
Dear Dr. Fenney:
This letter is in response to your letter re the Pinske Art
Center. This Art Center has, as I understand, a
conversation piece. Mr. Pinske came before Site Plan Review
and has met all the various requirements, including the
Board of Appeals.
When Mr. Pinske appeared before Site Plan Review he
explained to us what he had accomplished at the Giving Tree
Gallery in Sandwich and that when completed the site was a
show place. He stated very emphatically that he would do
the same in Barnstable. He also stated that he could only
do the work in stages and requested time to accomplish his
plan since he too had to make a living. He has assured me
on at least two occasions that he will complete the work to
conform with the plan on file in my office.
Now the question of "ART" . I had a meeting with Attorney
Peter Freeman, Chairman of the Old Kings Highway Historic
District Committee about this issue. It was interesting to
note that I never received a formal complaint from the Old
Kings Highway Historic District Committee, but not surprised
that I had not. So what is "ART"? Recently there was a
real furor in New York re "Art" displayed by artists . We
can find nothing in the regulations to prohibit art in any
form. We have discussed it at length and noted the same.
Mr. Pinske's idea is to promote sculpture in wood and metal.
He has an array of ideas about his' art form. He is an
artist and that's his art.

You are protected by the Old King's Highway Regional
Historic District regulations to the extent permitted by
law.
Dr. Fenney, I believe we should allow Mr. Pinske to complete
his project and at that time rule on compliance of the
completed project. He has assured me that he will live up
to his commitment and the Site Plan Review requirements.
Yes, I have been trying to help answer your concerns as well
as the concerns of others. That is why my response was
delayed.
I am sure we can resolve this issue for all concerned if
allowed the opportunity to come to a reasonable resolution.

Attention Patty,
As of our discussion Monday I have made a list of my requests for informal discus-
sion. As in the past I will try not to take much of the boards time.
1. I would like to build a stockade Fence to hide the mess I've created on the east side
of my building next to the shop.
2. The small house is proving to be a hazard to my visitors. The parking area is not at
all visible and people are doing strange driving maneuvers in front of the Property.
3. By listening to people who come in to'my building I feel as though the OKH could
use some Public relations help. My personal feeling,having lived in Sandwich and
driven down 6A many many times, is that Barnstable has the best Historic presenta-
tion on Cape and we should be proud of that and publicize a positive relationship
between the community and the OKH. I'd like to help.
AMENDED 9/23/92 MINUTES
Chairman P. Freeman felt some of the comments were not
germane to the jurisdiction that OKH deals with. OKH does
not handle Enforcmcnt Issues that is the Building Inspectors
Department . The only thing he. could suggest was . to ask the
Building Inspector to go back out and re-check the setting
to see if it was in violation.
Second item discussed: Barre Pinski requested this time to
discuss , 1 ) a stockade fence to hide the mess on the east
side of building. 2) the lack of parking area. 3) mail box
structure. Accompaning Mr . Pinski was reporter Dan Quinn,
from the Register Newspaper. P. Freeman read into the
record the letters from Dr. William N. Fenney, Helen E.
Wirtanen, Olavi Watka and the Town of Barnstable Historical
Commission all whos ' concerns were with the building the Art
Center is located in, that it wi I 1 not to be demo ) ished or
relocated.
B. Pinski spoke about the small house he wants to remove as
being an economic detriment and a hazard to visitors . P.
Freeman explained the process : a Demolition Permit and a
Site Plan Review Hearing . Suggestions were made by all
members .
MOTION was duly made by L. Davis and seconded by P. Freeman
that OKH ADJOURN the Hearing.

letter is to convey our opposition to the demolition of the
August Carlson house (circa 1901 ) on 1981 Main Street, West
Barnstable Mass.
The August (frlson house is the second oldest house built by
the Finnish settlers- of West Barnstable. These earlier houses
built by finnish immigrants are part of the heritage of the
ori7inal Finnish settlers on Cape Cod, and we feel it is
important these homes be preserved as historical sites.
The Finnish American society of Cape Cod requests that you
will take action to prevent the August Belmont house from
demolition, and be preserved as a historical site.

The Barnstable Historical Commission , established by Town Meeting
in 1967 under the provisions of Chapter 40 , Section 8D of
Massachusetts General Law for the purpose of preserving and
protecting the historic assets of the Town, by unanimous vote
strongly recommends that the historic building located at 1989
Route 6A in West Barnstable , not be demolished or relocated .
The "August Carlson House " , one of the earliest dwellings built
by the early Finnish settlers , is not only located within the Old
King ' s Highway Historic District but is also a contributing
element in the Old King ' s Highway National Register District and
the Town ' s Multiple Resource Area nomination accepted by the
National Park Service in 1988 .
Because the Old King ' s Highway is included in the Site Plan
Review process , the Historical Commission wishes to bring to
the committee ' s attention the enclosed material excerpted from
the files of the Site Plan Review and Zoning Board of Appeals .
In particular we would like to call your attention to the decision
of the Zoning Board of Appeals and Condition #3 : " . . .All the

Summary of Relief Sought:
At a regularly scheduled hearing of the Zoning Board of
Appeals, held on February 20, 199z, notice of which was duly
published in the Barnstable Patriot, and -notice of which was
forwarded to all interested parties pursuant to
Massachusetts General Laws Chapter 40A, the petitioner,
Barre Pinske, has appealed to the Zoning Board of Appeals
and petitioned for a Special Permit, to change an existing
non-conforming warehouse use to another non-conforming use
that of aM" art center, pursuant to Section 4-2. 2 of the
Zoning Ordinance.
The applicant's site is shown on Assessor' s Map/Parcel
Number 216/38, more commonly addressed as 1989 Route 6A,
West Barnstable, MA and is zoned RF Residential District.
The following Board members heard this petition: Gail
Nightingale, Betty Nilsson, Luke Lally, Gene Burman and
Chairman Bliss.
. Summary of Evidence:
The petitioner, Barre Pinske, presented his petition before
the Board. Mr Pinske discussed the history of the project
and stated that. a Site Plan was approved for this proposal
by the Site plan Review Committee. Mr. Pinske also stated
that he appeared before the O1d,King's Highway District
Committee (OKH) . The OKH granted him an informal approval
for the proposed changes to the building. Mr. Barre Pinske
stated that some alterations were done to the original Plan
that had been approved by the OKH. 'Mr Barre Pinske also
stated that he will be appearing before the OKH next week.
Mr Pinske further 2wt6ted that he will apply for a curb cut
permit to the State DPW after obtaining a Special Permit
-from the Board.
The Board questioned the hours of the art . center operation
and Mr. Pinske stated that normally an art gallery business
is seasonal . it is not like a normal business with posted
hours . He owned a Gallery on Route 6A in East Sandwich and
had formal business hours from 9 - 6.

