A review of that documentation revealed that the original sign was limited to a height not to exceed 21'. The sign was approved by the Board of Selectmen on January 25, 1973. This approval also identified expressed dimensions and limited its height to no more than 21' in total. As the present sign appears to comfortably exceed that restriction; it will be necessary for you to provide us with a graphic reflecting accurate measurements of the existing sign as well as a copy of the governing instrument that allowed it to be constructed in its current fashion. Additional Background: During recent.staff research (January 20, 1998)into past business uses at Cape Town Plaza, the ' staff found information that may be of relevance to the sign variance being requested by K-Mart in Appeal No. 1998-13. It appears some signage relief was issued to K-Mart on January 25, 1973 (see attached decision). This relief was issued by the Selectman as related to an appeal of the Building Commissioner under the Building Code of the time. In 1973, the Zoning Bylaw and Building Code were published together. The relief granted was apparently guided by Article.IV, Chapter III, -the Building Code Section I, Clause i, that read: "Any person aggrieved by a decision of the Building Inspectormay appeal_.to a Board consisting of the Selectman and Fire Chief.... Itis: located in an HB Highway Business Zoning District. The applicant wishes to replace the existing K-Mary Logo sign with a new Logo sign which exceeds the size limit allowed by the Zoning Ordinance. Section 4-3.7(3) of the Zoning Ordinance states"The total square footage for all signs,of each business shall not exceed ten percent(10%) of the area of the building wall facing a public way or one hundred (100) square feet,.whichever is the lesser amount. Section 4-3.4 Determination of Area further states "the area of a building face or wall shall be calculated by using a height of no more than ten feet(10') from the ground multiplied by the width of the building front." Any increase in square footage above this amount.. must have an approved variance from the Zoning Board of Appeals. Standing: The applicant has submitted,a statement from'K-Mart(the lessee of this property)authorizing Cummings Signs and their agent,Callahan Sign Co.,to 'represent K-Mart at the Zoning Board of Appeal's hearing. At this point in time, however, the staff.has not received any official authorization from the'property owner, Barnstable Municipal Airport Commission, to file,an appeal with the Zoning Board of Appeals. Town of Barnstable Planning Department-Staff Report Appeal No..1998-13-K-Mart Variance-Section 4-3.7(3)-Signs in Highway Business District The proposed wall sign would be approximately 416 square feet in area. This is significantly larger than what is currently there or what is permitted under the ordinance. This size is also significantly larger than most signage that has been permitted by variances granted. The 416 square feet does not include the area of the existing signs currently at this site. There are now 4 wall signs on the subject build' an 1 freestanding sign at the entrance to the mall which total approx e y are feet. Total signage for K Mart with the proposed new sign would be approximately 570 square feet. The proposed new logo sign would be out of character with the other business signs within the Capetown Mall. It is significantly larger than any of the other signs at this location. In 1990, the Board did approve a variance (Appeal No. 1990-48) for a 190 square foot wall sign for Filene's Basement. The Board found that the topography and intervening buildings obstructed lines of sight from Rt. 132. More recently, the Board approved a variance (Appeal No. 1996-20) allowing a total signage of 170 square feet for Tweeters.. The Board found that the topography and store frontage of the building were unique circumstances justifying the additional square footage. These same conditions do not appear to exist for the K-Mart location. There is a direct line of sight to the K-Mart store from Rt. 132. If the.Board is inclined to grant relief to the petitioner, staff would recommend that the proposed new sign not exceed 190 square feet in area. This would allow for a larger sign than currently exists but would limit the size so as not to exceed any of the existing signs.in the Capetown Mall. Section4-3.7(3)of the Zoning Ordinance states"The total square footage for all signs of each business shall not exceed ten percent(10%) of the area of the building wall facing a public way,or bne hundred (100) square feet,:whichever is the lesser amount." Section 4-3.4 Determination of Area further states "the area of a building face or wall shall be calculated by using a height of no more than ten feet(10') from the ground multiplied by the width of the building front.". Any increase in square footage above this amount must have an approved variance from the Zoning Board of Appeals..'. .Standing: . The applicant has submitted a statement from K-Mart(the lessee of this property) authorizing Cummings Signs and,their agent, Callahan Sign Co., to represent K-Mart at the Zoning Board of Appeal's hearing. 'At this point in time, however, the staff has not received any official authorization from the property owner, Barnstable Municipal Airport Commission, to file an appeal with the Zoning Board of Appeals. Variance: In consideration for the Variance, the applicant must substantiate those conditions unique to this lot that justify the granting of the relief being sought. In granting of the Variance the Board must find that: • unique conditions exist that affect the locus but not the zoning district in which it is located, • a literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise to the petitioner, and •` the relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. i Staff Review: Town of Barnstable- Planning Department-Staff Report Appeal No. 1998-13-K-Mart Variance-Section 4-3.7(3)-Signs in Highway Business District The proposed wall sign would be approximately 416 square feet in area. This is significantly larger than what is currently there or what is permitted under the ordinance. This size is also significantly larger than most signage that has been permitted by variances'granted. The 416 square feet does not include the area of the existing signs currently at this site. There are now 4 wall signs on the subject buildin an 1 freestanding sign at the entrance to the mail which total approxl e y are feet. Total signage for K Mart with the proposed new sign would be approximately 570 square feet. The proposed new logo sign would be out of character with the other business signs within the Capetown Mall. It is significantly larger than any of the other signs at this location. In 1990, the Board did approve a variance (Appeal No. 1990-48) for a 190 square foot wall sign for Filene's Basement. The Board found that the topography and intervening buildings obstructed lines of sight from Rt. 132. More recently, the Board approved a variance (Appeal No. 1996-20) allowing a total signage of 170 square feet for Tweeters.. The Board found that the topography and store frontage of the building were unique circumstances justifying the additional square footage. These same conditions do not appear to exist for the K-Mart location. There is a direct line of sight to the K-Mart store from Rt. 132. If the Board is inclined to grant relief to the petitioner, staff would recommend that the proposed new sign not exceed 190 square feet in area. This would allow for a larger sign than currently exists but would limit the size so as not to exceed any of the existing signs in the Capetown Mall.
