RV parked on side of El Rodeo Restaurant is occupied by Rhawn DePriest(850-973-7266) and his wife
Natasha. Mr DePriest's mother lives in the Cape Crossroads Condos across the street. He indicated to
Donna(Health)that he works at El Rodeo. Previously, Donna found him on state property at the Burger
King site on the highway. Our files indicate that Aspen Dental has complained about him parking
overnight near their facility. Officer Gallant encountered him during the summer at the Festival Plaza and
advised him to relocate his RV to another site.

Subject: Festival Plaza 107o lyannough Rd Hyannis Ma
I am writing to make you aware of a potential liability issue to you concerning one of your properties located in Hyannis,
MA and known as the Festival Plaza. Since last year,we have been struggling with a homeless couple that resides in an
RV on Festival Plaza property.
Aspen Dental complained about this last summer. In fact, Barnstable Police Officer Therese Gallant reached out to Pat
Kinsella (203-524-9401/516-869-7161) regarding this matter on numerous occasions but ultimately received no
response at all. Currently,the occupants have been parking the RV behind the landscape screen next to the El Rodeo
Restaurant (near the rear site exit/entrance). The occupant, Rhawn D.ePriest is said to be an employee of the restaurant.
Obviously, the plaza is reserved for commercial uses and therefore any other use would not be allowed as a matter of
right. Unauthorized and continued use without official approval may be subject to fines and/or injunctive relief. In
addition,the fact that the occupants of the RV do not have all of the amenities required of single-family living under the
Mass State Sanitary code is another violation and shall be addressed by the Health Division. These violations are also
deemed to be the responsibility of the property owner. With this in mind, I seek your assistance in rectifying this matter
and notifying El Rodeo and DePriest to cease and desist residing or parking on the Festival Plaza property overnight.

Hi Robin: I interacted with RHAWN DePRIEST on Friday,Jan. 3, 2020 at the Commuter Parking Lot in West
Barnstable. He has his RV parked up there with a broken tire. Last inspection for it was July 2014. It was moved from
parking lot by the morning of January 7, 2020.
Hi cell number is 850-973-7266.
He came to the site with his wife Natasha in a black Honda EX: License plate number is 9MB-281.
He informed me that he was having the tire fixed and-moving it to his mother's address at Cape Crossroads or he
mentioned that sometimes his employer, El Rodeo, lets him park it out back there on the property.

1/30/2020 andersor Spoke to Pat Kinsella 1/30/2020. Advised him that according to reports and
our current knowledge,the RV never left the site and they are not in
compliance. He stated he would call the PD today and arrange to have unit
towed. I advised him to let me know of his actions and plans as I have no
way to demonstrate his compliance and it certainly appears that he is not
cooperating unless he shares that information with me. He indicated that he

Chapter 240. Zoning
Article VII. Sign Regulations
§ 240-61 . Prohibited signs.
The following signs shall be expressly prohibited in all zoning districts,
contrary provisions of this chapter notwithstanding:
A. Any sign, all or any portion of which is'set in motion by movement,
including pennants,, banners or flags, with the exception of trade
flags pursuant to § 240-72 and at the entrance to subdivisions where
developed and undeveloped lots are offered for initial sale and
official flags of nations or administrative or political subdivisions
thereof.
[Amended 6-17-2010 by Order No. 2010-123; 5-5-2011 by Order No.
2011-046; 5-5-2011 by Order No. 2011-047]
B. Any sign which incorporates any flashing, moving or intermittent
lighting. Such signs include LED (light emitting diode) signs; LED
border tube signs, including any sign that incorporates or consists
solely of a LED border tube lighting system; and simulated neon
signs which are extremely bright backlit signs using fluorescent
lamps and neon colored inks or translucent vinyl for lettering and
display.

C. Any display Iighting .by strings or tubes of lights, including lights
which outline any part of-a building or which are affixed to any
ornamental portion thereof, except that temporary traditional holiday
decorations of strings 'of small lights shall be permitted between
November 15 and January 15 of the following year. -Such temporary
holiday lighting shall be removed by January 15.
D., Any sign-which contains the words "Danger" or "Stop" or otherwise
presents or implies*the need or requirement of stopping or caution,
or which is an imitation of, or is likely to be'confused with any sign
customarily displayed by a public authority.
E. Any sign which infringes upon the, area necessary for visibility on
corner lots.

F. Any sign which obstructs any window, door, fire escape, stairway,
ladder or other opening intended to provide light, air or egress from
any building.
G. Any sign or lighting which casts direct light or glare upon any
property in a residential or professional residential district.
H. Any portable sign, with the exception of a location hardship sign in-
the HVB, including any sign displayed on a stored vehicle, except for
temporary political signs.

I. Any sign which obstructs the reasonable visibility of or otherwise
distracts attention from a sign maintained by a public authority.
J. Any. sign or sign structure involving the use of motion pictures or
projected ph-otographic scenes or images.
Any sign attached to public or private utility poles, trees, signs or
other appurtenances located within the right-of-way of a public way.
L. A sign painted upon or otherwise applied directly to the surface of a
roof.
M. Signs advertising products, sales, events or activities which are
tacked, painted or otherwise attached to poles, benches, barrels,
buildings, traffic signal boxes, posts, trees, sidewalks, curbs, rocks
and windows regardless of construction or application, except as
otherwise specifically provided for herein.
N. Signs on or over Town property, except as authorized by the
Building Commissioner for temporary signs for nonprofit, .civic,
educational, charitable and municipal agencies.
O. Signs that will obstruct the visibility of another sign which has the
required permits and is otherwise in compliance with this chapter.
P. Off-premises signs except for business area signs as otherwise
provided for herein.
Q. Any sign, picture, publication, display of"explicit graphics or language
or other advertising which is distinguished 'or characterized by,
emphasis depicting or describing sexual conductor sexual activity
as defined in MGL Ch. 272, § 31 , displayed in windows, or upon any
building, or visible from 'sidewalks, walkways, the air, roads,
highways, or a public area.

Dear Mr. Huerta:
The Licensing Authority held an advertised show cause hearing, on November 16, 2015 for
Hyannis El Rodeo;LLC, d/b/a El Rodeo, Raul Huerta, Manager, 1070 lyannough Road;Hyannis_
for the following violation of the Town of Barnstable, MA Code:
• 501-7 Section I. Alcoholic beverages sales and laws: for the sale or delivery of an
alcoholic beverage to a person under 21 years of age. x
After testimony from Consumer Affairs Officer Steven Estey, the following motions were voted
3-0 by the Licensing Authority:
• FINDINGS: To move that the Licensing Authority determine violation of Section §
501-71 of the Barnstable Licensing Authority Rules and Regulations was found;
• VERDICT: To move that the Licensing Authority find El Rodeo located at 1070
lyannough Road, Hyannis guilty in violating Section § 501-71 of the Barnstable
Licensing Authority Rules and Regulations;
• ACTION: To move that the Licensing Authority suspend the Annual All Alcohol
Common Victualler License, the Common Victualler and Entertainment Licenses
for 2 days: of which you will serve a one day suspension on January 30th, 2016
and have one day suspension held in abeyance for one year from date of this
hearing.
The licensee has the right to -appeal this decision of the : Licensing Authority to the
Commonwealth of Massachusetts Alcoholic Beverages Control Commission within five (5) days
of receipt of this decision as to the Alcohol License and the Barnstable Superior Court within 60
days of receipt of this decision related to the Common Victualler and Entertainment licenses.