Melody Ojala spoke in favor of the petition.
Mr. Joseph Daluz, the Town of Barnstable Building
Commissioner, commented that a Site Plan was approved for
this site, with three conditions as enumerated in a letter
to the Board.
Finding of Facts :
At the meeting of the Zoning Board of Appeals held on
February, 20, 1992, the Board made the following finding of
facts as related to Application # 1992- 11 :
1 . That the petitioner has received •a site plan approval in
accordance with Section 5-3 .3 (2) (C) of the Zoning Ordinance,
with three conditions.
2. It has been established that there has been a non-
conforming use on the premises within the past five years .
3 . The proposed use would not be more detrimental to the
neighborhood affected than the existing warehouse use.
4. The proposed change is from one non-conforming use to
another non-conforming use.
The vote was as follow:
AYES: BURMAN, NILSSON, NIGHTINGALE, LALLY, BLISS
Decision:
Based upon the positive findings, a motion was duly made and
.seconded, the Board voted to grant the petitioner a Special
Permit for change of non-conforming warehouse use to retail
art center subject to following conditions :
1 . That the petitioner shall receive an approval from the
Old King's Highway Committee.
2. That the petitioner shall receive a curb cut permit from
the Massachusetts Department of Public Works .
3 . All the work shall*be done in accordance with the
approved site plan.
The vote was as follow:
AYES; BURMAN, NILSSON, LALLY, NIGHTINGALE, BLISS

Narrative;
I Barre Pinske seek to renovate an existing warehouse building in an approved motif
consistent with the historic district established along route-6A. The main structure will be used for
the production and sale of art work I create. The small historic residential building will be restored
and I will reside there. I propgs%property develoment in phases over the next two years, while in
business, with respect to my time and budget. I am a skilled craftsman and will be doing much of the
work myself.
I assert that I have completed (or caused to be completed) this page, the Site Plan Review Applica-
tion and the check list on the back of the application and that, to the best of my knowlbge, the infor-

under Title V, the State Environmental Code.
2) Four (4) feet not shown at test hole in relation to the
bottom of the proposed leaching facility.

I have assembled,to the best of my ability,the requests of the site Plan Review Board.
The Engineer was unable to complete the requested additions and or changes on the
plan,as of this date,much to my disappointment.Hopefully I will be able to submit
them with time for review prior to next weeks meeting.
I did however complete a lighting diagram to add to the package, (comment#9), I
hope the board will find my efforts satisfactory. Also I have submitted a sign design
and placement plan,(comment#10). The computer graphic,of the building,has the
comments of the OKH committee written on the bottom of the page.I also spoke to
them with regards to.the cottage, (comment#6).The improvements are going to be ; -
done on the cottage with no change to the structure,therefor not requiring an approval.
If is my intention.to research the history and try to find pictures of the structure to
follow. At that point I will again informally discuss the cottag with the OKH. ,
Please find included a photo copy confirming usage of e pre-existing non-
conforming use, (comment#7 ) , during the time period from`1986 to 1988.
I have communicated with the state DPW in regards to the curb cut(comment#5).
I received your call this morning,with respect to Mr. Marcello's comments, and an
approval with a contingent State DPW approval would be a gracious help.
I would also like to make a request for an extension of the review boards time frame
for decision with regards to my project.I have been unable to acquire the engineering
changes necessary with in the current time frame.

I am writing to call your attention to the con-
dition of the above property , which received a permit from
the Board of Appeals for the re-institution of a non-conform-
ing use in a residential neighborhood . Having attended the
hearing- and personally hearing the appellant state that the
area -between the road and the main structure would be "all
flowers" it has come as quite a surprise to see more and more
signs and displays of merchandise.
Enclosed please find copies of the approved plans
by you, including the one (only) .attached-to-building sign
plus the lighting and landscaping . I also enclose copies of
recent articles about the "new art movement" and of the post
card invitation to the grand opening, all for your information.
Please note that on the Landscaping Plan the com-
puter graphics make it nearly impossible to distinguish the
separate plantings . Also note the title '.'Shop" at the Eastern
end of the configuration . There are a lot of types of shops
gift shops , barber shops , antique shops , welding shops - and
this is apparently more closely related to the last . There is
a collection of rusty old junk facing the Old King ' s Highway
which does nothing to beautify . I believe that the public has
been misled throughout the permitting process .
Nearly across the street is "Paxton' s Antiques" , a home
occupation, so-called, which has been in violation. of the sign
code for years , plus outside displays of merchandise - notifica-
tion to the Building Commissioner has brought no results , but I
am sending them a copy of. this letter anyway; also the Board of
Appeals .

Description; I propose to carve an Eagle in full detail with extended wings around a sign board. The beak would be gold
leaf,the head and tail to be gilded in white gold. The body and wings of the bird are proposed to be brown so that the bird
actually looks like a Bald Eagle. I propose to carve and guild the letters in capitals,using the Times font. It's my intention
to use a black,with the slightest tint of dark purple,for the area surrounding the letters and white,with a slight tint of lavender,
for the perimeter area of the sign board.I propose to construct the sign within a maximum of 13.5 square feet. The carved
�=. lettered sign board will be 1'xT.The Eagle carving represents the remaining 6.5 Sqr.Ft. of the total 13.5 Sqr.Ft.proposed.
Placement of the sign will be on the front of the existing building, centered above the entrance door.I respectfully request
the board find the size proposed compositionally correct, with respect to the size of the existing structure, as shown in
rendering.

I :barre Pinske propose to design build and install light posts with directional low voltage fighting that is

in keeping with the Route. 6A Historic District. I intend to create a 3/4 moon illumination directed only
p toward the buildings, sign,parking area and rear garden area. My specific intent is to create a discrete
neighborhood feel with the lighting, but also provide enough illumination to provide safe movement
about the property after sunset. The exterior lights are intended to be placed on timers, which will
automatically shut off-in the latter part of the evening. The lights, on the rear corner of the main building
adc at the entry to the primary parking area, will be equipped with motion detectors.

August Carlson house (circa 1901 ) on 1981 Main Street, West
Barnstable Mass,
The August erlson house is the second oldest house built by
the Finnish settlers- of West Barnstable. These earlier houses
built by finnish immigrants are part of the heritage of the
ori7inal Finnish settlers on Cape Cod, and we feel it is
important these homes be preserved as historical sites-.
The Finnish American society of Cape Cod requests that you
will take action toprevent the August Belmont house from
demolition, and be preserved as a historical site.

I am writing to call your attention to the con-
dition of the above property , which received a permit from
the Board of Appeals for the re-institution of a non-conform-
ing use in a residential neighborhood . Having attended the
hearing and personally hearing the appellant state that the
area between the road and the main structure would be "all
flowers" it has come as quite a surprise to see more and more
signs and displays of merchandise.
Enclosed please find copies of the approved plans
b 1 y you, including the one (only) attached-to-building sign
plus the lighting and landscaping. I also enclose copies of
recent articles about the "new art movement" and of the post
card invitation to the grand opening, all for your information.
Please note that on the Landscaping Plan the com-
puter graphics make it nearly impossible to distinguish the
separate plantings . Also note the title "Shop" at the Eastern
end of the configuration . There are a lot of types of shops -
gift shops , barber shops , antique shops , welding shops - and
this is apparently more closely related to the last . There is
a collection of rusty old junk facing the Old King ' s Highway
which does nothing to beautify . I believe that the public has
been misled throughout the permitting process .
Nearly across the street is "Paxton' s Antiques" , a home
occupation, so-called, which has been in violation of the sign
code for years , plus outside displays of merchandise - notifica-
tion to the Building Commissioner has brought no results , but I
am sending them a copy of this letter anyway; also the Board of
Appeals .

