This submittal contains an Application for Jurisdictional Determination and an Application for Exemption pursuant to Section 12 of the Cape Cod Commission Act (the "Act"). The Applicant reserves the right to submit additional memoranda, evidence and documentation in support of the respective applications prior to and concurrent with hearings by the Cape Cod Commission or subcommittees thereof: BACKGROUND The Festival at Hyannis-is a multi-use shopping center facility consisting of 204,987 square feet, which was constructed in 1989. The original construction included a septic qP system, together with completed infrastructure to allow for connection.to town sewer upon its availability to the center. Following the completion of construction, portions of the project have been leased to several anchor tenants, including Purity Supreme Supermarkets, Toys 'R Us and Highland. Smaller retail tenants including Block Buster Video, Pier One Imports, Paperama, The Golf Market,-Hit or Miss, Bed & Bath, Ben Franklin Craft Store, Payless Shoesource and Nynex. In October of 1990, the shopping center was purchased by a trust, the beneficiary of which is the Estate of James Campbell of Honolulu, Hawaii. Since the purchase; eight tenants have terminated leases and/or vacated the premises, including Walgreen's Pharmacy, t • which leased 11,385 square feet which was vacated on or about September, 1993. In August of 1994, the owner filed an application to allow for immediate connection with the . Town of Barnstable sewer system, which was recently constructed along Route 132. THE PROPERTY The property is located off of Route 132 in the Village of Hyannis, and is shown on Land Court Plan 24921-H as Lots 18 and 19. The location of the Property is shown on the locus plan attached as Exhibit A. The property is located almost entirely in the Business (B) zoning district of the Town of Barnstable, with the exception of a small portion of.the entrance which is located in the Highway Business (HB) Zone. The shopping center consists of a series of buildings and ancillary roadways and parking, as shown on the Site Plan Exhibit A . A copy of the Barnstable Assessor's.Map and list of abutters is attached • as Exhibit B. THE PROTECT The Estate of James Campbell proposes to lease 11,385 square feet of vacant space (the "Project Space"), previously leased by Walgreen's Pharmacy to Buffets, Inc. d/b/a Old County Buffet. The project will consist-of renovation' of a portion shopping center space entirely within the existing footprint and building shell constructed at the time of the original development of the shopping center. The project space is shown on Exhibit C, and on the Site Plan. Attached as Exhibit D is a copy of the Project plans. The restaurant will consist of a sit down, full service buffet-style restaurant with 402 seats. The restaurant will have approximately 20 full-time year round employees. A diagram of the proposed internal configuration of the Project Space is attached as Exhibit 3 - E. The Project Space is located within the Business Zoning District and is an entirely permitted use under the Barnstable Zoning Ordinance without the.requirement of either Special Permit or Variance. The proposed restaurant will operate 7 days a week and will •serve lunch and dinner only.' No alcoholic beverages will be served and no liquor license will be sought. The normal hours of operation are'11:00 A.M. to 8:30 P.M.. LOCAL PERMITTING Renovation of the existing space will occur within the Town of Barnstable, and will, therefore, be governed by the Town of Barnstable Zoning Ordinances. . An Application for Site Plan Review is concurrently being filed with the Town of Barnstable. With the exception of Site Plan Review Approval and the issuance of a Building Permit, no r permits will be required for this renovation project. , STATEMENT OF REASONS IN SUPPORT OF REQUEST FOR JURISDICTIONAL DETERMINATION INTRODUCTION Section 12(c)(6) of the Act states that "use changes which have a floor area greater than 10,000 square feet" shall be presumed to be Developments. of Regional Impact under. the Cape Cod Commission Act. The Building Commissioner of the Town of Barnstable has indicated that the proposed renovation may constitute a change of use based upon the application of the definition of "intensification of use" as contained.in,Section 7 of the Barnstable Zoning Ordinance, which is based upon an interpretation of parking demand. The Cape Cod Commission has promulgated a policy definition for change of use which establishes different criteria for determining what constitutes a change of use within the meaning of the Act. These include: 1. Whether there is a difference, in relation to the resources protected by the Regional Policy Plan and the Cape Cod Commission Act, between the proposed use and the use and existence immediately prior to the proposed use. Such a determination may be based upon, but is not limited to the following: A. The nature and purpose of the use; B. The quality or'character of the use; C. A material change in the use or�appearance of any structure or in the land; or D. Any change in the intensity of the land itself, such as an increase in the number of dwelling units in a structure or a change to a commercial or industrial use to a less intensive use; 2. Whether the proposed use results in different or increased impacts from the immediately prior use in relation to its effect on the resources protected by • the Cape Cod Commission Act and/or the Regional Policy Plan. 3. In cases where prior use has been discontinued for a period of time greater than five (5) years