Background:
This appeal was for a Variance to Section 4-3. Sign Regulations for height&size. The site is the Festival Mall,
and the applicant is seeking to install two new signs. One is at the site entrance along Route 132 and the other
is at the new site entrance along Hadaway Road. The proposed two signs are higher and larger in area that
permitted under zoning.
Section 4-3.7 which regulates signs in the Business and Highway Business zoning districts, permits the Building
Commissioner to allow a total of two free standing signs, a maximum height of 12 feet for each, and the total
sign area of each not to exceed 50 feet sq.ft.
Procedural Summary:
This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on June 15,
2000. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters
in accordance with MGL Chapter 40A. Board members hearing these appeals were Gail Nightingale, Richard
Boy, Ralph Copeland, Jerry Gilmore and Chairman Ron Jansson. Attorney Patrick Butler represented the
petitioner. The hearing was opened on August 2, 2000, and continued to September 27, 2000, and further
continued to November 1, 2000, at which time the applicant requested and the Board granted a withdrawl
without prejudice.
Decision:
At the November 1, 2000 hearing of this appeal, a motion was made and seconded to allow the applicant to
withdraw without prejudice.
VOTE:
AYE: Gail Nightingale, Jerry Gilmore and Chairman Ron Jansson
NAY: None
Ordered:
Appeal 2000-66 has been Withdrawn Without Prejudice. Appeals of this decision, if any, shall be made pursuant
to MGL Chapter 40A, Section 17, within twenty (20)days after the date of the filing of this decision in the office
of the Town Clerk.