Description; I propose to carve an Eagle in full detail with extended wings around a sign board. The beak would be gold
leaf,the head and tail to be gilded in white gold. The body and wings of the bird are proposed to be brown so that the bird
actually looks like a Bald Eagle. I propose to carve and guild the letters in capitals, using the Times font. It's my intention
to use a black,with the slightest tint of dark purple,for the area surrounding the letters and white,with a slight tint of lavender,
' for the perimeter area of the sign board.I propose to construct the sign within a maximum of 13.5 square feet.The carved

i'Barre Pinske propose to design build and install light posts with directional low voltage lighting that is
in keeping with the Route. 6A Historic District. I intend to create a 3/4 moon illumination directed only
toward the buildings, sign,parking area and rear garden area. My specific intent is to create a discrete
neighborhood feel with the lighting, but also provide enough illumination to provide safe movement
about the property after sunset. The exterior lights are intended to be placed on timers, which will
automatically shut off-in the latter part of the evening. The lights, on the rear corner of the main building

-Barre--Pinske presented his application for alterations,
sign, fence and wall. The Committee reviewed and discussed
the plans presented. Mr. Pinske explained to the Committee
that he put shingles and deck in the back as stated from
previous hearing. He further explained the location of the
stone walls and that he would do plantings in between the
rocks. Mr. Pinske stated many different ideas he had for the
landscaping for the area and the Committee agreed it would
make the property very attractive.
D. Martin questioned the cottage on the plan, and Mr. Pinske
explained he would take off the vinyl siding and re-shingle.
MOTION was duly made by P. Freeman and seconded by D. Martin
that the OKH APPROVE WITH AMENDMENT plans as presented and
to allow the cottage vinyl siding be removed and replaced

Petitioner: Barre Pinske
Summary of Relief Sought:
At a regularly scheduled hearing of the Zoning Board of
Appeals, held on February 20, 1992, notice of which was duly
published in the Barnstable Patriot, and notice of which was
forwarded to all interested parties pursuant to
Massachusetts General Laws Chapter 40A , the petitioner ,
Barre Pinske, has appealed to the Zoning Board of Appeals
and petitioned for a Special Permit, to change an existing
non-conforming warehouse use to another non-conforming use
that of an art ,center , pursuant to Section 4-2. 2 of the
Zoning Ordinance.
'The applicant's site is shown on Assessor' s Map/Parcel
Number 216/38, more commonly addressed as 1989 Route 6A ,
West Barnstable, MA and is zoned RF Residential District.
The following Board members heard this petition : Gail
Nightingale, Betty Nilsson, Luke Lally, .. Gene Burman and
Chairman Bliss.
Summary of Evidence:
The petitioner, Barre Pinske, presented his petition before
the Board. Mr Pinske discussed the history of the project
and stated that a Site Plan was approved for this proposal
by the Site plan Review Committee. Mr. Pinske also stated
that he appeared before the Old King' s Highway District
Committee (OKH) . The OKH granted him an informal approval
for the proposed changes to the building. Mr. Barre Pinske
stated that some alterations were done to the original Plan
that had been approved by the OKH. Mr Barre Pinske also
stated that he will be appearing before the OKH next week.
Mr Pinske further stated that he will apply for a curb cut
permit to the State DPW after obtaining a Special Permit
from the Board.
The Board questioned the hours of the art center operation
and Mr. Pinske stated that normally an art gallery business
is seasonal . It is not like a normal business with posted
hours . He owned a Gallery on Route 6A. in East Sandwich and
had formal business hours from 9 - 6.
The Board discussed the parking area and reviewed the Plans .
Mr. Pinske stated that he intends to utilize stone retaining
walls and landscaping in the parking area.
The Board discussed the runoff from the locus onto Route 6A
and property to the north. The Board reviewed the Plan and
the location of catch basins. Mr. Pinske stated that all
the storm water ru.n-off will be retained on the property.
The Board questioned the applicant regarding legality of the
existing non-conforming use.
Mr. Pinske provided the Board with a copy of the Assessors 's
Field Card, dated 1989, indicating the use of the building
as a warehouse within the past five years .
The Board asked the applicant about the use of each floor of
the building.
Mr. Pinske responded that the garage area will be his work
space, the lower level will house his personal work and the
upper level will be used to display other artists works that
he will be marketing.
The Board questioned the proposed lighting on the site.
Mr. Pinske responded that he will build the lights in a way
so that they will not reflect light to the side properties.
Mr. Pinske explained that the lights will provide a full -
moon affect in order to provide safety in the parking area.
Mr. Pinske summed up his presentation by saying that he has
worked very hard on this project and hopes that the Board
will find in favor -of h i s project.
The following people made comments regarding this petition :
Mrs. Messer, who has resided in the area for 25 years ,
commented on the noise that emanated from the building with
its former use as warehouse. She also spoke on behalf of
her next door neighbor, Ms. Corsa. She and her neighbor are
in favor of this petition.
Andrew Ojala spoke in favor of the proposed use.
Mr. & Mrs . Paxton, close abutters, spoke in support of the
petition and 'hoped that the Board will grant approval to Mr.
Pinske.
Helen Wirtanen stated that she is not really speaking in
favor or against but commented that the existing building is
an eyesore and anything would be an improvement.

Melody Ojala spoke in favor of the petition.
Mr. Joseph Daluz, the Town of Barnstable Building
Commissioner, commented that a Site Plan was approved for
this site, with three conditions as enumerated in a letter
to the Board.
Finding of Facts :
- At the meeting of the Zoning Board of Appeals held on
February, 20, 1992, the Board made the following finding of
facts as related to Application # 1992- 11 :
1 . That the petitioner has received a site plan approval in
accordance with Section 5-3 .3 (2) (C) of the Zoning Ordinance,
with three conditions.
2 . It has been established that there has been a non-
conforming use on the premises within the past five years .
3 . The proposed, use would not be more detrimental to the
neighborhood affected than the existing warehouse use.
A. The proposed change is from one non-conforming use to
another non-conforming use.
The vote was as follow:
AYES: BURMAN, NILSSON, NIGHTINGALE, LALLY , BLISS
Decision:
Based upon the positive findings, a motion was duly made and
seconded, the Board voted to grant the petitioner a Special
Permit for change of non-conforming warehouse use to retail
art center subject to following conditions :
1 . That the petitioner shall receive an approval from the
Old King' s Highway Committee.
2. That the petitioner shall receive a curb cut permit from
the Massachusetts Department of Public Works .
3 . All the work shall be done in accordance with the
approved site plan.
The vote was as follow:

Gary Brennan asked about the building and what mechanisms
would prevent it from being improperly used in the future.
Chairman Bliss stated that the enforcement of the Zoning
Ordinance is the Building Commissioner's Office - he acts on
complaints filed with him.
Attorney Kirk submitted copies of Case Law that he had
referred to in his initial presentation. Also apologize to
Mr. Tuttle when he referred to items as junk - this has
nothing to do with the quality of items collected by Mr.
Tuttle. If he constructed the same building to house rare
works of art, he would still be present tonight. It is the
size of the building and composite of uses which are the
problem.
There is nothing wrong with the language of the Ordinance -
the words are terms of art and have to be applied to these
facts and in view of the facts in the area - what is
customary in terms of an accessory building - in terms of
size and use. Ask the Board to apply the standard that the
Court amplifies.
In speaking for the Board, Chairman Bliss stated that the
Board will view the site and others in the Town. Also, he
will not be present for the next scheduled hearing of March
12 , therefore, we will not make a decision until Mach 26.
Mr. & Mrs. Tuttle will be out of Town - Chairman Bliss
stated that we will not take any further testimony - the
Board will view the. site, on an individual basis, and also

will provide a Certified Plot Plan to the Board and if
possible, in confidence, similar structures in the flown.
Attorney Kirk stated that from that aspect - discussed non-
conforming structures/new structures.

