The release investigation,including an inspection of the roadway and subsequent inspection of the catch basins adjacent to the affected roadway, has indicated that no release to the environment occurred. By regulation and definition, in the absence of a release to the environment of more than 10 gallons of hydraulic oil, Notification and Remedial Response are categorically excluded under the provisions of the MA Contingency Plan(MCP) 310 CMR 40.0000, cited herein. The following is a description of the events following leak discovery, in the context of the environmental and physical setting, as applied to the governing regulations. On July 3,2019,a street sweeper operated by the Town of Barnstable Highway Department suffered a ruptured hydraulic line, which resulted in the discharge of approximately 30 gallons of hydraulic oil along the northbound lane of Route 132/Iyannough Road, south of the Capetown Plaza from the Tiki Port Restaurant at 714 Iyannough Road to the intersection of Iyannough Road and Airport Road, an approximate distance of 1,700 feet. Subsequent to the discharge, Highway Dept. personnel applied sand and absorbents to the roadway for traction and absorption of the wetted surface. BEA was requested to provide LSP oversight to investigate a potential release to the environment. An inspection of the affected area the same day as the reported release indicated that the release was confined to the paved roadway surface and did not enter any of the storm water catch basins located along the side of the road or any earthen areas. Based on observations, it appeared that the release,over such a distance with the sweeper activated,resulted in a thin layer of hydraulic oil spread over the pavement surface. The affected pavement was inspected and found to be in good condition with no significant cracking or defects observed. An inspection of proximal catch basins found no evidence of impact from the subject discharge of hydraulic oil. A total of some 7 one-yard containers (7,000 pp Y g Y r6s) of spent absorbents were managed as oily solids (MA01) by Frank Corp. at Northland Environmental LLC., in Providence, RI on July 8, 2019 under a Uniform Hazardous Waste Manifest(018092771JJK). With the benefit of a police detail for traffic control and assistance of the Barnstable DPW, the catch basins were visually re-inspected and found to be free of hydraulic oil impact as finding no staining of the covers or inside concrete risers. The catch basins were noted as clogged and full of sediment. Based on the observed condition and at the recommendation of BEA,the Barnstable DPW removal of the sediment as part of the normal routine maintenance of storm water facilities. The material removed from the seven basins was transported to the Hyannis DPW yard for storage pending management of the material under the Town of Barnstable's Beneficial Use Determination(Transmittal#X277928), pursuant to the applicable Solid Waste Regulations. Wherein prompt response was used to contain and remove the hydraulic oil released to the pavement surface, and no discharge to the catch basins was noted at the time of the release and by subsequent visual inspection,no release to the environment actually occurred. In the absence of a Release to the environment where there is no need for Remedial Response Actions under the MA Contingency Plan(MCP)other than the appropriate management of the absorbents and catch basin road litter, a Retraction of a previous Notification is technically justified in support of project closure. This work has been undertaken under LSP oversight in a manner consistent with the MCP Response Action Performance Standards, pursuant to 310 CMR 40.0191 and the QA/QC policies of BENNETT ENVIRONMENTAL ASSOCIATES,LLC. The facts and statements herein are,to the best of my knowledge, a true and accurate representation of the Site activities, remedial response actions and environmental conditions associated with the project. ENVIRONMENTAL CONDITIONS [Refer to Appendix A] The subject Site, represented by the "Area of Staining" on the site plan, consists of an approximately 1,700' (L) x 3-5' (W) portion of the MA State Highway Route 132 Northbound paved travel area,beginning approximately 1,100' northwest of the intersection of Route 132 and Nightingale Lane in Hyannis,MA[Refer to Figure 1 and Site Plan].The coordinates for the subject Site are Latitude 41.66809 N, Longitude 70.29378 W. The area surrounding the Site is a heavily-developed commercial use area with malls, restaurants, shopping centers,hotels, and car dealerships. Access to the area of the highway where the release occurred is unrestricted, with soils along the roadway having a low frequency/low intensity of use, with children potentially present. On-site workers are identified as the primary human receptors to potential ingestion, particulate inhalation and dermal contact exposures associated with soil impacts. Regional groundwater contours indicate a southerly flow