Dear Ms. Karle and Members of the Conservation Commission:
BSC Group, Inc. (BSC) is pleased to submit this request for waiver of the Performance Standards found in Section 704-
3 for projects proposed within 50-foot Buffer Zone, on behalf of Brian and Anne Guarco (the Applicant), for the
property located at 163 Estey Avenue, Hyannis, MA (the Site). The proposed project at the site consists of the
construction of an 8’ x 12’ second story deck and 4’ x 10’ access stairway. These structures will be attached to the
existing dwelling and built over existing lawn and retaining wall. These structures are proposed within the 50-foot
Buffer Zone to Bordering Vegetated Wetlands (BVW) and Coastal Dune. As mitigation, 96 sf of mitigation planting
areas within the 0-50-Buffer Zone to Coastal Dune and BVW. Planting will include coastal zone tolerant species such
as Bearberry (Arctostaphylos uva-ursi), Virginia Rose (Rosa virginiana), Pasture rose (Rosa carolina), Lowbush
Blueberry (Vaccinium angustifolium), Sweet Fern (Comptonia peregrina), and Inkberry (Ilex glabra). See Notice of Intent
project description and plans for more details on mitigation planting area.
It should be stated that much of the existing buffer zone to BVW is currently occupied with lawn and a portion of the
existing single-family dwelling, although some areas of beachgrass exist in the southwestern corner of the Site. The
proposed work will not change the existing vegetation or cover type of the 50-foot Buffer Zone to BVW or Coastal
Dune, as the structure will be pile supported. The areas beneath the deck will remain lawn. Excavation will be limit to
the support pilings and sediment controls will be installed prior to the start of work. Therefore, there are no
anticipated or significant impacts to the 50-foot Buffer Zone to BVW and Coastal Dune.