The following Board members heard this petition: Gail
Nightingale, Betty Nilsson, Luke Lally, Gene Burman and
Chairman Bliss.
A Staff Report prepared by the Planning Department has been
submitted to the file.
Mr. Pinske presented his petition before the Board. He told
the Board that 14 months ago he gave a $1, 000 deposit to Mr.
Klotz as a down payment to acquire the building and since
then he has acquired the necesssary financing and approval.
An approved Site Plan has also been submitted. Mr. Pinske
has appeared before the Old King's Highway District and has
been informally granted relief.
Chairman Bliss discussed the approval . of the OKH. Barre
Pinske stated that there were alterations done to the
original Plan of approval. The new Plan has been approved
informally., a copy of which has been submitted to the file
and Barre will be appearing before that Board next week.
Gail Nightingale questioned the hours of operation.
Mr. Pinske that normally a Gallery business is seasonal. He
owned a Gallery on Route 6A in East Sandwich and can say
that approximately 70 - 80% of the business was drive-by..
He had formal business hours from 9 - 6, but because he
lived there people would stop and oftentimes they would talk
with them. It is not like a normal business with posted
hours. The only time they would have evening hours is when
they would have an art opening - that would be for a few
hours only - more than likely, they would be open for
business on Sundays.
Betty Nilsson discussed the parking area - the Plans were
reviewed. The petitioner intends to utilize stone retaining
walls and a great deal of foliage.
Betty Nilsson discussed the steep hill. Mr. Pinske will
make this the maximum grade, yet still have safety - he will
work with the hill and place walls, rocks, plants and
foliage along the area so that one can still move about
safely without removing too much soil. This Plan was
something that was recommended by the Site Plan Review Board
and since then many of his own ideas have gone by the
wayside, instead he has been encouraged to do other things
such as saving the existing dwelling. Mr. Pinske stated
.that he is happy to say that he understands and appreciates
many of their ideas, although he personally would not like
to have a parking area of this size; however, with the size
of the building it is required and from what he now
understands of it, it seems a good idea. Initially, he
intended to have a second floor above the garage which would

increase the square footage; however, the new Plan deleted
that so that he would not be required to have additional
parking.
Betty Nilsson commented regarding the prior petition of
1982, in which Arne Ojala stated that the clay nature of the
soil in the area would cause runoff water from the locus to
flow onto Route 6A and to the property to the north.
The Plan was discussed and the catch basins were identified
by Mr. Pinske who stated that all the water will be retained
on the property.
The petitioner stated that there will be a paved area, and
he has contacted the DPW who told him that it is possible to
install gravel, although the steepness of the property might
not allow that. He would probably pave the area and add
sealcoating of grey stone - feel that is more attractive -
needs to be addressed. The petitioner has been in contact
with the State DPW regarding the curb cut - he has been told
that the curb cut will cost $500 and until he has his
approval/Special Permit he will not proceed with that.
The Plans and the Staff Report were reviewed by the Board.
The shingles will be colored/weathered to give the
appearance of being old - there is a process where he would
burnish the wood - blacken shingles and go over with grey
stain. The existing garage has an overhead door which will
be altered with a barn door. The petitioner and the Board
discussed the existing windows.
Luke Lally informed the petitioner that he must prove the
non-conforming use.
Mr. Pinske has provided the Board with a copy of the
Assessors Field Card dated 1989 indicating' the warehouse
use, as required within the past five years.
Luke Lally does not believe that the Board can give approval
until several items have been established, specifically, the
curb cut, etc. , the Board must approve as Per Plan.
Mr. Pinske proposed that the Board approve. the Plan as
submitted pending the acquisition of approval by the OKH and
the State DPW he has been in touch with a Mr. Broderick of
that Department regarding the curb cut - ,has been told it
would not be a problem - once the information and check
reaches him - he has ten days within which to respond -
should be completed by the end of the appeal process.
Mrs. Messer, who has resided in the area for 25 years
commented on the prior noise that emenated from the building
with its former use - it was terrible with noisy trucks and
motors running, etc. She also spoke on behalf of her next

door neighbor, Ms. Corsa, who is unable to be present
tonight and is also in favor.
Andrew Ojala who is an abutter to the locus is confused - he
would like to view the Site Plan - objects to the layout of
the parking lot going up the hill; however, he does like the
proposed use.
Mr. & Mrs. Paxton, close abutters, spoke in support of the
petition and hope that the Board will grant approval to Mr.
Pinske.
Helen Wirtanen stated that she is not really speaking in
favor or against, but has heard what is said - this is an
eyesore - anything would be an improvement - have not heard
anything about change of use - would. like Mr. Pinske to
clarify what is going to be on the first floor and whether
there are two or three shops on the second floor - that is
what the Board has to decide - if he is going to be
subletting space, she would like an answer to that.
Melody Ojala spoke in favor of what the petitioner intends
to do - her concern is what might happen if businesswise
tfhis does not work - what will then happen to the property.
Chairman Bliss responded that the use established by the
Board can continue to another owner, but a change of use
would come back before the Board. If someone else came in
to run an Art Gallery, they would be able to , do that - the
building would have a Special Permit; however, if they came
in to have retail that would be a change of use and would
come back to the Board, etc.
Andarew Ojala commented that years ago a retail store wanted
to have that use on the site '- it was .. rejected - he
questioned on what basis it was rejected.
Chairman Bliss responded - that with that type of use there
might be a combination of things such as parking, rapid turn
over of vehicles 2 - ' 3,000 one dollar purchases daily which
makes a difference in traffic volume, as opposed to a
business that might sell one, $3,000 painting.
Mr. Daluz, The Town of Barnstable Building Commissioner,
commented regarding the Site Plan submitted and that some of
the questions from various Boards to Mr. Pinske were
addressed by him and he has come back with the revised Plan,
and must add in his favor that it was the first time that
comments made by the Site Plan Review were addressed so
completely by the petitioner who did a lot of work to
satisfy the concerns and directives of the Site Plan
Committee. . The Site Plan approved with three conditions it is conditional approval with the three recommendations as
enumerated in their letter.

It has been established that there is currently a curb cut;
however, believe the State is looking for funding which
requires the petitioner to file, etc.
Chairman Bliss commented that there is one question that was
not addressed, specifically, whether the use is going to be
retail gallery on all floors.
Mr. Pinske responded that the garage area will be his work
space, the lower level will house his personal work and the
upper level will be other artists works that he will be
marketing. There is a trend today in the art business to
allow other individual artists to place their pieces in an
area and acquire that space for a set amount of money and
not be there and have the gallery owners run the gallery and
market their works - eliminating the sales percentage. It
is difficult for artists to make money = the average artist
in America today makes $12,000 a year. Having a place to
show artists work is very important - artists have to give
up 40 - 50% to the people marketing their work because they
do their business.
Betty Nilsson questioned the proposed lighting.
Mr. Pinske will build the lights so that the sides are
shaded - will have reflected glass on the sides to direct
the light. Mr. Pinske understands the importance of being a
good neighbor - he desires to have a nice addition with the
least amount of impact.
Helen Wirtanen questioned whether there would be any lights
in the parking area, and has there been any discussion of a
sign.
There is a diagram of the proposed sign in the file.
Mr. . Pinske discussed his intent regarding the lights which
he described in the paperwork - he would like to do a full-
moon effect so that when the lights are on there will be a
full-moon illumination to provide safety, etc.
Mr. Pinske summed up his presentation by saying that he has
worked very hard on this project. and hopes that the Board
will find in favor of his project.
GAIL NIGHTINGALE MADE THE FOLLOWING FINDINGS:
find that the petitioner has received Site Plan Approval
with three conditions. The use is not more detrimental. It
has been established that there has been an existing non-
conforming use on the premises within the past five years.

