At this point in time, staff has not received any official, authorization from the,property,owner to file,an appeal with the`Zoning Board of Appeals. Staff:suggests the applicant provide a letter from the property owner in order to'show standing before the Board: Background: The property that is the subject of this appeal is the IHOP restaurant located in the Capetown Plaza. The site is located in an HB Highway Business Zoning District. In August of 1998, the applicant had the original sign face replaced after it had fallen into disrepair. The new sign is the same as the old sign with respect to the size and height. Only the color and wording of the sign face has changed. According to the application, the applicant was unaware that a sign permit was required for the replacement of the original sign. The applicant was notified by the Town's Building Department that a permit was required. When the applicant applied for a sign=permit on August 21, 1998, he was denied by the Building Commissioner. The Town's sign regulations only permit a maximum height of 12 feet for free-standing signs in HB Districts and no more than 50 square feet(half the total allowable sign area of 100 square feet). Section 4-3.24(2)of the sign regulations requires conformance to the new standards on a building or a lot where one or more illegal or nonconforming signs exist for any proposed new sign. The existing sign is approximately 23'4" in height and approximately 94 sq. ft. in area, and, according to the submitted materials,was originally erected in 1973. The current sign regulations were adopted in 1985 (ATM 11/2/85, Art. A-1). The applicant is seeking a Variance to Section 4-3.7(2), Section 4-3.7(4)and Section 4-3.24(2)of the sign regulations in order to legitimize the existing free-standing sign,which exceeds the allowable height and size. Staff suggests the applicant provide the Board with the square footage of this sign. Variance Findings: In consideration for the Variance, the petitioner must substantiate those conditions unique to this lot that justify the granting of the relief being sought. In granting of the Variance the Board must find that: • unique conditions exist that affect the locus but not the zoning district in which it is located, • a literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise to the petitioner, and • the relief may be granted without substantial detriment to the public.good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Suggested Conditions: If the Board should find to grant the requested Variance, they may wish to consider the following conditions`. 1. (IHOP) APPLICATION FOR VARIANCE The Petitioner, KNC Industries, Inc. (IHOP) files this Memorandum in support of its application for a variance to Section 4-3.7(2), 4.3-7(4) and 4-3.24(2) of the Town of Barnstable Zoning Ordinances. FACTS The Petitioner is KNC Industries, Inc. (IHOP) through its principal, Karl Bueller. The Petitioner's address is Capetown Plaza, Route 132, Hyannis, Massachusetts, where it is shown on the Town of Barnstable Assessor's Map 311 as Parcel 092. The property lies in a HB Zoning District. The present use of the premises is as a restaurant open to the.public and-which is known as the INTERNATIONAL HOUSE OF PANCAKES. . BACKGROUND In August of 1998,the Petitioner contracted with Saxton Sign Corp.of East Greenbush,New York to replace the existing sign with a new one of similar size and height since the original sign had fallen into disrepair. Unbeknownst to the Petitioner, a sign permit is required by the Town of Barnstable in order to replace the original sign. The Town of Barnstable thereafter notified the Petitioner of the sign permit requirement,and the Petitioner filed an application for such permit on August 21, 1998. The permit was denied by the Building Inspector. The Petitioner now applies for a variance to Sections 4-3.7(2),4=3.7(4)and 4-3.24(2)of the Town of Barnstable Zoning Ordinances. ARGUMENT The replaced sign was originally erected in 1973. The size of that sign as set forth in the invoice (attached as Exhibit "A") was eight feet by eleven feet and stood approximately twenty- three feet above the ground. The inscription on the replaced sign read "International House of Pancakes Restaurant". The dimensions on the new sign are also approximately eight feet by eleven feet with a new height being also approximately twenty-three feet above ground level. The wording now reads "IHOP Restaurant". (See attached Exhibit"B"). With regard to the area requirements, a plan of the front of the building is attached for your review. (See Exhibit"C"). Based on this plan,the area of the building front exceeds 1,000 square feet. Given the measurements of the new sign, the square footage of the sign would be in compliance with Section 4-3.7(3) (except for the provisions of Section 4-3.7(4)) since the square footage of the new sign is approximately 88 square feet. The replacement sign is the same height and size as the original with the only change being in its color and wording. Under.M.G.L. Chapter'40A,Section 10,`;the permit granting'authority must find that"owing ao circumstances relating to the soil conditions,shape or-topography of such Jand or structures a literal enforcement of the provisions of the ordinance or by-law would'involve substantial hardship; financial or otherwise, to the,Petitioner : 'and .that desirable relief may..be granted.without-- substantial detrimentto the,public good and without nullifying or substantially derogating from the intent or purpose of such ordinance or by-law:"; Y,. A. Height of Sign. The sign at issue stands higher than the ten foot(twelve if permitted) limitation proscribed by the Ordinance. The land on which the Applicant's premises sits is approximately six to ten feet above the street level and there is a steep embankment from the position of the base of the sign to the street level. In addition,the street(Route 132)begins a slow but steady climb from Airport Road to the west of the premises to a point beyond the premises where the traffic lights allow entrance to both the Cape Cod Mall and the Capetown Plaza. (See Sit Map attached as Exhibit"D"). The unusual topography has created a situation under which a sign which complies with the height requirements of the Town of Barnstable Zoning