the,Commission will presume that any use of the premises is considered a change of use Section 120) of the Cape Cod Commission Act provides that an applicant may apply to the Commission for.a Jurisdictional Determination as to whether a development is e a Development of Regional Impact under the applicable standards and criteria established in Section 12 of the Act. An application of the Cape.Cod Commission's definition of change of use set forth above results in the conclusion that the proposed renovation of existing vacant-shopping center space as a restaurant in this location is not a change of use. As described more specifically herein, at the time of its construction, the Festival at Hyannis Shopping Center • contemplated potential utilization of its commercial space for a restaurant and other ancillary forms of use which would be permitted upon connection of the premises to town sewer. In point of fact; the underground infrastructure to allow for connection to the sewer was constructed and put in place in 1989, at the time of original construction. Further, the use of the existing space as a restaurant is a permitted use under Section 3-3.1 of the Barnstable Zoning By-Law, was a permitted use at the time of construction of the shopping center, and was clearly contemplated at the time of the original development. A review of the large commercial shopping centers in the mid-cape area confirms that restaurant facilities are an intricate part of the use of land for commercial shopping centers. The nature, purpose, quality and character of the use of the Project Space for renovation and lease as a restaurant facility is entirely consistent with the use of the • premises as a shopping center. Simply put, the premises were previously utilized as a shopping center, and will continue to-be utilized as a shopping center. More importantly, there will be no material change in use or appearance of any structure or in the land. The footprint of the building will.remain unchanged, and with the exception of signage and minor architectural changes, there will be no change in appearance whatsoever. "Also, as discussed more specifically"below,`there will be no need to construct any additional parking spaces, in that existing parking substantially,exceeds that required by the proposed renovations. There will.be 'no increase in-the number of units or a change to a commercial or industrial use from a less•intense use, nor enlargement of a structure or additions to useable interior floor area, norr the, conversion of a seasonal use to a.year round use. See definition of "redevelopment" Regional Polio - Page 11.. - 6 - It is not anticipated that there will be any difference or increase`in impacts in relation to effects on resources protected by the Act or by the Regional Policy Plan. There will be no change in lot coverage, zoning use, parking or appearance. The property will be connected to town sewer, which will result in substantial benefits and improvements in the ground water quality. With regard to traffic, as discussed more specifically in the statement of support of DRI exemption, the applicable ITE Trip Manual Code (Code 820) shows no change in trip generation by application of that code to this facility. Finally, the project space has been vacant since September,'1993, which is well within the five (5) year limitation for application of the Change of Use Doctrine. t STATEMENT OF REASONS IN SUPPORT OF SECTION 12(kk) EXEMPTION Section 12(k) of the Cape Cod Commission Act states, in relevant part, as follows: "The Commission shall make a finding whether a proposed development, which would literally qualify as a Development of Regional Impact, may nonetheless be exempted from Commission review because it will have no significant impacts on the values and purposes specified in Section 1 outside of the municipality in which it is proposed due tb,its particular location, character and environmental effects." [emphasis added]. A review of the location, character and environmental effects of the proposed renovation of the Project Space as a restaurant indicates that there will not be any, significant impact on the values and purposes protected by the Act outside of the municipality of Barnstable: ' i NO IMPACT ON WATER QUALITY The proposed leasing of the Project Space as a restaurant will have no impact on water supply, sewerage or water quality. The connection to Town sewer.and the utilization of a grease trap as approved by the Department of Environmental Protection will result in net improvement to water quality. In that all construction is contained within the existing building shell, storm water drainage and water retention will not be effected by this project. A copy of the Town of Barnstable and D.E.P. approvals for sewer connection are attached as Exhibit F. In addition, the existing septic tank shall,be abandoned and sealed. NO INCREASE IN LOT COVERAGE, PARKING SPACES OR CUSTOMERS The proposed renovation of the Project Space will involve no change to the existing • footprint and, accordingly,,lot coverage, including buildings and pavement, will remain unchanged. Presently, existing parking spaces on the site total 1,254, which,were constructed based upon potential maximum utilization of the shopping center in conformance with Section 3-3.1 and Section 4-2.7 of the Barnstable Zoning Ordinance: - The total number of parking spaces required, for the shopping center, including the utilization of the Project Space as a restaurant will be _1,133, resulting'in an excess number. of parking spaces of 121. In addition, it is estimated that the number