1. I propose to change the existing garage roof from a relatively flat pitch with
the peak facing the front of the building,to a roof with a matching pitch and peak,
8' below the existing roof on the main warehouse building.

doors.
3. I propose to change the rear of the building from the existing windows on

I Barre Pinske propose to design build and install light posts with directional low voltage lighting that is
in keeping with the Route. 6A Historic District. I intend to create a 3/4 moon illumination directed only
toward the buildings, sign,parking area and rear garden area. My specific intent is to create a discrete
neighborhood feel with the lighting, but also provide enough illumination to provide safe movement
about the property after sunset. The exterior lights are intended to be placed on timers, which will
automatically shut off-in the latter part of the evening. The lights, on the rear corner of the main building
and at the entry to the primary parking area, will be equipped with motion detectors.

At a regularly scheduled hearing of the Zoning Board of
Appeals, held on February 20, 1992, notice of which was duly
published in the Barnstable Patriot, and notice of which was
forwarded to all interested parties pursuant to
Massachusetts General Laws Chapter 40A, the petitioner ,
Barre Pinske, has appealed to the Zoning Board of Appeals
and petitioned for a Special Permit, to change an existing
non-conforming warehouse use to another non-conforming use
that of an art center, pursuant to Section 4-2.2 of the
Zoning Ordinance.
The applicant's site is shown on Assessor' s Map/Parcel
Number 216/38, more commonly addressed as 1989 Route 6A ,
West Barnstable, MA and is zoned RF Residential District.

The Board discussed the runoff from the locus onto Route 6A
and property to the north. The Board reviewed the Plan and
the location of catch basins. Mr. Pinske stated that all
the storm water run-off will be retained on the property.
The Board questioned the applicant regarding legality of the
existing non-conforming use.
Mr. Pinske provided the Board with a copy of the Assessors 's
Field Card, dated 1989, indicating the use of the building
as a warehouse within the past five years .
The Board asked the applicant about the use of each floor of
the building.
Mr. Pinske responded that the garage area will be his work
a lower level will house his personal work and the
space, the o
upper level will be used to display other artists works that
he will be marketing.
The Board questioned the proposed lighting on the site.
Mr. Pinske responded that he will build the lights in a way
so that they will not reflect light to the side properties.
Mr. Pinske explained that the lights will provide a full -
moon affect in order to provide safety in the parking area.
Mr. Pinske summed up his presentation by saying that he has
worked very hard on this project and hopes that the Board
wi l l find in favor -of his project.
The following people made comments regarding this petition:
Mrs. Messer, who has resided in the area for 25 years ,
commented on the noise that emanated from the building with
its former use as warehouse. She also spoke on behalf of
her next door neighbor, Ms. Corsa. She and her neighbor are
in favor of this petition.
Andrew Ojala spoke in favor of the proposed use.
Mr. & Mrs. Paxton, close abutters, spoke in support of the
petition and hoped that the Board will grant approval to Mr.
Pinske.
Helen Wirtanen stated that she is not really speaking in
favor or against but commented that the existing building is
an eyesore and anything would be an improvement.
Melody Ojala spoke in favor of the petition.
Mr. Joseph Daluz, the Town of Barnstable Building
Commissioner, commented that a Site Plan was approved for
this site, with three conditions as enumerated in a letter
to the Board.
Finding of Facts:
At the meeting of the Zoning Board of Appeals held on
February, 20, 1992, the Board made the following finding of
facts as related to Application # 1992- 11 :
1 . That the petitioner has received a site plan approval in
accordance with Section 5-3 .3 (2) (C) of the Zoning Ordinance,
with three conditions.
2. It has been established that there has been a non-
conforming use on the premises within the past five years .
3. The proposed use would not be more detrimental to the
neighborhood affected than the existing warehouse use.
4. The proposed change is from one non-conforming use to
another non-conforming use.
The vote was as follow:
AYES: BURMAN, NILSSON, NIGHTINGALE, LALLY, BLISS
Decision:
Based upon the positive findings, a motion was duly made and
seconded, the Board voted to grant the petitioner a Special
Permit for change of non-conforming warehouse use to retail
art center subject to following conditions :
1 . That the petitioner shall receive an approval from the
Old King's Highway Committee.
2. That the petitioner shall receive a curb cut permit from
the Massachusetts Department of Public Works .
3 . All the work shall be done in accordance with the

Applicant's Proposal :
The premises is a 70,000 sq.ft. parcel of land and contains
two buildings, used as a warehouse and a residence. The
applicant proposes to use the warehouse building as a
center. The applicant specifically proposes to produce, •
display and sell art and related products including
paintings, graphic arts, wood and metal sculpture,
videography and photography. The applicant proposes to
restore the existing residential structure, which is on the
National Historic Register, and to improve the appearance of
the other building, currently a non-conforming warehouse.
Zoning Relief Sought:
The applicant is seeking a Special Permit under Section 4-
4.2 of the Zoning Ordinance, for the change of the existing
non-conforming use of warehouse to another non-conforming
use as an art center.
Background:
In 1982, the Board granted a Special Permit to Matthew &
Joanne Cavallini , change of non-conforming warehouse storage
use to retail use subject to four conditions (see attached) .
Staff Comments:
Pursuant to Section 4-4.2 any proposed change of a non-
conforming use to another non-conforming use only shall be
allowed if the proposed change is no more objectionable or
substantially detrimental to the neighborhood and a Special
Permit is obtained from the Board. According to assessor' s

record, the warehouse contains 6,640 sq. ft. of floor area
and the residential structure contains 736 sq.ft. of living
area.
A site plan of the premises entitled" Site Plan of land in
West Barnstable, MA" , revised dated 1/23/92 , prepared by
down Cape Engineering, submitted by the applicant, shows two
buildings and parking for 24 vehicles. This site plan was
reviewed and found approvable by the Site Plan Review
Committee on 1/23/92.
Summary:
The applicant should be required to document or establish
the pre-existing legal non-conforming use of the building as
a warehouse, which. justifies the relief being sought. If the
Board finds that the request for a Special Permit is
appropriate then the Board should consider the following:
1 . that the applicant shall obtain necessary approval

Attorney Stephen C. Jones represented the petitioners who are the owners of a
nonconforming storage warehouse at 1989 Main St. (Rte. 6A) -West Barnstable
in a residence F zoning district. The locus has been known as the Barker-Chadsey
building and prior to its warehouse use was a wholesale marine supply store with
some retail sales. The petitioners purchased this property in 1977 and now seek
a special permit to allow three retail stores in this structure as shown on the
plan submitted with the filing. Mr.. Jones said that the building is in a state
of disrepair and the petitioners would landscape and upgrade the property so that
it would bean asset to the neighborhood. The building was originally used as
a gas station and car repair shop. Mattresses are now stored in this buil-ding for
a store which Mr. Cavallini operates in Hyannis. The Locus comprises 1 .2 acres
of land and on-site parking for 30 to 50 cars would be provided in the rear
portion of the lot. There would be one entrance and exit onto route 6A. Mr.
Jones said the Boards consideration should be based on whether or not the pro-
posed use would be substantially more detrimental to the neighborhood than the
existing use. There are now large trucks going in and out of the property in
conjunction with its use for mattress storage and the proposed use with upgrading
and renovating of the building and landscaping would be less detrimental than the
existing use. The petitioners are not asking to have two or more uses differing
in use since all of the shops would be retail stores.
No one spoke in favor of. the petition and speaking in objection was Atty. Daniel
J. Mullen representing Martha 0jala, abutter to the locus. Mr. Mullen said that
Barker-Chadsey used the warehouse as a marine hardware distribution center prior
to their move to Rhode. lsland. The present use of the property is run on a business
day basis and a shopping center use would extend the hours of operation and create
additional traffic. The 0jala's operate a restaurant next door during the summer
months and are usually open for lunch only. Due to the topography of the land,
it would be necessary to have terraced parking in the rear and the use would be
increased from a passive one to an active business use. Mr. Mullen said that the
Board should not grant the special permit in view of the Wirtanen case regarding
two or more uses differing in use. Lucy Messer spoke in objection and said that
she did not want to see stores going in across the street. Martin Wirtanen spoke
in objection and said there would be multiple uses at the site with an increase

