Box 1630 I Hyannis,MA 02601 Re: Proposed family style restaurant at Festival Mall,Hyannis Dear Pat: This informal presentation by the applicant seeks to get a"sense of the Board" as pt1iriancP and direction prior to filing formally for Site Plan Review. - Based on prior precedent, and in an effort to be as consistent as possible, I looked at three t items to arrive at the decision as to whether or not this proposal constitutes a change of use under the Cape Cod Commission Act. i. Does the proposed use change the need for parkin in comparison to the immediate prior use? The central argument here is do we look at the shopping center as a whole, or at the individual proposal as a stand alone project? Based on the fact that the Cape Cod Commission does not specify, I feel comfortable going to our Zoning Ordinance for guidance. Section 4-7.3(2)and(3) of the Barnstable Zoning Ordinance; along writh the definition of intensification of use in Section 6, make it clear to me that it is a change of use if it increases the need for parking. Looking at the 11,160 square foot building and comparing the prior retail use(one space for each 200 square feet)to the proposed restaurant use(one space for each three seats), one can see that the increased demand is 79 spaces. This is at least a clear intensification of use, not to mention a change of use. 2. Does there appear to be a regional pursuit here2 I believe from the materials submitted, including the fact that nationally this restaurant averages 9000 visits per week, and the fact that they expect between 40.0 and 640 cars per day at this Q941102A I 1446 Attorney Patrick M. I do not believe there are many,if any, restaurants with a larger capacity in town. 3. , Is there an excessive draw on municipal services From this proposal, as compared to the last use,it is unknown from the information submitted if this is the case. We have to therefore conclude that it probably will not adversely impact ible exception of the traffic question during peak municipal services with the poss hours at Route 132,and the impact of that. Based on the above, I am of the opinion that this proposal P p p does constitute a change of use under the Cape Cod Commission Act and therefore, should go back to the applicant for him to decide either: I. to officially file for Site Plan Review and be formally referred to the Cape Cod Commission or ..;. : 2. to seek, on his own initiative,either a DRI exemption or an informal opinion from the Cape Cod Commission. I failed to do so and take full responsibility for prolonging the problem and wearing your patience thin, I was not aware that we could not change the face as long as we did not increase the square footage. I can see where the fact that the sign was obtained by variance would complicate this, I have no recollection of going for a variance on this sign and it must have been.handled by Trammell Crow Company. The Festival at Hyannis copy and the old Star Market panel were removed and junked and were replaced by this new panel which reads only Star Market. We had Trammell Crow's permission to effect this change and it is now apparent that we made a serious error in not presenting the change for your consideration. For that I apologize, If we must remove the panels immediately we will do so. I would like to request on Star Markets behalf that we be allowed to leave the panels until we can apply for a variance and have a hearing, At that point we will immediately comply with the boards wishes. I feel badly that I placed Star Market in this position and would appreciate any consideration you could give them in allowing the sign to remain in place until the hearing. Trammel Crow will be a part of any request we make to leave this change in place. Thank you for your help.