of customers to be served by the restaurant will be less on a per week basis than the prior Walgreen's retail pharmacy. This is true for a number of-factors. First, the hours and nature of operation of the restaurant are more limited than a retail pharmacy. The hours of operation of the former Walgreen's were 9:00 A.M. to 9:30 P.M. Based on information provided by Old Country Buffet, the nation-wide average at over 200 stores is approximately 9,000 customers per week. This is as opposed to an average customer base of a large retail 'pharmacy such as Walgreen's of between 8,500 and 12,500 customers per week. NO SIGNIFICANT IMPACT ON TRAFFIC A review of the Institute of Transportation Engineer's Trip Generation Manual Land Use 820 (Shopping Center) indicates that the Shopping Center Land Use category included studies of over 500 different shopping centers throughout the United States, and that many shopping centers included uses such as restaurants, theaters, post offices, banks, health clubs, recreational facilities and similar non-retail uses. Accordingly, the Festival at Hyannis would be treated by the same ITE code including the Project Space, which would • result in no net increase in trip generation. Based upon information available from the proposed tenant, it is anticipated that the peak hours of operation will be between 11:30 A.M. and 1:30 P.M. and 5:30 P.M. and 7:30 P.M. Further, the tenant informs us that its demographic data confirms that a substantial majority of the restaurant patrons are cross- shopping from stores within the shopping center, with an average 3.2 customers per, vehicle. This is substantially less than the per vehicle customer average for a retail pharmacy. Although there may be some minor fluctuations in peak hour traffic flow, the original planning for traffic flow, parking, entrance and Route 132 mitigation was designed to handle a capacity of substantially greater than will result from any peak hour . fluctuations. ECONOMIC AND EMPLOYMENT IMPACTS I It is anticipated that reconstruction of the Project Space will result in significant economic benefits. These will include employment of construction personnel, creation-of full-time employment opportunities and revitalization of the other shopping center space (presently 2,100 square feet of the shopping center is vacant). The presence of a restaurant facility within the center will create greater appeal to retail tenants to consider leasing other vacant space within the shopping center. F BUILDING DESIGN AND VISUAL IMPACT As noted above, there will be no change to the building shell,.and only minor esthetic changes involved with signage and trim on the front of the building. The Festival at Hyannis is considered a well maintained and aesthetically pleasing facility, both in terms of design, layout, landscaping, safety and related issues. The utilization of.the Project Space • for a restaurant will not impact, in any fashion;,the resources described in the Regional Policy Plan or Cape Cod Commission.: CONCLUSION - The proposed reconstruction and leasing of the Project Space for a 402 seat restaurant facility is not a change of use within the guidelines and criteria promulgated by the Cape Cod Commission under Section 12(c) of the-Cape Cod Commission Act. Accordingly, a negative determination of jurisdiction should be issued. In the alternative, even if considered a technical DRI under the change of use category; the Project will have no significant impacts on the resources protected by the Cape Cod Commission Act or the . Regional Policy Plan outside of the 'municipality in which the project is located. • «" - 10 - I { s. SUMMARY The Cape Cod Commission (Commission), through its Regulatory Committee, hereby approves the application of Attorney Patrick M. Butler, acting on behalf of PetSmart a tenant at the Festival Mall in Hyannis, for a modification to an Approved Development of Regional Impact (DRI) decision under Section 9(n) of the DRI Enabling Regulations. The change to the exterior 'sign is hereby approved as a minor modification #2 under Section 7 of the Administrative Regulations (as revised). This decision is rendered pursuant to a' vote of the Commission's Regulatory Committee on September 17, 2001. PROJECT DESCRIPTION, ISSUES& PROCEDURAL HISTORY The project approved as.a DRI by the Commission with conditions, in a decision dated May 7, 1998 was the construction of an 18,9oo square foot free-standing i 2 retail building located on a then-vacant parcel at the Festival at Hyannis shopping plaza, Route 132 in Hyannis, MA. A subsequent modification decision was issued on July 12, 1999 that increased the size of the proposed building from 18,9oo to 19,310 square feet. The Commission received a request on September 7, 2001 from Attorney Butler, on behalf of PetSmart, tenant of the proposed building, to allow the exterior sign on the building to be internally..illuminated. Condition #10 of the original DRI decision stipulated that any signs had to be externally illuminated. On September 17, 20o1, Attorney Butler attended a Regulatory Committee meeting where this project was discussed. DISCUSSION AT THE REGULATORY COMMITTEE MEETING No comments from the public were received at the September 17, 2001 Regulatory Committee meeting on this project. Attorney. Butler described the proposed modification, and Commission staff presented a report. The Commission's Regulatory Committee considered the change to the original DRI Decision that would result from allowing an internally-illuminated sign, and voted unanimously to consider this change a minor modification #2.