in traffic. Arne Ojala said that the clay nature of the soil in this are would
cause runoff water from the locus to flow onto route 6A and also to the property
. to the North. Arthur Harper spoke in objection based on the increase in traffic
congestion that would result from the proposed use.
In . rebuttal , Mr. Jones said the Board's permit could be conditioned on the number
of parking spaces they felt would be required for the three stores and the Board
of Health regulations would- be imposed on this project. The present warehouse
use could be increased, by right, which would be more objectionable than the
proposed use. The petitioners would provide three shops with perhaps a bakery
and other -types of stores that would provide an amenity to the neighborhood.
The Chairman advised that the Board would view the premises, the matter was taken
under advisement and the hearing closed.
The Board voted unanimously to allow the .petitioner a special permit for a change
of an existing warehouse use to retail stores and found that this change of use
would be in keeping with the spirit and intent of the zoning by-laws inasmuch as
this site which is now in a state of disrepair would be upgraded and landscaped.
The Board found that the change of use from a warehouse to small retail stores
would not be substantially more detrimental than the existing use and the following
restrictions are imposed on the special permit:
1 . All construction, parking spaces ,and landscaping shall be in accordance
with the plans submitted and cited as follows:
"Perspective View - Proposed Renovation, Route 6A, Barnstable, Mass."
"Landscape and Site Plan - Prepared by Catherine Wilkie - April , 1982".
2-. Outside lighting shall be subdued, shall not reflect on abutting
residential property or on route 6A, and shall not exceed 15 ft.
in height.
3. There shall be three (3) retail shops only.
4. Hours of operation shall be from 8:00 a.m. to 10:00 p.m. Monday through
Saturday with no business operation permitted on Sundays.

Gary Brennan asked about the building and what mechanisms
would prevent it from being improperly used in the future.
Chairman Bliss stated that the enforcement of the Zoning
Ordinance is the Building Commissioner's Office - he acts on
complaints filed with him.
Attorney Kirk submitted copies of se Law that Also apologizeahad

tation. to Mr. Tuttle when he referred to items as junk this has
nothing to do with the quality of items collected by Mr.
Tuttle. If he constructed the same building to house rare
works of art, he would still be present tonight. It is the
size of the building and composite of uses which are the
problem.
There is nothing wrong with the language of the Ordinance the words are terms of art and have to be applied to these
facts and in view of the facts in the area - what is
. customary in terms of an accessory building - in terms of
size and use. Ask the Board to apply the standard that the
Court amplifies.
In speaking for the Board, Chairman Bliss stated that the
Board will view the site and others in the Town. Also, he
will not be present for the next scheduled hearing of March
12, therefore, we will not make a decision until Mach 26 .
Mr. & Mrs. Tuttle will be out of Town - Chairman Bliss
stated that we will not take any further testimony - the
Board will view the site, on an individual basis, and also
the neighboring property in relation to this. Mr. Daluz
will provide a Certified Plot Plan to the Board and if
possible, in confidence, similar structures in the Town.
Attorney Kirk stated that from that aspect - discussed non-
conforming structures/new structures.
Chairman Bliss stated that the Board is aware of non-
conforming vs conforming.

The following Board members heard this petition: Gail
Nightingale, Betty Nilsson, Luke Lally, Gene Burman and
Chairman Bliss.
A Staff Report prepared by the Planning Department has been
submitted to the file.
Mr. Pinske presented his petition before the Board. He told
the Board that 14 months ago he gave a $1,000 deposit to Mr.
Klotz as a down payment to acquire the building and since
then he has acquired the necesssary financing and approval.
An approved Site Plan has also been submitted. Mr. Pinske
has appeared before the Old King's Highway District and has
been informally granted relief.
Chairman Bliss discussed the approval of the OKH. Barre
Pinske stated that there were alterations done to. the
original Plan of approval. The new Plan has been approved
informally., a copy of which has been submitted to the file
and Barre will be appearing before that Board next week.
Gail Nightingale questioned the hours of operation.
Mr. Pinske that normally a Gallery business is seasonal. He
owned a Gallery on Route 6A in East Sandwich and can say
that approximately 70 - 80% of the business was drive-by.
He had formal business hours from 9 - 6, but because he
lived there people would stop and oftentimes they would talk
with them. It is not like a normal business with posted
hours. The only time they would have evening hours is when
they would have an art opening that would be for a few
hours only - more than likely, they would be open for
business on Sundays.
Beaty Nilsson discussed the parking area - the Plans were
. reviewed. The petitioner intends to utilize stone retaining
walls and a great deal of foliage.
Betty Nilsson discussed the steep hill. Mr. Pinske will
make this the maximum grade, yet still have safety - he will
work with the hill and place walls, rocks, plants and
foliage along the area so that one can still move about
safely without removing too much soil. This Plan was
something that was recommended by the Site Plan Review Board
and since then many of his own ideas have gone by the
wayside, instead he has been encouraged to do other things
such as saving the existing dwelling. Mr. Pinske stated
that he is happy to say that he understands and appreciates
many of their ideas, although he personally would not like
to have a parking area of this size; however, with the size
of the building it is required and from what he now
understands of it, 'it seems a good idea. Initially, he
intended to have a second .floor above the garage which would

increase the square footage; however, the new Plan deleted
that so that he would not be required to have additional
parking.
Betty Nilsson commented regarding the prior petition of
1982, in which Arne Ojala stated that the clay nature of the
soil in the area would cause runoff water from the locus to
flow onto Route 6A and to the property to the north.
The Plan was discussed and the catch basins were identified
by Mr. Pinske who stated that all the water will be retained
on the property.
The petitioner stated that there will .be a paved area, and
he has contacted the DPW who told him that it is possible to
install gravel, although the steepness of the property might
not allow that. He would probably pave the area and add
sealcoating of grey stone - feel that is more attractive -
needs to be addressed. The petitioner has been in contact
with the State DPW regarding the curb cut - he has been told
that the curb cut will cost $500 and until he has his
approval/Special Permit he will not proceed with that.
The Plans and the Staff Report were reviewed by the Board.
The shingles will be colored/weathered to give the
appearance of being old - there is a process where he would
burnish the wood blacken shingles and go over with grey
stain. The existing garage has an overhead door which will
be altered with a barn door. The petitioner and the Board
discussed the existing windows.
Luke Lally informed the petitioner that he must prove the
i no -conform n ng use.
Mr. Pinske has provided the Board with a copy of the
Assessors Field Card dated 1989 indicating the warehouse
use, as required within the past five years.
Luke Lally does not believe that the Board can give approval
until several items have been established, specifically, the
curb cut, etc. , the Board must approve as Per Plan.
Mr. Pinske proposed that the Board approve the Plan as
submitted pending the acquisition of approval by the OKH and
the State DPW he has been in touch with a Mr. Broderick of
that Department regarding the curb cut - has been told it
would not be a problem - once the information and check
reaches him - he has ten days within which to respond -
should be completed by the end of the appeal process.
Mrs. Messer, who has resided in the area for 25 years
commented on the prior noise that emenated from the building
with its former use - it was terrible with noisy trucks and
motors running, etc. She also spoke on behalf of her next

door neighbor, Ms. Corsa, who is unable to be present
tonight and is also in favor.