Ordinances (10 feet)would barely be visible to persons in automobiles coming from the west towards Hyannis on Route 132. An even more serious predicament arises for those traveling from the east away from Hyannis since there are other signs and shrubbery at the main entrance to the Capetown Plaza and also one additional free A standing building which would limit the visibility of a sign which complied with the Ordinances. Furthermore, to limit the size of the sign to one-half of the size allowed under Section 4-3.7(4) would reduce the size of the sign to such an extent as to make it barely visible given the topographical complexities of the area. Finally,since the new sign is substantially the same size and height of the replaced sign,the only difference being in some coloration and the wording on the sign, a variance allowing the new sign, if granted,would not result in a detriment to the public good and Would not substantially derogate from the intent or purpose of the Ordinance. It is quite similar to the sign which has existed for years in the same location. On the other hand,a literal enforcement ofthe provisions of the Ordinance,given the location of the Petitioners premises and the unusual topography, would result in substantial hardship to the Petitioner since it would result in the sign being substantially unseen from Route 132 and therefore of no benefit to the Petitioner in attracting members of the public to its place of business. Kline, is an architect engaged by the tenant to develop the proposed project and to file this appeal. The tenant, Boater's World, is intending to lease the property from Cape Harbour Associates. At this point in time, staff has not received any official authorization from the property owner, Cape Harbour Associates, to file an appeal with the Zoning Board of Appeals. Staff suggests the petitioner submit a letter from the property owner to show standing before the Board. Background: The property that is the subject of this appeal is a 5,000 square foot store located in the Capetown Mall. This commercial space is currently vacant and is located within an HB Highway Business Zoning District. The applicant wishes to erect two wall signs, one on the front and one on the rear of the building, which would exceed the number of signs and the maximum square footage allowed for this business. The Zoning Ordinance allows one wall sign of 50 square feet. 9 q The applicant Is requesting two wall signs with a total of 100 sq. ft. Section 4-3.7(3)of the Zoning Ordinance states"The total square footage for all signs of each business shall not exceed ten percent(10%)of the area of the building wall facing a public way or one hundred (100)square feet, whichever is the lesser amount." Section 4-3.4 Determination of Area further states "the area of a building face or wall shall be calculated by using a height of no more than ten feet(10')from the ground multiplied by the width of the building front." The space Boater's World is proposing to lease has approximately 50 feet of building frontage, which allows a 50 sq. ft. sign. Section 4-3.7(8) only permits each business one wall sign when two or more businesses are located on a single lot. Any increase in the number of signs or the square footage above this amount must have an approved variance from the Zoning Board of Appeals. Staff Review: The applicant is proposing a wall sign of 30 sq. ft. on the front of the building and a wall sign of 70 sq. ft. on the rear of the building (see attached plan). The petitioner's application states that a 15 sq. ft. wall sign is being proposed for the front of the building. However, the submitted plan shows that the applicant is proposing to replace only the face of the existing sign box, which is 30 sq. ft. in area. Section 4-3.4(2) states"The area of signs painted upon or applied to a building shall include all lettering, wording and Town of Barnstable-Planning Department-Staff Report Appeal No. 1998-66-Kline Variance-Section 4-3.7-Signs in Highway Business Districts accompanying designs or symbols together with any background of a different color than the finish material or the building face." When individual letters are attached to a building wall, the area then becomes the smallest rectangle which encompasses all of the letters. The application states that a minimum of two signs is needed due to the location of the building within the shopping center site. The front of the building faces internally and the rear of the building faces lyannough Road (Route 132). In order for customers to locate the store from Route 132 and then locate the store's entrance from the parking lot, two signs are needed. The applicant has further stated that the height of the lettering being proposed is the minimum height that can be clearly seen from passing motorists on Route 132 or from the parking lot. There are two other businesses located in this same building, a 7,500 square foot medical clinic and a 6,000 sq. ft. home and fabric center. These businesses both have a wall sign on the front of the building and one on the rear of the building, as the applicant is proposing. It appears that the previous tenant of the store the applicant is intending to lease also had two signs. A review of ZBA records shows no variance ever having been approved for these signs. But they may be legal nonconforming signs. In 1990, the Board did approve a variance(Appeal No. 1990-48)for a 190 square foot wall sign for Filene's Basement. The Board found that the topography and intervening buildings obstructed lines of sight from Rt. 132. More recently, the Board approved a variance(Appeal No. 1996-20)allowing a total signage of 170 square feet for Tweeters. The Board found that the topography and store frontage of the building were unique circumstances justifying the additional square footage. Variance: In consideration for the Variance, the applicant must substantiate those conditions unique to this lot that justify the granting of the relief being sought. In granting of the Variance the Board must find that: • unique conditions exist that affect the locus but not the zoning district in which it is located, • a literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise to the petitioner, and • the relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance.