direction towards Lewis Bay, with groundwater elevations shown at 30+'. As such, groundwater is estimated as within 10-15' below grade at the Site [Refer to Figure 2]. According to the Mass GIS Priority Resource Map, the Site is located within a Medium- Yield, Non-Potential Drinking Water Source Area(NPDWSA). The Site is also shown as within the Zone II Protective Radius of the Town of Barnstable Public Water Supply (PWS) wells, as well as within the EPA-designated Sole-Source Aquifer for all land east of the Cape Cod Canal Therefore,the Site is classified as being within a Current Drinking Water Source Area(CDWSA). Properties in the surrounding area are serviced by the Town of Barnstable municipal water supply with no known private wells within 500' of the release area. Freshwater wetlands are shown within a half-mile north and south of the Site, and two Potential Vernal Pools are shown to the west and northwest of the Site. Several small, unnamed ponds are also shown within a half-mile of the Site, although several appear to be related to drainage basins for the paved parking areas located throughout the area [Refer to Figure 3]. BACKGROUND [Refer to Appendix B] On the morning of July 3,2019,a street sweeper operated by the Town of Barnstable DPW suffered a ruptured hydraulic line resulting in the discharge of approximately 30 gallons of hydraulic oil to the paved roadway. The spill occurred over a roughly 1,700' length of MA State Highway Route 132/Iyannough Road, on the northernmost northbound lane, beginning from the parking lot entrance in front of the Tiki Port Restaurant. When the street sweeper operator became aware of the ongoing release, he pulled the machine into Airport Rd., where the majority of the hydraulic oil released. The street sweeper was later towed from the scene on a flatbed tow truck to Town of Barnstable fleet maintenance facility for repair. AUGUST 14,2019 FRANK CORP/TOWN OF BARNSTABLEBEAI9-11224 PAGE 4 OF 8 IRAC WITH PERMANENT SOLUTION:RTN4-27828 INITIAL RESPONSE [Refer to Appendix B & C] Town of Barnstable DPW personnel responded immediately and applied sand to the impacted roadway to absorb the hydraulic oil and to provide traction to cars traveling the roadway. Barnstable DPW subsequently contacted the Hyannis Fire Department, who in-turn contacted the MA DEP to report the release. MA DEP personnel (Andy Jones) authorized the application and recovery of sand to absorb the released oil as well as for traction for the roadway in regards to public safety. Mr. Jones further spoke with Barnstable DPW personnel regarding remedial response liability under Chapter 21E and assigned release tracking number (RTN) 4-27828 to the release as an Immediate Response Action. The sand was applied to the area of release and recovered with a street sweeper, before being transported to the Barnstable Highway Department yard pending off-site transport and disposal. Highway Department personnel then contacted Frank Corp.,as a competent emergency response/environmental cleanup contractor,to provide assistance for remedial response actions at the Site. Frank Corp. subsequently contacted BEA to provide LSP oversight of the Immediate Response Action. BEA responded to the Site that afternoon and conducted an initial walk-over of the release area. Prior to BEAs inspection, the Barnstable DPW had applied sand to the area of staining and removed the sand using another street sweeper. During the inspection, petroleum staining was observed in the travel lane of the northbound side of the roadway. Upon inspecting the roadway over the entire length of the release, no significant cracking or defects in the pavement were observed. A total of eight (8) catch basins were noted on the north side of the roadway along the area of staining, none of which appeared to be affected by the release of hydraulic oil. Heavier staining was observed at the intersection of Airport Road and Route 132,where the street sweeper pulled off of Route 132. Additional absorbents were applied at this location as a result and remained at the time of BEAs inspection. During the inspection of the area, it was noted that Airport Rd. appeared recently paved and as a result the pavement was in good condition, with no cracks or defects observed. Two catch basins were located along Route 132 just west of this intersection,neither of which appeared to be affected by hydraulic oil. �-s- -r Picture 2: Granular absorbents applied at the intersection of Route 132 and Airport Road. Vehicles tracking the hydraulic oil immediately following the release may have contributed to this staining. However,the area of staining beyond the Route 132/Airport Rd. intersection was similar in appearance to petroleum staining observed in the unaffected lane of the roadway and was consistent with staining typically observed on any heavily traveled roadway. The sand and absorbents applied to the staining were subsequently removed with another street sweeper and were taken to the