Chanter 66 Section 10 Request 1450 Osterville Road West Barnstable Road#A Osterville MA Ma /Parcel 127-007-001 & Ma /Parcel127-036 Dear Mr. Ford: This confirms that the Building Department is in receipt of your public records request dated June 7, 2023. An extension of 15 additional business days was entered and a response date of July 13, 2023 is reflected. Your request is as follows: "[AJny and all records, documents, emails, letters, photographs, videos, and any other correspondence in the town's Building Department files for the property located at 1450 Osterville West Barnstable Road and 1450 Osterville West Barnstable Road #A, Osterville, MA dating from July 8`h, 2016 to the present. Including without limitation, any and all communications, emails, letters, photographs, videos and complaints, from the abutting neighbor Kenny Lacasse, who is specifically named in the violation letter from July 8`h, 2016, to the present." Please be advised that the Building Department and Information Technology ("IT") Department have already begun searching the records requested, however, your request is very broad in terms of time period and is also vague in that no subject matter or key words are identified in the 7 year period for which you seek documents, therefore the search to date is turning up a large amount of records, some of which may not be responsive to your request. Finally, you seek documents "from abutting neighbor Kenny Lacasse" but do not narrow the individual(s) to whom such correspondence may have been sent. Enclosed are documents maintained in the files of the Building Department that are responsive to your request. In addition, there may be responsive emails or other responsive documents, but the time period and subject matters need to be narrowed for this not to be an overly-broad and unduly burdensome request for our IT department. Please provide me with a narrower description of the types of documents you are seeking by providing email subjects and/or search terms for topics of information that you want. If you can also narrow your timeframe that would be helpful to our IT department in finding documents that are responsive to your request. Finally, please narrow the identities of recipients of communications from"Kenny Lacasse" so we more easily find documents responsive to your request. Once we have received a more narrowly-tailored request we can provide you with a cost estimate for searching for and producing responsive records. Please be advised that pursuant to 950 CMR 32.00 and G.L. c. 66, Section 10(a) you have the right to appeal this decision to the Supervisor of Public Records within 90 calendar days. Such appeal shall be in writing, and shall include a copy of the letter by which the request was made and, if available, a copy of the letter by which the custodian responded. Pursuant to G.L. c.66, section l0A(c), you also have the right to seek judicial review by commencing a civil action in the Superior Court.
