Boselli 183 Bay Street, Osterville MA Map 117 Parcel 152 The project site is located at 183 Bay Street abutting North Bay consisting of approximately 1.5 acres of land with approximately 129 linear feet of frontage to North Bay. Presently, the site is developed with an existing single-family dwelling, pool cabana (under construction SE3-6002), pool (under construction SE3-6002), shed, permitted and licensed pier (SE3-3396), kayak platform (SE3-4586), Ramp & Float (SE3-5005), and all associated appurtenances. The project as proposed is to permit and maintain the expansion of the existing float. A separate future Notice of Intent is being filed for the wetland restoration similar to the abutters’ filing at 209 Bay Street. Under SE3-5005 a new ramp and float was revised during the permitting process and approved as a 8x16’ float. At the time concerns were raised about the proximity of a mooring float located in the area. Since the permitting, the mooring float has either been removed or relocated and the navigation concerns should no longer be an issue. The project has been brought before the waterways committee without any objections. The existing float is considerably smaller than the allowed 200sf float allowed under current pier regulation standards. This project will keep the 30” requirement for the boats and a sign will be placed on the pier stating the allowed boat. The previously approved pier, ramp, and float (SE3-5055) extend 40’ from Mean Low Water which will not change with the proposed float. The proposed pier will extend no closer to the channel than the neighboring structures and provides over double the required separation with 90’ from the float to the edge of channel. Although we believe the float replacement is not a substantial improvement, the pier, ramp and float as proposed is fully in compliance with the Town of Barnstable Conservation Chapter 703 Regulations for Private Docks and Piers except for not being in the middle of the lot. This is due to the brackish marsh/ bordering vegetated wetland. *Additional information provided as part of the revised Narrative. PERFORMANCE STANDARDS: Land under the Ocean: The proposed pier will not affect or change the land under the ocean’s ability to provide protection for storm damage prevention. The project will not have a significant negative effect on water quality, distribution of grain size sediment, or water circulation as required by 310 CMR 10.25(6). Land Containing Shellfish: The proposed pier will not have a negative impact on the water circulation, relief elevation, distribution of the sediment grain size, or natural drainage from adjacent land, or result in the compaction of the land by vehicular traffic, or change the water quality so as to change the productivity of the Land Containing Shellfish as required by 310 CMR 10.34(4).
