HomeMy WebLinkAbout309 Bay Lane Revised Plan Request - Submission      05/12/2023 To: Darcy Karle, Conservation Administrator Edwin Hoopes, Conservation Agent Town of Barnstable 230 South Street, Hyannis MA, 02601 Cover Letter Regarding Revised Plan Request – 309 Bay Lane Centerville Dear Ed and Darcy, Attached is a revised plan showing the proposed disturbance of the extension to the previously permitted boardwalk within the top of a coastal bank. During our November 2nd, 2022, meeting it was discussed that the client would like to complete the project to safely get from the top of the boardwalk to the existing dock. The recommendation was to submit this revised plan request to allow the commission to make any comments regarding the extension and what would be required to do so. As part of the original mitigation a total of 3,772 square feet of mitigation was proposed, much of which has already been completed and is now in the process of monitoring for invasive species. The total disturbance including the boardwalk extension calculates to 593 square feet. The mitigation provided under the original permit is well over the required 4:1 ratio, thus no additional mitigation is proposed. During our site visit it was discovered that a pitch pine located within the proposed boardwalk extension was infested with turpentine beetle. Attached in this package is a report of the finding of the turpentine beetle, as well as a mitigation of 2:1 for the proposed removal. In addition to the boardwalk extension plan we will be submitting stamped construction documents for the proposed construction. This will detail the construction methods and limit disturbance to the bank. This project will have no negative affect to the resource area and will construct a boardwalk within an existing path to water, the only proposed vegetation removal will be the one diseased pitch pine which we feel we have sufficiently mitigated for. Protection of trees and shrubs shall include both the visible growth and the root zones. 6. Coordinate closure of the work area with the Owner. Prevent migration of dust, soil, and debris outside of the work area. At the end of each work day, leave the site clean and free of hazards. The Contractor is responsible to install and maintain all temporary barriers necessary to protect the site, the owner, and the public. 7. Verify location of existing above- and below-ground utilities and services and protect from damage. Repair utilities damaged during work at the Contractor’s expense. 8. Do not scale drawings. 9. Perform all work below the top of the Coastal Bank, including excavation and movement of materials, by hand. The contractor is responsible for erosion control and for the prompt protection of open soil and restoration of vegetation. 10. Dear Darcy and Ed, On November 2, 2022, we had a meeting at 309 Bay Lane way to discuss the extension of the elevated walkway along the lower portion of the site. While designing on site we came to the conclusion it is going to be very difficult to design without the removal of a pitch pine located on the site plan. Below are three photos of the visible damage from what appears to be the Black Turpentine Beetle (Dendroctonus terebrans). The third image also shows the exposed root system along the base that would inevitably lead to the tree succumbing to the erosion happening along this portion of the bank. I believe the pitch would be necessary to remove as the damage appears to be minimal, but the tree is clearly infected and will decline quickly and become a clear problem. Below is a report outlining the reasoning for the removal of the tree, as it pertains to the proper eradication of the insect. ELS proposes that this be presented to the Conservation Commission to be sure they have     Page 2 of 2   the available information before making a final determination as to whether the removals serve as the best environmental practice for the site. ELS conducted a site visit on March 13, 2023. There we discussed the possibility of the proposed extension to the boardwalk. While on site minor damage to the bark from boring could be observed on all the pitch pine (See Photos 1-3). Although minor, the damage to the bark shows that the infestation has spread throughout the tree. The reason for the request for removal of all trees is that first, the inevitable decline of the three additional trees would pose a threat to the proposed construction. Rather than requesting the removals once the trees have been compromised, we are requesting to do so now. While noting the importance of canopy trees within the buffer zone the client has agreed to mitigate for the removals in a 2:1 ratio in the form of two (2) Eastern Red Cedar (Juniperus virgininana), that appear to be thriving on site. The Umass Extension’s Black Turpentine Beetle Management protocol summaries the treatment of the black turpentine beetle as follows “Black turpentine beetle prefers weakened or damaged pines but is also capable of attacking healthy trees. Prevention is an important management strategy to reduce attack. Drought and storm damage can cause widespread stress, making trees susceptible to attack. Other stresses that can increase chance of attack include mower damage, string trimmer damage, pruning during insect activity, soil compaction, and excavation. Cultural practices should focus on keeping pines stress free and growing rapidly. Damaged or declining trees should be removed quickly so as not to further attract black turpentine beetles to the area” 1 In summary, the removal of the tree proposed is a measure to limit the spread of the insect, and adequate measures have been put in place to mitigate the removals to ensure wildlife habitat be sufficient in the area following construction. We are seeking permission to remove the tree and are open to discussion regarding proper mitigation measures.
