HomeMy WebLinkAboutCape Cod Community College Land Transfer Overview July 2023Page 1 of 3 CAPE COD COMMUNITY COLLEGE APRIL 19, 2023 Overview of Land Transfer between Commonwealth of Massachusetts’ Entities on the Campus of Cape Cod Community College Cape Cod Community College (CCCC) has been working closely with the Division of Capital Asset Management and Maintenance (DCAMM) to finalize the process of reallocating control over 21.24 +- acres of land adjacent to parking Lots 3 and 4 from the MA Department of Transportation (MassDOT). This work had commenced in 1990 but was never concluded. The College has been working with DCAMM Leadership to complete the process. The four final steps are: • an Environmental Records Review; • updated Title Search; • completion of a Delegation of Control Agreement; and, • the Transfer Document from MassDOT to DCAMM. Once the property is acquired by DCAMM, responsibility for control will be delegated to the College. The status of the four final steps include: first is the review of the Environmental Record on the land to be transferred. This review included any filing from an environmental standpoint on the land. The land is in its natural state and no environmental records were found. Second, is an update of the Title Search. One of the first early steps in the process was to complete a Title Search which showed that a transfer had been commenced but not completed between Cape Cod Community College via the predecessors of DCAMM and MassDOT. An update of the records since the completion of the Title Search is underway and should be completed shortly. The third step and basis for the Board of Trustees’ recent action was to implement an agreement entitled Delegation of Control Agreement. The essence of this Agreement is simply that DCAMM delegate’s responsibility for the said parcel to Cape Cod Community College. As an institution, we have separate statutory authority under which we operate. This agreement makes CCCC responsible for the property. For the record, the College has been maintaining the property and believed that it was under the College’s control based on public records available through the Town of Barnstable Assessing Division property records Map/Block/Lot: 236 / 005/ B00. Once the Title Search has been updated and with the Board of Trustees’ Delegation of Control Agreement complete, the final stage of the Transfer Agreement is scheduled to be executed. This process was reinitiated most recently to ensure the responsibility of the property was legally reflected under DCAMM with the College delegated control. Historically, the College has operated as if the land under review has been the responsibility of the institution. We have continued to maintain trails and open space for field research and recreation. While there are no current plans to change the use of the property, the College may conduct a future planning review of the options and feasibility of other uses.