Mr. & Mrs. Paxton, close abutters, spoke in support of the
petition and hope that the Board will grant approval to Mr.
Pinske.
Helen Wirtanen stated that she is not really speaking in
favor or against, but has heard what is said - this is an
eyesore - anything would be an improvement - have not heard
anything about change of use - would. like Mr. Pinske to
clarify what is going to be on the first floor and whether
there are two or three shops on the second floor - that is
what the Board has to decide - if he is going 'to be
subletting space, she would like an answer to that.
Melody Ojala spoke in favor of what the petitioner intends
to do - her concern is what might happen if businesswise
this does not work :- what will then happen to the property.
Chairman Bliss responded that the use established by the
Board can continue to another owner, but a change of use
would come back before the Board. If someone else came in
to run an Art Gallery, they would be able to , do that - the
building would have a Special Permit; however, if they came
in to have retail that would be a change of use and would
come back to the Board, etc.
Andarew Ojala commented that years ago a retail, store wanted
to have that use on the site '- it was rejected - he
questioned on what basis it was rejected.
Chairman Bliss responded - that with that type of use there
might be a combination of things such as parking, rapid turn
over of vehicles 2 - 3,000 one dollar purchases daily which

Mr. Daluz, The Town of Barnstable Building Commissioner,
commented regarding the Site Plan submitted and that some of
the questions from various Boards to Mr. Pinske were
addressed .by him and he has come back with the revised Plan,
and must add in his favor that it was the first time that
comments made by the Site Plan Review were addressed so
completely by the petitioner who did a lot of work to
satisfy the concerns and directives of the Site Plan
Committee. . The Site. Plan approved with three conditions -
it is conditional approval with the three recommendations as
enumerated in their letter.

It has been established that there is currently a curb cut;
however, believe the State is looking for funding which
requires the petitioner to file, etc.
Chairman Bliss commented that there is one question that was
not addressed, specifically, whether the use is going to be
retail gallery on all floors.
Mr. Pinske responded that the garage area will be his work
space, the lower level will house his personal work and the
upper level will be other artists works that he will be
marketing. There is a trend today in the art business to
allow other individual artists to place their pieces in an
area and acquire that space for a set amount of money and
not be there and have the gallery owners run the gallery and
market their works - eliminating the sales percentage. It
is difficult for artists to make money - the average artist
in America today makes $12,000 a year. Having a place to
show artists work is very important - artists have to give
up 40 - 50% to the people marketing their work because they
do their business.
Betty Nilsson questioned the proposed lighting.
Mr. Pinske will build the lights so that the sides are
shaded - will have reflected glass on the sides to direct
the light. Mr. Pinske understands the importance of being a
good neighbor - he desires to have a nice addition with the
least amount of impact.
Belen Wirtanen questioned whether there would be any lights
in the parking area, and has there been any discussion of a
sign.
There is a diagram of the proposed sign in the file.
Mr. Pinske discussed his intent regarding the lights which
he described in the paperwork - he would like to do a full-
moon of fect so that when the lights are on there will be a
full-moon illumination to provide safety, etc.
Mr. Pinske summed up his presentation by saying that he -has
worked very hard on this project. and hopes that the Board
will find in favor of his project.
GAIL NIGHTINGALE MADE THE FOLLOWING FINDINGS:
find that the. petitioner has received Site Plan Approval
with three conditions. The use is not more detrimental. It
has been established that there has been an existing non-
conforming use on the premises within the past five years.

1. I propose to change the existing garage roof from a relatively flat pitch with
the peak facing the front of the building,to a roof with a matching pitch and peak,

second story side,from an over head doors, to a tongue and grove pine sliding barn
doors.
3. I propose to change the rear of the building from the existing windows on

I Barre Pinske propose to design build and install light posts with directional low voltage lighting that is
in keeping with the Route. 6A Historic District. I intend to create a 3/4 moon illumination directed only
toward the buildings, sign,parking area and rear garden area. My specific intent is to create a'discrete
neighborhood feel with the lighting, but also provide enough illumination to provide safe movement
about the property after sunset. The exterior lights are intended to be placed on timers, which will .
automatically shut off in the latter part of the evening. The lights, on the rear corner,of the main building
and at the entry to the primary parking area, will be equipped with motion detectors.

I Barre Pinske proposed and received informal approval, of submitted sign (see copy of sign) and sign
placement,Wednesday January 8th 1992 by the Old kings Highway committee. The actual size will be
submitted for formal review in the near future. It was of unanimous decision that the size of the sign
would be determined with respect to the compositional feeling of the existing warehouse/proposed
Art Center. A request was made that I create a pattern and place it on the building for actual viewing by
the committee members. I found this request favorable and gracious considering the,strict sign size
regulations within the OKH district.

times. There were many questions the committee had that no one could
answer. Due to the date application was received December 6, 1991 it
could not be continued to next meeting of January 22, 1992, because the
forty-five day limit to act on would go over that deadline. The board
also felt it should go before the Zoning Board of Appeals first` as to
not be in violation of the ordinance. As of this writing the applicant
has applied to ZBA on January 23, 1992 for a special permit to allow a
family apartment in the existing garage. It was the boards opinion that
the proposed work is very visible from Route 149 and needed design
changes.
After reviewing the plans submitted the Committee felt the dormer on the
back is not appropriate; the triangular shaped window dormer over door
on the front of house is not appropriate; and the windows are too large
for the building.
MOTION was duly made by D_ Martin and seconded by V. Woollard that OKH
Committee DENY the application as submitted for reasons stated above.
SO VOTED UNANIMOUSLY.
INFORMAL DISCUSSION
BARRE PINSKE, 1989 OLD KING'S HWY. , RT. 6A, W_ BARNSTABLE: SIGN
Barre Pinske who has come to the OKH Committee before, asking to convert
a warehouse property to a gallery/art center with a residence and
parking. He stated he knew he had to go before the Site Plan Review
first but he was primarily looking for direction from the board on the
sign design he had created for this redevelopment of the property. He
passed out sketches of his plans on the art work of the sign and of the
landscaping ideas he has. The board felt they were very impressive. He
wanted to find out the maximum allowance of signs he could have on the
building. There was a lot of other issues discussed but it was not
pertinent . 0. Martin wondered if the eagle was seperated with a space
from the sign portion, if,°it would not be considered decoration. P.
Freeman stated that in the residential area the. sign allowance is 4
square feet (2'x2' ). He also stated that Mr. Pinske could go to Site
Plan Review with OKH blessings and that they should make their decision
quickly.
JUDY SANDERSON, RT.6A, MAIN ST. , BARNSTABLE VILLAGE: LAUNDROMAT SIGN
This matter was not planned to be discussed this meeting but the
petitioner asked to be heard. She came to observe how OKH Committee
addresses the Historic Acts. She is the owner of the Laundromat and the
little sign they have now on the building is not visible when driving
by, the park cars hide it . She wanted to know how the board felt about
a sign out front by the driveway with an arrow showing that there is a
dry cleaners/laundromat and parking in the rear. P. Freeman stated his
office is in the same building and being a tenant of same should be able
to share the :sign that is there already by combining it . He tried
brainstorming with the Committee to try and come up with ideas so not to
have mu.l.tiple signs where there are three free standing signs already

