It is located in an HB Highway Business Zoning District. The applicant wishes to replace the existing K-Mart Logo sign with a new Logo sign which exceeds the size limit allowed by the Zoning Ordinance. Section 4-3.7(3)of the Zoning Ordinance states"The total square footage for all signs of each business shall not exceed ten percent(10%) of the area of the building wall facing a public way or one hundred (100) square feet, whichever is the lesser amount." Section 4-3.4 Determination of Area further states "the area of a building face or wall shall be calculated by using a height of no more than ten feet(10')from the ground multiplied by the width of the building front." Any increase in square footage above this amount must have an approved variance from the Zoning Board of Appeals. Standing: The applicant has submitted a statement from K-Mart(the lessee of this property) authorizing Cummings Signs and their agent, Callahan Sign Co., to represent K-Mart at the Zoning Board of Appeal's hearing. At this point in time, however, the staff has not,received any official authorization from the property owner, Barnstable Municipal Airport Commission, to file an appeal with the Zoning Board of Appeals. Variance: In consideration for the Variance, the applicant must substantiate those conditions unique to this lot that justify the granting of the relief being sought. In granting of the Variance the Board must find that: • unique conditions exist that affect the locus but not the zoning district in which it is located, • a literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise to the petitioner, and • the relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Staff Review: Town of Barnstable-Planning Department-Staff Report Appeal No. 1998-13-K-Mart Variance-Section 4-3.7(3)-Signs in Highway Business District The proposed wall sign would be approximately 416 square feet in area. This is significantly larger than what is currently there or what is permitted under the ordinance. This size is also significantly larger than most signage that has been permitted by variances granted. The 416 square feet does not include the area of the existing signs currently at this site. There are now 4 wall si ns on the subject buil ' an 1 freestanding sign at the entrance to the mall which total approx e y are eet. Total signage for K=Mart with the proposed new sign would be approximately 570 square feet. The proposed new logo sign would be out of character with the other business signs within the Capetown Mall. It is significantly larger than any of the other signs at this location. In 1990, the Board did approve a variance(Appeal No. 1990-48)for a 190 square foot wall sign for Filene's Basement. The Board found that the topography and intervening buildings obstructed lines of sight from Rt. 132. More recently, the Board approved a variance (Appeal No. 1996-20) allowing a total signage of 170 square feet for Tweeters.. The Board found that the topographyand store frontage of the building were unique circumstances g g q justifying the additional square footage. These same conditions do not appear to exist for the K-Mart location. There is a direct line of sight to the K-Mart store from Rt. 132. If the Board is inclined to grant relief to the petitioner, staff would recommend that the proposed new sign not exceed 190 square feet in area. This would allow for a larger sign than currently exists but would limit the size so as not to exceed any of the existing signs in the Capetown Mall. On ................February...6. ................................................................. 19 ...86........, The Board of Appeals found Mr. Behan, President of Proper Identification, presented the petition for variance relief - requesting a sign of 37.5 square feet to replace the existing one of 24 square feet on a store front 15'3 x 25' located in the K'Mart Plaza at Route 132, Hyannis in a Highway Business zoning district. Mr. Behan indicated that there is a hardship as the store is not visible from the road due to its placement in the parking lot - and the existing signs in the area are all larger. Section 3 (e) of the new Sign Code says that for the purpose of the regulations, the area Of-the building facing the wall should be calculated by using the height of, no more than ten feet (10) multiplied from the ground by the width of the building front. At this time, the petitioner has a conforming sign, if the sign were 37.5' he would have a non-conforming sign, and under the new by-law he would have 24 months to keep the sign - he would then need a new sign - under the proposed by-law, all signs of that size will have to be reduced during a two-year period. If the petitioner is granted relief under the new by-law, he would have a variance that goes with the land - all signs in this area would be smaller - he would then become non-conforming with everyone else. It is the interpretation of the Board, that these signs will all have to come down from- above the roof line, in two-years time. The Attorney General has not signed the new code; however, it has been approximately three months since the sign code has been passed and we know of no litigation pending in Superior Court seeking review of Town action. Chairman, Luke Lally, made a motion to deny the relief requested - seconded and amended by Ronald Jansson -to allow the petition relief would not be consistent with the new zoning by-law. James McGrath, Gail Nightingale, Ronald Jansson and Luke Lally all voted to deny the variance relief because to allow this would be creating an illegal situation - we would be fostering something that might possibly be unenforceable by the Building CaTmissioner - to allow this would defeat the purpose of the sign code. Richard Boy abstained from voting on the petition. The petition is denied with four negative votes of a five-member Board of Appeals. v C SS - ........................ A review.-of the tenants presently committed at the center indicates that this requirement would be satisfactory for all satellite tenants. It is our intention to restrict the satellite tenants who take less than 4 ,000 sq. ft: of total area to the Exhibit "F-3" indicating a box sign not to exceed 3' at height as per the copy of Exhibit "F" that I have left with you and Mr. Green, and not to exceed a total of 100 sq. ft. per sign to comply with the ordinance. With reference to the K mart facia signs, this restriction does impose a problem. The main K mart sign in the front canopy as per the attached drawings indicates a total of 221 sq. ft. The electrical characteristics of all of the signs are shown on the details being provided you. Electrical connections between the outlets furnished by the Landlord and the individual sign letters will be made by our Electrical Contractor. The K mart and Auto Signs should be located as per the elevation drawing. Electrical outlets required for these signs should be provided in the exact location shown on the details for the signs . Proper structural support behind all of the K tart sign letters are the responsibility of the Landlord. We require that you indicate on the working drawings, the location of these structural members, as well as the location of the electrical outlets. Our Sign Contractor will provide the necessary bolts and will do all necessary drilling in order to accomplish a complete installation. Provision should be made for the structural support of the Garden Shop Sign, which will be 22'-0" long. This support should be shown on your working drawings. A properly located electrical outlet should be .provided also. This work should .be detailed as per information shown on our Typical drawings. Our Sign Contractor will also erect this sign. A 2'-6" high Auto Center Sign will be located above the entrances to that department, as per our elevation drawing. It is the responsibility of the Landlord to furnish the necessary electrical outlets and our Sign Contractor will do all necessary drilling and furnish toggle or expansion bolts, as required for making the .complete installation.