Barnstable DPW yard pending off-site transport as remedial waste. On July 8,2019,Frank Corp.transported seven one-yard containers of sand and absorbents (7,000 lbs) from the Highway Department yard to Northland Environmental in Providence, RI [Refer to Appendix C]. Based on the absorbent capacity of granular clay type absorbents used (4 gallons per 50 lb bag), the 7000 lbs of absorbents managed far exceeds the estimated release volume of 30 gallons. As such,the use of absorbents immediately following release discovery for containment and removal of the spill to the roadway, further supports absence of release to the environment as advanced by the inspection of the storm water catch basins in the area. CATCH BASIN INSPECTIONS [Refer to Appendix B & C] On July 11, 2019, BEA personnel met Barnstable DPW personnel and a Barnstable Police detail at the Site to perform a more thorough inspection of the affected area of roadway, including the catch basins along the roadway.. During the inspection, Barnstable DPW personnel removed the cast iron grates from each of the catch basins'to allow for"." close inspection of the interior of the basin. Barnstable DPW personnel took notes on the type, construction and condition of the catch basins and noted the distance from grade to the sediment in the basin. BEA personnel inspected the grate, riser and basin for the presence of any wetness or staining that would indicate the hydraulic oil had entered the basin. None of the basins exhibited any wetness or staining that would indicate the hydraulic oil entered the basins. In fact, the distance between the staining in the roadway associated with the subject hydraulic oil release, and the catch basins was measured to be between 2.5' to 8' laterally. Of the eight catch basins in the vicinity of the release area, one (#8) was inaccessible due to being buried under dirt and vegetation. Two of the catch basins (#6 and #7) contained water from a rain event the previous evening. The water in the basins did exhibit a minor sheen,however, the sheen observed was typical of catch basins in similar locations along the major thoroughfare outside the release area. Following the inspection of catch basins within close proximity to the release, BEA and DPW personnel reviewed utility plans of the area to investigate a potential threat to the drainage basin located further west, at the intersection of Independence Drive and Route 132. The plans showed that the drainage basin only receives water from the drainage system along Independence Drive,which is located beyond the area of release. As such, inspection of the drainage culvert was determined to be unnecessary. The sheen observed was consistent with the conditions of a heavily-traveled roadway outside the area of release. AUGUST 14,2019 FRANK CORP/TOWN OF BARNSTABLE/BEA19-11224 PAGE 7 OF 8 IRAC WITH PERMANENT SOLUTION:RTN4-27828 During the inspections of the catch basins, Barnstable DPW personnel noted that the catch basins were full of"road litter" sediment and should be cleaned out as a maintenance issue, to improve the performance of the drainage system along the roadway. This coincided with the recommendation BEA made to muck-out the basins as a precautionary measure, due to the proximity of the release. This recommendation was discussed with MA DEP personnel (Bob Murphy, Case Officer)that afternoon, who concurred with the benefit of this catch basin cleaning. On July 15, 2019, Barnstable DPW personnel returned to the Site with a vactor truck to remove the accumulated sediment from the catch basins. Approximately five cubic yards of sediment were removed from the seven catch basins. The material was transported to the Barnstable Highway Department yard the same day, pending off-site reuse pursuant to the MA Solid Waste Regulations for beneficial use determination. CONCLUSIONS Based on the emergency response actions undertaken by the Barnstable Department of Public Works, including application and recovery of sand and absorbents to capture any freestanding liquids, a release to the environment was averted. Seven cubic yards of sand and absorbents were later transported to a disposal facility under a Uniform Hazardous Waste Manifest, included for reference in Appendix C as demonstrating appropriate management of OHM materials. Subsequent inspections of the area of release along the roadway and the nearby storm water catch basins documented that no release to the environment had occurred, wherein no hydraulic oil had been released to the subsurface through imperfections in the pavement nor via discharge to adjacent storm water catch basins. Therefore, pursuant to 310 CMR 40.0335 (1)(a), wherein no release to the environment actually occurred, the release is not required to be reported, nor is there need for Remedial Response Actions under the MA Contingency Plan(MCP). As such, a Retraction of a Previously Reported Notification is technically justified in support of project closure as framed herein.