Cathy,
I have assembled,to the best of my ability,the requests of the site Plan Review Board.
The Engineer was unable to complete the requested additions and or changes on the
plan,as of this date,much to my disappointment.Hopefully I will be able to submit
them with time for review prior to next weeks meeting.
I did however complete a lighting diagram to add to the package, (comment#9), 1
hope the board will find my efforts satisfactory.Also I have submitted a sign design
and placement plan,(comment#10).The computer graphic,of the building,has the
comments of the OKH committee written on the bottom of the page.I also spoke to
them with regards to.the cottage, (comment#6). The improvements are going to be ;
done on the cottage with no change to the structure,therefor not requiring an approval.
If is my intention.to research the history and try to find pictures of the structure to
follow. At that paint I will again informally discuss the cottag�with the OKH. ,

known as the August Carlson House which existed prior to the
warehouse now being considered for a gallery/art center. The
current owners of the property, U.S. Government, were informed
that this was an historic property several months ago.

R . Stewart explained that the Committee approves the aesthetics of the
design and therefore needs the four plan elevations . D . Martin said
that , further , they need the pitch of the roof , window configurations ,
materials , etc .
P . O 'Connell said that they frequently have a hard time approving
plans based on what is submitted to them . V . Woollard suggested that
he request a similar or copy of the OKH package including the spec
sheet which supplies a lot of information . There was further
discussion as to designs being submitted, and OKH guidelines .
B . Pinske and Interior Designer Linda Hutton were present to discuss
proposed plans to convert a warehouse property to a gallery/art center
with a residence and parking . He wished ultimately to create a
cultural arts center . He primarily was looking for direction this
evening from the Committee , presented sketch designs , and said he was
open to new ideas .
The design presented raised the existing roofline and was three
stories high . V . Woollard said it would overpower anything in the
neighborhood and would make such a statement that it would not be
compatible with anything surrounding it . R . Stewart said that the
neighborhood is made up of very simple houses and both he and D .
Martin agreed that it would not fit into its surroundings .
B . Pinske told the Committee of his plans for stone walls , gardens ,
landscaping , waterfall , pond , sculpture garden , etc . It was agreed
that the parking should be moved from the front to the rear in order
that it not impact the neighborhood . Ultimately , Mr . Pinske agreed he
might be able to create parking in a stepped-up , terraced lot in the
back .
D . Martin suggested that a living space could be created on the second
floor without raising the roofline , saying that it is a big two-story ,
building as it exists and that the Committee would like to see less
impact . B . Pinske said he needed the Committee 's guidance . He said
he would be creating a cultural center on Cape Cod that would generate
attention , be interesting for young persons , and beneficial to the
Cape as a whole , both in broad terms and economic terms . He said that
creating a Cape Cod center with interesting things that people will
come to enjoy was good business .
V . Woollard suggested using a barn theme and everyone felt something
interesting could be done with that premise . Suggestions were made to
expand on that idea ( i .e . , a two-story colonnade with a colonial rail ,
breaking up the roofline , etc . ) and exploratory discussion followed .
There was also a small house in the rear which would be removed as it
had no historical significance , was in poor shape , and the space would
Lbe needed to carry out the plans .

D . Martin felt that attention would still be drawn to the building and
it would be in the feeling of early American architecture . B . Pinske
said he may go to the library , look at some books , and he felt he
could come up with something that would work very well . L . Hutton
agreed that a barn design could be very interesting to work with and
would be more modest in appearance .
ENFORCEMENT ISSUES
Letters to be sent regarding violations were reviewed prior to
mailing . R . Stewart was to advise the Secretary as to how to proceed
on Olander 's .
Myles Franklin
V . Woollard said she had spoken to B . Martin of the Building
Commissioner 's office regarding the plans approved January 23 , 1991 .
She had been by the job site and had concerns that the new windows she
had seen lying on the ground were not the windows that had been
approved . She said that at the night of the Hearing the applicant had
said they would make a grill to imitate the existing windows .
The Hearing Minutes were read aloud and it was determined that there
had been confusion at the Hearing and the Minutes were incorrect . The
Committee had meant to say 2/2 , but had said 4/4 by mistake . Also ,
the Motion in the Minutes stated that the first floor front windows
were to be approved as drawn which was 9 light when the Committee had
meant to say that they should remain the same . The Minutes would have
to be amended as they did not reflect the actual sizes approved . V .
Woollard said the Minutes should be changed to read as follows: The
front first floor windows are to be as drawn which is 9 light ( she
said that was in the Motion and that was the Committee 's mistake ) , and
all other windows ( except the rear elevation ) are to be 2/2 with
grills .
V . Woollard stated that the Committee had never approved that the
structure be ripped apart the way it has been . She said she was'
concerned as to whether the cornices had been kept that hold up the
roof and R . Stewart said no , they were building new ones . There was
discussion as to how to proceed at this point though they did not want
to have to file a Cease and Desist Order . It was decided to contact
B . Martin to provide enforcement of the project . He should also be
informed that there was a pipe on the roof that was not approved and
the Committee had not approved that the overhang and brackets be
ripped off . The Committee wants to know if and how they intend to
replace the overhang and if they have the original brackets .
MOTION was duly made by V. Woollard and seconded by R. Stewart that
the OKH Committee amend the Minutes of Myles Franklin for the Hearing
of January 23, 1991 to read ( as it was meant ) 2/2 grill wherever it
says 4/4 grill .

The premises is a 70, 000 sq. ft . parcel of land and contains
two buildings , used as a warehouse and a residence. The
applicant proposes to use the warehouse building as an art
center. The applicant specifically proposes to produce,
lisp y and sell art and related products including
paintings , graphic arts , wood and metal sculpture,
videography and photography. The applicant proposes to
restore the existing residential str.ucture.,1 which is on the

Zoning Relief Sought:
The applicant is seeking a Special Permit under Section 4-
4. 2 of the Zoning Ordinance, for the change of the existing
non-conforming use of warehouse to another non-conforming
use as an ar �.n_ er..
Background:
In 1982, the Board granted a Special Permit to Matthew &
Joanne Cavallini , change of non-conforming warehouse storage
use to retail use subject to four conditions (see attached) .
Staff Comments :
Pursuant to Section 4-4 . 2 any proposed change of a non-
conforming use to another non-conforming use only shall be
allowed if the proposj change is no more objectionable or
ubsts��i !a 1 1 do to them and a Special
record, the warehouse contains 6,6 _is__c�, of floor area
and the residential structure contains 736 sq.ft. of living
area.
A site plan of the premises entitled" Site Plan of land in
West Barnstable, MA II , revised dated 1 /23/92 , prepared by
down Cape Engineering, submitted by the applicant, shows two
buildings and parking for 24 vehicles . This site plan was
reviewed and found approvable by the Site Plan Review
Committee on 1/23/92.
Summary:
The applicant should be required to document or establish
the pre-existing legal non-conforming use of the building as
a warehouse, which justifies the relief being sought. If the
Board finds that the request for a Special Permit 1s
appropriate then the Board should consider the following:
1 . that the applicant shall obtain necessary approval
from the Old King"s Highway Historic District Committee
with respect to proposed renovation to both buildings .
2 . That the applicant obtain a curb cut permit from the
Massachusetts Department of Public Works .
