Introduction Please accept this Notice of Intent application for the proposed dock and stairway reconstruction project located at 160 Lake Elizabeth Drive in Barnstable (the site). The Town of Barnstable Assessors Department references the site as Map ID: 226-137. The proposed project is located within Land Under Lake Elizabeth as well as the Inland Bank, Bordering Vegetated Wetland, FEMA flood zone and Coastal Bank associated with Lake Elizabeth. The existing 5-foot x 16-foot wood dock is proposed to be replaced with an aluminum dock with cedar plank decking. The proposed dock will be reduced to 4 feet wide and maintain the existing length of 16 feet. The wood stairway will be replaced in the same footprint with non-CCA lumber (or PVC material, such as Azek). This application is being submitted in accordance with the Massachusetts Wetlands Protection Act and the Town of Barnstable Wetlands Protection Bylaw. 2. Site Description The site is located along the western shore of Lake Elizabeth and consists of an undeveloped embankment located just across Lake Elizabeth Drive from the single-family home property at 109 Lake Elizabeth Drive. The owner of the embankment, the Christian Camp Meeting Association, maintains an existing dock and stairway to access Lake Elizabeth down the steep bank to the water’s edge. The existing dock has been in place prior to before the previous owners of 109 Lake Elizabeth Drive and is believed to have been installed in the early 1980s, or earlier. The existing stairway is a wooden stairway constructed nearly at grade down the slope to the lake. The stairway is separated from the dock by a narrow strip of lawn. The dock is a wooden dock approximately 5 feet wide and 16 feet long that has been constructed on wooden piles roughly 6 to 8 inches in diameter. The Bordering Vegetated Wetland and Inland Bank associated with Lake Elizabeth were delineated by Environmental Consulting & Restoration, LLC (ECR) on July 18, 2022. As a result of the field work and review of available environmental databases, ECR is able to confirm that the site contains the following wetland resource areas and areas of Conservation Commission jurisdiction: • Land Under Lake Elizabeth • Bordering Vegetated Wetland • Inland Bank • Coastal Bank • Land Subject to Coastal Storm Flowage (FEMA Flood Zone AE el. 12 ft.) • 100-foot buffer zone Notes: 1. The site is not located within an area mapped as Priority Habitat & Estimated Habitat for Rare Species according to the Massachusetts Natural Heritage & Endangered Species Program (MaNHESP). 2. The site does not contain or is near a Certified Vernal Pool according to the MaNHESP. 3. The site is not located within an Area of Critical Environmental Concern (ACEC). 4. Proposed Activities The purpose of this application is to authorize the proposed dock and stairway reconstruction project at 160 Lake Elizabeth Drive in Barnstable. The proposed project will involve the following activities: • Removal of the Existing Dock and Stairway - The existing wooden dock and stairway are partially dilapidated and shall be completely removed. It is anticipated that the dock and stairway can all be disassembled and removed by hand. All material shall be removed and disposed of offsite at an appropriate faciality. • Construction of the New Dock – The existing 5-foot x 16-foot wood dock is proposed to be replaced with an aluminum dock with cedar plank decking. The proposed dock will be reduced to 4 feet wide and maintain the existing length of 16 feet. The cedar plank decking will be installed with a minimum of 3/4 inch plank spacing as required by Town’s regulations. New support piles shall consist 1.5-inch diameter galvanized steel pipe legs. The two landward most legs will be secured to the subsurface with helix anchors. The support legs will be removed seasonally with the dock frame. The dock will be permanently fixed in position throughout the year. The dock is intended to provide recreational access to Lake Elizabeth for residents of and visitors to Craigville Village. The dock will provide canoe and/or kayak access, which may be temporarily docked at times. The dock is not intended to be utilized by motorized vessels. • Construction of the Stairway – The new stairway shall be constructed within the same footprint as the existing stairway. The stairway shall be approximately 3 feet by 12 feet and constructed of non-CCA lumber (or PVC material, such as Azek). The intent of the stairway is to provide access to the dock along the steep bank to the pond. At this time, the current stairway is built into the bank at grade and the proposed stairs shall maintain that design. • Stabilization Activities - All disturbed areas associated with the proposed project will be restored and stabilized with native plant material and native seed mix appropriate for the site. Any disturbance to the wetland fringe to the pond will be hand planted and seeded with native species tolerant of wetland conditions. Any disturbance landward of the wetland will be hand planted and seeded with native species suitable for the upland environment. The applicant intends to maintain a narrow shoulder of mowed upland along either side of the stairway as it currently exists. Notice of Intent 160 Lake Elizabeth Dr, Barnstable 5. Summary The proposed project includes the replacement of the existing dock and stairway at 160 Lake Elizabeth Drive. The new dock has been designed to meet all the current regulations for docks in the Town of Barnstable. The proposed project has been designed to minimize disturbance to the site and includes stabilization and restoration activities. The project shall be overseen by an environmental monitor to ensure the methodology is followed and all wetland resource areas are adequately protected. Once all work has been completed the applicant shall prepare and submit a Certificate of Compliance to the Barnstable Conservation Commission to confirm that the project has been constructed in accordance with the conditions set forth in the Order of Conditions.
