Please contact the Conservation Division at 508.862.4093 for assistance. The meeting was called to order at 6:30 p.m. by Chairman Dennis Houle. Also attending were Vice-Chairman Tom Lee and Commissioners John Abodeely, Peter Sampou (left at 8:30 p.m.), and Scott Blazis. Commissioners Larry Morin and Louise Foster were away. Rob Gatewood, Conservation Administrator, assisted. The meeting was held in the Hearing Room, Barnstable Town Hall, 367 Main Street, Hyannis, MA. I MINUTES FOR APPROVAL The Chairman discussed the process for amending minutes in public. A. July 31, 2012 A motion was made to approve the minutes of 7/31/12, as amended. Seconded and voted unanimously. One commissioner abstained from the vote.. B. August 7, 2012 A motion was made to approve the minutes of 8/7/12, as amended. Seconded and voted unanimously. C. August 14, 2012 A motion was made to approve the minutes of 8/14/12, as submitted. Seconded and voted unanimously. D. Executive session minutes – process update The Chair announced that he was doing a periodic review of executive session minutes, as required by open meeting law. II REQUESTS FOR DETERMINATION 40 Crossway LLC. Seek approval for 50-foot wall extension; lawn expansion; addition of loam/seed/irrigation; vista pruning at 160 Peppercorn Ln., Cotuit as shown on Assessor’s Map 004 Parcel 011. DA-12066 The applicant was represented by Ted Kommenda. A photograph was submitted and noted as Exhibit A. A motion was made to issue a negative determination. Seconded and voted unanimously. Barnstable Land Trust. Construct 14-foot footbridge to span open culvert, constructed of pressure-treated lumber; bridge to have handrails and be handicapped-compliant at 0 Fox Hill Rd., Centerville as shown on Assessor’s Map 190 Parcel 046. DA-12068 The applicant was represented by Red Banfield. A motion was made to issue a negative determination. Seconded and voted unanimously. Commonwealth of MA Dept. of Fish & Game and Town of Barnstable. Replace nine existing float piles at 307 Millway, Barnstable as shown on Assessor’s Map 301 Parcel 064. DA-12064 The applicant was represented by Doug Cameron, Assistant Director of MA Department of Fish & Game. A motion was made to issue a negative determination. Seconded and voted unanimously. Brenda Haynes & Adam Koppel. Maintain existing path to water and maintain existing vegetation between road and water at 1664 Main St., Cotuit as shown on Assessor’s Map 017 Parcel 016. DA-12065 The applicant was represented by Peter Hansen. A motion was made to continue the hearing, at the applicant’s request, to September 11. Seconded and voted unanimously. Michael A. Barnfield. Upgrade septic system at 233 Bay Ln., Centerville as shown on Assessor’s Map 166 Parcel 056. DA-12067 The applicant was represented by John O’Dea, P.E. The proposed plan was displayed and noted as Exhibit A. A motion was made to issue a negative determination. Seconded and voted unanimously. III NOTICES OF INTENT May & James L. Tung. Revise drive, parking, garage, entry; reorganize decks, patios & pergolas, fire pit, water feature, pathways; remove invasives; replace trees; plant mitigation; beach maintenance at 222 Hayes Rd., Centerville as shown on Assessor’s Map 211 Parcel 030. SE3-5025 The applicant was represented by Arlene Wilson, P.W.S. The proposed plan was displayed and noted as Exhibit A. A motion was made to approve the project with special conditions: Require a revised plan Water feature to be removed Remove asphalt at gate Provide turn-around at gate of applicant’s property Tree to be removed in consultation with staff Replacement tree (type and placement) in consultation with staff Allow small light as gate area No plowing of snow into lake Upon receipt of letter from Natural Heritage and Endangered Species Program, NHESP conditions to be incorporated into the decision. Construct single-family residence with attached garage and raised exterior patio; replace access stairs to Neck Pond; mitigation plantings at 30 Lewis Ln., Osterville as shown on Assessor’s Map 139 Parcel 094. SE3-____ The applicant was represented by Peter Hansen. A short discussion ensued. A motion was made to approve the project with special conditions. Seconded and voted unanimously. M6 Cape Trust c/o SCS Financial Services, LLC. Raze existing house; construct new house, pool, pool patio and landscaping at 90 Kearsarge Ave., W. Hyannisport as shown on Assessor’s Map 225 Parcel 020. SE3-____ The applicant was represented by Stephen Wilson, P.E. and Kris Horiuchi, R.L.A. The proposed plan was displayed and noted as Exhibit A. The proposed landscaping plan was displayed and noted as Exhibit B. A letter from abutter Lucinda Sanders was received and noted as Exhibit C. Elevation views were submitted and noted as Exhibit D. Considerable discussion followed. A motion was made to approve the project with standard conditions, as specified. Seconded and voted unanimously. IV CONTINUANCES Laura Trust, Tr./183 Bay Street Realty Trust. Proposed 15-ft. ramp and 8' x 16' float for existing permitted dock at 183 Bay St., Osterville as shown on Assessor’s Map 117 Parcel 152. SE3-5005 The applicant was represented by Attorney John Kenney and Bradley Bertolo, P.E. The proposed plan was displayed and noted as Exhibit A. A motion was made to approve the project with special conditions, specifying the following: A 210 Montauk with 150 hp providing 32” of water column separation; The nearby sunken vessel to be removed, in consultation with the town harbormaster. Seconded and voted unanimously. David Rosengard. Construction of hard-surface tennis court; grading; restoration plantings; pea-stone driveway; stabilization of existing steep slope with timber terracing; maintain existing paths as 41 Weaver Rd., Centerville as shown on Assessor’s Map 207 Parcel 106. SE3-____ A motion was made to continue the hearing, as requested by the applicant, to September 11. Seconded and voted unanimously.
