A detailed project narrative is enclosed for your review. The on-site sewage disposal system will also be replaced, but the primary system components are outside of Riverfront Area and the Coastal Bank buffer zone. MME submits this NOI pursuant to the Massachusetts Wetlands Protection Act (“MWPA”)(M.G.L. Ch. 131 §40), the Massachusetts Rivers Protection Act (Chap. 258 of the Acts of 1996), and the Town of Barnstable Wetlands Protection Bylaw (Ch. 237), and in accordance with the implementing MWPA Regulations (310 CMR 10.00) and the town’s Regulation Governing Minimum Submission Requirements for a Notice of Intent Application. MME attests that it will notify property abutters of this application and of the May 23, 2023, public hearing in accordance with state and local requirements. The town portion of the $275 filing fee and the $200 local wetland bylaw fee are enclosed, and the legal advertisement fee (amount TBD) will be paid on or by the date of the hearing. Directions to the Site are provided on the reverse of this letter and property access by Commission members is authorized. Payor name on check: Last Name MARSH MATTERS ENVIRONMENTAL Prepared for: George Torbay Northborough, Massachusetts Notice of Intent Project Narrative 70 Ocean Avenue, Hyannisport (Barnstable), Massachusetts vMME_9 MAY 2023 MARSH MATTERS ENVIRONMENTAL Notice of Intent PROJECT NARRATIVE May 2023 Contents 1.0 Existing Conditions 2.0 Proposed Project Description 3.0 Regulatory Compliance MARSH MATTERS ENVIRONMENTAL Notice of Intent PROJECT NARRATIVE May 2023 1.0 Existing Conditions GEOGRAPHICAL SETTING: The applicant’s property (Assessor’s reference Map 288, Parcels 182-004 and 182-005)(the “Site”) is a 1.74-acre residential lot on Ocean Avenue in Hyannisport adjacent to the southernmost portion of the Stewart’s Creek estuary (Figure 2). The applicant purchased the property in 2022. EXISTING HOUSE: The original house on the property was constructed in 1916. The existing house, rebuilt in 1984, is a two-story, nine-room house of approximately 4,288 sf (living area according to the property record card). The applicant purchased the property last year. Exterior features/structures include a storage shed, patio, concrete pad seating area, brick walkway, gazebo, and outdoor fireplace/kitchen. WETLAND RESOURCE AREAS: Associated with Stewart’s Creek, the lower/southern portions of which are tidally influenced, are Resource Areas including Riverfront Area (310 CMR 10.58), Bordering Vegetated Wetland (BVW)(310 CMR 10.55), Salt Marsh (310 CMR 10.32), Coastal Bank (310 CMR 10.30)(both locally and DEP Policy-determined), and Land Subject to Coastal Storm Flowage (310 CMR 10.04). These Resource Areas extend onto, or have jurisdictional buffer zones that extend onto, the Site. The landward limit of Riverfront Area extends for two-hundred horizontal feet and reaches into the footprint of the existing house. Approximately 32,131 sf of property area (approximately 42%) is located within Riverfront Area, most of which is outer riparian zone (100-200 ft from mean high-water portion). Nearly the entire inner riparian zone (0-100 ft from mean high water) is naturally vegetated wetland and upland area. The one-hundred-foot wide Coastal Bank buffer zone extends furthest into the Site and this buffer zone and the Riverfront Area boundary together define the landward limit of Conservation Commission jurisdiction. DEGREE OF LAND DISTURBANCE: Most of the property is altered from long-existing, residence development-associated activities (i.e., home construction, landscaping). Nearly the entire inner portion of the Riverfront Area (zero to one-hundred feet from the river’s mean high-water mark) is naturally vegetated wetland and upland area. The entire inner portion of the BVW buffer zone (zero to fifty feet from the wetland boundary) naturally vegetated upland area. FLOODZONE(S): The nearest Zone AE floodzones (El. 11 and El. 13)(Land Subject to Coastal Storm Flowage – 310 CMR 10.04) is located to the north and east of the house (FIRM No. 25001C0568J)(Figure 6). LAND ELEVATIONS: Maximum land elevation change on the property is approximately 14 feet extending from elevation 10 feet in the northwest corner of the property to 24 feet (NAVD88) in central property areas where the house is. RARE SPECIES HABITAT: The NHESP maps no Priority Habitat of Rare Species or Estimated Habitats of Rare Wildlife on or near the property. MME reviewed all or some of the following data sources. Certain maps were used to produce a set of site locus figures, which are part of the NOI attachments. • Federal Emergency Management Agency (FEMA) Flood Insurance Rate Maps. • United States Geological Survey Topographic Quadrangle. • MassGIS MassDEP Wetland and Hydrography data layers. • MassGIS Natural Heritage Atlas data layers. • Google Earth Aerial photography. • United States Department of Agriculture, Natural Resources Conservation Service (USDA-NRCS) Web Soil Survey; and, • Mapping data layers provided by the subject municipality’s website (if available). MME performs WRA identification and delineations in substantial accordance with the following publications: the Massachusetts Wetlands Protection Act and the implementing MWPA regulations (310 CMR 10.00 et seq.); Section 404 of the Clean Water Act (33 U.S.C. 1344); the Massachusetts Department of Environmental Protection (MassDEP) publication Massachusetts Handbook for Delineation of Bordering Vegetated Wetlands (2022); and the U.S. Army Corp of Engineers (USACE) Wetland Delineation Manual (1987). When performing WRA identification and delineations, MME uses a methodology involving consideration of (1) plant community compositions and transitions between plant communities, (2) observed topographic changes in the landscape, (3) indicators of wetland hydrology, including evidence of extent of standing or flowing water in nearby waterbody or waterway, (4) the