Trust The Festival at Hyannis 1070 Iyanough Road (Route 132) , Hyannis Dear Ms. Shapiro; This letter is in response to your letter dated December 1, 1992 re a foundation permit for the Festival Mall. You made reference to a sewer moratorium by the Barnstable Department of Public Works ( "DPW" ) in April of 1988 . According to the Superintendent, Mr. Thomas Mullen the moratorium had no effect on the Festival project and he listed several reasons. There were no sewer mains abutting the property when the project was designed, sewer connection was beyond cost-effective connection and Trammell Crow reduced the size of the project to meet the Board of Health Regulations. In accordance with the statutory requirements of Chapter 40A of M.G.L. the perimeter plans approved by .the Planning Board had an eight ( 8) year protection. That plan was to expire on December 3,, 1992. On that same date a Building Permit was requested for a building of 47 , 682 square feet. Ms. Sandra Shapiro December 29, 1992 Page 2. The difficulty is the date of submission of the application for a Building Permit - the final day before expiration of the eight (8 ) year protection of the perimeter plan. By such a late date application on the last day prior to expiration, it becomes impossible to secure the. approvals necessary for the issuance of a permit before the expiration date. In addition, the critical issue of the building size, 47 ,682 square feet, the project now becomes subject to the Cape Cod Commission Act as well as local approvals. In support of my decision I would reference a few cases I believe would support my decision. Spector vs Building Inspector of Milton, 250 Mass. 63,71, 145 N.E. 265 ( 1924) ; Caputo vs Board of Appeals of Somerville, 330 Mass. 107, 111, 111 N.E. 2d 674 ( 1953 ).; Wniker Realty, Inc. vs Zoning Board of Appeals of Millis, 362 Mass. 869,285 N.E. 2d 452 ( 1972) . On December 10, 1992 the Site Plan Review Committee suspended any further review due to the applicants inability to meet Board of Health regulations for the site. Trust The Festival at Hyannis 1070 Iyanough Road, Route 132 Dear Mr. Daluz: On behalf of our client, The Campbell/Massachusetts Trust, owner of the Festival at Hyannis (the "Festival") , we submit herewith an application for a permit to construct foundations for a 47 682 square foot addition to proposed q the Festival at Hyannis. The Barnstable Planning Board endorsed its approval of the Definitive Plan for the Festival at Hyannis subdivision on December 3, 1984. Because the Preliminary Plan for the subdivision was filed on November 4, 1983, the Zoning By-Laws in effect on November 4, 1983 will govern the subdivision until December 3 , 1992, which is eight (8) years from the date of ,the Planning Board endorsement of approval of the Definitive Plan. The proposed addition will be consistent with the Zoning By-Laws in effect on November 4, 1983 . As you are aware, the Barnstable Department of Public Works- ("DPW") imposed a moratorium on new sewer connections in April 1988. Previously, the Board of Health had imposed an effective ban on new on-site septage systems. Given this '.moratorium, Massachusetts General-' Laws Chapter 40A, S 6, provides that the running of the..'e .ght (8) year `zoning "freeze" granted under that•' section has been "talled!', or extended by a period of time equal to the time of the:`local 'moratorium, or since April 1988. According to representatives of the DPW, planning is currently under way .for constr.uctioneof a..#sewer line extension in the vicinity; of. Route 132. . It is''our understanding that this new "sewer line, which is scheduled for ,completion during the summer .: of 1994, will have the capacity to handle not just the current volume of sewage generated by those persons who. will tie ' irito'the sewer; but •will also have capacity to handle increases,,in.voluine either from new projects or from project expansions, such as .tNit proposed .herein. . It is therefore the intention of the Festival at: ,Hyannis that both current effluent and that resulting from this planned expansion will be discharged to the Barnstable-Waste `# Water .Treatment Unit through the new sewer line. Nonetheless, ..while DPW representatives have indicated that DPW would be. pleased.ta receive an application for a sewer connection permit reflecting .the .proposed . expansion, they emphasized that the sewer moratorium will remain in effect until thetinew.=_sewerline has been completed. The moratorium had no effect on the Festival project for the following reasons: There were no sewer mains abutting the property when this development was being designed and constructed nor is there a sewer main currently abutting the Festival property or within a reasonable distance to allow a cost-effective connection. The developer, Trammell Crow, determined that it was in their financial best interest to reduce the size of their project to a point where it would meet the provisions of the Board of Health Regulation wherein a development may not exceed the disposal quantity of 330 gallons of septage effluent per day, per acre of land. This is substantially less than allowed for a free standing sign under the existing ordinance. It should be further noted that the total area for the sign to be located on the Hadaway entrance is 71.42 square feet. The calculations for the sign area are attached hereto as Exhibit B. It should be further noted that the Hadaway sign could be located in the Industrial Zone on the subject property. This would allow for a sign 200 square feet in size (see Section 4-3.8). As a result, the two signs as now proposed will have significantly less area than would be allowed as a matter of right. The Applicant will be submitting at the time of the continued public hearing photographs of signs within the immediate vicinity of the Route 132 entrance for further consideration by the Board. Finally, a condition of Site Plan Review was that the Applicant submit engineered plans depicting a specific location of the proposed sign with a certification that the sign will have no adverse affect on stopping sight distances on Route 132 and Hadaway Road, respectively. That permit was denied by the Building Commissioner on December 29, 1992. The applicant is requesting an Appeal of that decision to deny a permit for the construction of the foundations. From materials submitted it appears the applicant is requesting the Zoning Board of Appeals to reverse that decision. It also appears that the applicant 1 Staff Report - Appeal No. 1993-15 Appeal of an Administrative Decision is questioning some grandfathered rights in this development. The applicant should be prepared to explain exactly what grandfathered rights are sought. Cape Cod Commission Action: This project was referred to the Cape cod Commission by the Town of Barnstable on February 03, 1993 and was denied without prejudice by the Commission on April 15, 1993 (decision attached) . During the Cape Cod Commission proceedings, Patricia Daley, Commission Counsel, in corespondents to the Town of Barnstable's Attorneys office suggested that two possible course of actions for the Town existed after the Cape Cod Commissions denial without prejudice. They were; "First, the applicant may withdraw local development permit application", or "Second, any local board with a pending development permit application may deny such a permit on .procedural grounds, without prejudice, based upon the Commissions action." (see attached March 18th ) . Given that this case is an Appeal of a Town of Barnstable Administrative Official, the department would delegate review of this case to the Building Commissioner, who,s decision is the subject of this appeal.
