GLADSTONE SECRETARY COMMISSIONER April 19, 2023 Councilmembers Barnstable Town Council 367 Main Street Hyannis, MA 02601 RE: Notice to Governmental Bodies in Affected Areas of Proposed Action Concerning Real Property Dear Councilmembers: Pursuant to G.L. c. 7C, sec. 37 (copy enclosed), this letter is to notify you that the Division of Capital Asset Management and Maintenance is acquiring 21.24± acres of real property located adjacent to Cape Cod Community College and abutting Route 6, in Barnstable, Massachusetts from the Massachusetts Department of Transportation and delegating responsibility for control to Cape Cod Community College. The Premises are currently undeveloped, landlocked and contain walking trails. Cape Cod Community College intends to use the Premises as is and to conduct a planning exercise to inform the feasibility of other uses or subsequent disposition. Any disposition would require legislative authorization. Section 37 requires that notice be provided to governmental bodies in the affected area at least 120 days prior to any purchase, sale, rental, lease, transfer, or change in use of one or more acres of real property owned by the Commonwealth on behalf of state agencies. This notice is intended to satisfy the requirement of the statute. There is no required action on your part, however, the notice period may be reduced from 120 days with the agreement of certain public officials. This letter requests your agreement to a reduction of the 120-day notification period to 30 days from the date of this notice and your confirmation of such agreement by completing and returning the attached waiver. This is permitted under G.L. c. 7C, sec. 37 and will allow DCAMM to proceed with the acquisition without delay. A public Hearing will be held on May 3, 2023, at the Lorusso Technology Building, Cape Cod Community college, Room 114, to provide the public an opportunity to comment. Thank you for your assistance.