presence/absence of certain sub- surface soil morphological indicators (i.e., redoximorphic features) that confirm the presence, or absence, and approximate elevation of groundwater in the soil profile (relative to the ground surface) during a portion of the growing season, and (5) any evident land alterations. MME marks WRA boundaries with numbered tape flagging, or stakes, and typically collects a set of photographs that document on-site conditions on the day(s) of fieldwork. Entrance onto abutting property is usually incidental and often necessary in order to complete fieldwork and MME assumes that this entry, as well as establishment of wetland boundary flagging, has either been pre-approved, or is otherwise acceptable by the subject property owner and/or property abutters. For wetland indicator status ratings for vascular plants, MME refers to the National Wetland Plant List for the Northcentral and Northeast Regions administered by the U.S. Army Corps of Engineers (2017 updated version). For hydric / non-hydric soil profile determinations, MME consults Field Indicators for Identifying Hydric Soils in New England (Version 4, 2017). When noting the presence of invasive and potentially invasive plant species, MME uses plant status designations provided by the Massachusetts Invasive Plant Advisory Group (MIPAG). MARSH MATTERS ENVIRONMENTAL Notice of Intent PROJECT NARRATIVE May 2023 MME typically completes at least one set of Bordering Vegetated Wetland Determination Forms when a Bordering Vegetated Wetland is delineated and/or if MME believes that this type of detailed documentation is necessary. One or more sets of these data forms may accompany this narrative / NOI and the information on the forms should be considered representative of plant community and soil profile conditions along the length of wetland boundary. Preparation of the attached site locus figures was part of MME’s desk-top review of the Site prior to observing site conditions. For determining the landward extent of Riverfront Area, in accordance with 310 CMR 10.58(2)(a)(2), if the project engineer is not identifying the mean high water (MHW) or the mean annual high-water (MAHW) mark/elevation, the MME identifies MHW/MAHW by identifying visible markings or changes in the character of soils or vegetation due to the prolonged presence of water. These markings distinguish between predominantly aquatic and predominantly terrestrial land. For tidal rivers, in the absence of reliable tidal flood elevation information, MME typically determines the approximate MHW mark using topographic clues and, in certain instances, the observed landward extent of Spartina alterniflora growth. 2.0 Proposed Project As illustrated by the proposed project site plan set, the proposed project includes construction of an in- ground pool, patio, garage, and reconfigured pea stone parking area with addition of landscaping amenities. The on-site sewage disposal system will also be replaced, but the septic tank and soil absorption system are both proposed outside of Conservation Commission jurisdiction. Please refer to Mitigation Calculations sheets 1 and 2 of the plan set (NOI Attachment 1), which provides project area quantities for both Coastal Bank buffer zone and Riverfront Area. Pool and Patio The proposed pool dimensions are 18 ft by 40 ft with a hardscape patio between the pool and house with dimensions 12 ft by 40 ft. A spa with dimensions 8 ft by 10 ft is part of the pool footprint. The pool and patio footprint total area is 1,228 sf. The project area is an existing lawn area abutting the east end of the house. A fenced-in outdoor cooking area consisting of a stone fireplace/oven located partially within the pool footprint will be entirely removed (see Photo 1, Attachment 2). Details of the pool design and construction are provided in NOI Attachment 1. Because an Auto Cover will be installed, no pool security fencing is necessary. As no buried leaching or infiltration basin is proposed, should the pool require any emergency or maintenance drainage, all water will be removed by a pump truck. One pitch pine (Pinus rigida), which is located close to the northeast corner of the pool footprint will be removed (see Photo 4). Garage and Parking Area The proposed garage dimensions are 24 ft by 40 ft and the structure will be located in an existing, level lawn area west of the house (see Photo 2). The three-bay garage will contain a small apartment on its second floor. Please refer to the design drawing prepared by SDP Architects provided in NOI Attachment 2. The existing gravel driveway will be enlarged and will be resurfaced with pea stone. The enlargement will displace 266 sf of existing lawn area in the outer portion of the Coastal Bank buffer zone. Any existing lawn areas disturbed during project activities will be repaired. No new lawn area is proposed. MARSH MATTERS ENVIRONMENTAL Notice of Intent PROJECT NARRATIVE May 2023 Landscaping Please refer to the landscaping plan in NOI Attachment 1 which provides an illustration of foundation and walkway-adjacent plantings. Structure / Feature Removals Several structures and landscape features will be removed as part of the project. These include the gazebo, the outdoor cooking/fireplace area and fence, the paved area in the front yard, the storage shed, and the brick walkway behind the house. The area quantity of each of these features has been worked into the mitigation calculations. Impact Mitigation The project landscape plan also provides the proposed mitigation planting plan to compensate for the project’s net increase in structure and hardscape in the outer portions of the BVW and Coastal Bank buffer zones. EWI calculated the total amount of mitigation area to be provided to be 5,322 sf in order to comply with Barnstable’s Chapter 704 requirements (§704-3 Performance Standards for Projects Requiring a Notice of Intent). In addition to native trees and shrubs, the mitigation area design incorporates “pollinator pockets.” The mitigation area, which will displace existing lawn, is located entirely within the Coastal Bank buffer zone and the Riverfront Area. Septic System Replacement The on-site sewage disposal system will be replaced with a new Title V-compliant system. The new septic tank and the soil absorption system will be located in the front yard of the house and outside of Conservation Commission jurisdiction. The system will serve the new living space above the garage. The existing cesspool will be pumped, filled, and abandoned in place. No variance from Title V or local regulations is proposed and, therefore, the septic system design will not be subject to a formal Board of Health review. Please refer to EWI’s design sheet 3 for system details. Erosion Control / Work Limit An erosion control barrier (“ECB”) consisting of continuous, staked siltation fence and/or staked straw wattles will define the limit of work. The ECB will be installed prior to use of excavation equipment. All excavated soil material will be removed from the site for disposal, or off-site reuse. Any temporary storage of soil materials during construction will be in a location inside the ECB. Additional conditions specific to enhanced erosion control and resource area protection that the BCC may include in the permit are anticipated and can be incorporated upon MME and contractor review. 3.0 Regulatory Compliance The intent of this project narrative is to describe existing conditions, explain proposed project elements, and demonstrate that the proposed project will substantially meet the applicable performance standards for wetland resource areas present nearest the proposed limits of work and, therefore, serve or contribute to the interests of the Massachusetts Wetlands Protection Act (M.G.L. c.131 §40), the Massachusetts Rivers Protection Act (Chapter 258 of the Acts of 1996), and the Barnstable Wetlands Protection Bylaw (Chapter 237). The interests to be served include protection of public and private water supply, protection of groundwater supply, flood control, storm damage MARSH MATTERS ENVIRONMENTAL Notice of Intent PROJECT NARRATIVE May 2023 prevention, prevention of pollution, protection of land containing shellfish, protection of fisheries, and protection of wildlife habitat. The local bylaw describes wetland-associated “values and functions” to be protected to include public or private water supply, groundwater, storm damage prevention, flood control, erosion and sedimentation control, prevention of water pollution, wildlife habitat, shellfish, fisheries, recreation, aesthetics, agricultural and aquacultural values, and historical values. With respect to the protection of these interests and values, it is important to note that all project activities will occur on lawn or otherwise previously long-existing altered area on the property. The project will actually remove lawn area and convert that area to native plant-vegetated impact mitigation area containing trees, shrubs, and herbaceous vegetation. The only resource area in which work will occur is Riverfront Area, specifically the outer one-hundred feet of Riverfront Area. The inner one-hundred-foot zone of the Riverfront Area will maintain full vegetative coverage. With the removal of several existing features in the landscape, there will only be a net increase of 862 sf of impervious surface in the outer portion of the Riverfront Area. However, with the addition of a 5,322-sf mitigation area within the Riverfront Area, there will be a net increase in native vegetation coverage in the Riverfront Area. MME believes that this will provide an overall improvement to Riverfront Area conditions. With respect to project location alternatives, MME believes that there is no practicable and substantially equivalent economic alternative to the project, as proposed, that will have less adverse effect on the MWPA interests and meet the applicant’s goals. The project footprint has been kept within existing previously altered areas (lawn) and is a relatively small area of total riverfront area on the property. As this project is single-family home-associated and the Site is a lot that was recorded on or before August 1, 1996, the area under consideration for practicable alternatives is limited to this property. Due to the configuration of the property, the location of the existing structure, and proximity to the naturally vegetated Coastal Bank and bank buffer zone, the level area on the east side of the house is the only suitable location for a pool and small adjacent patio area. For the pool to be located entirely outside of Riverfront Area, the location would need to be in the front yard or in the location of the existing driveway. Both options are neither practical nor preferred. Coastal Bank is located to the north and east of the house and this landform is a fully vegetated and stable resource area. This Coastal Bank is not a dune or beach sediment source. No work is proposed on the Coastal Bank, but work is proposed in the Coastal Bank buffer zone. No aspect of the project in the buffer zone will result in conditions that will prevent or reduce the ability of the Coastal Bank to perform its important storm damage prevention and flood control functions. In order to comply with Barnstable’s Chapter 704 mitigation requirements, a 5,322-sf mitigation area is provided. Please see Mitigation Calculations Sheet No. 1 providing a breakdown of existing and proposed project areas. MME believes that this project is eligible for an Order of Conditions approving the project, as the applicable resource area performance standards are met and the proposed work within the Riverfront Area and the Coastal Bank buffer zone will contribute to the protection of the Massachusetts Wetlands Protection Act, the Rivers Protection Act, and the Chapter 237 interests and values.
