The purpose of this project is to update the existing tennis facility, protect it from flooding caused by coastal storm surges and sea level rise, and include a pickleball court. March 2022 Page 1 CHAPTER 707 Regulation Governing Minimum Submission Requirements for a Notice of Intent Application The Barnstable Conservation Commission has adopted the following requirements in order to obtain more consistently complete submission documents necessary for a thorough and efficient review of all Notice of Intent (NOI) applications. Failure to complete any of the items in this checklist may result in your application being denied. Applicant or applicant’s agent should check each box denoting that the task has been completed or in certain instances, like field staking, denoting that the task will be completed. The following submission checklist covers the requirements of Chapter 237, Wetlands Protection, of the Part I General Ordinances of the Code of the Town of Barnstable. This checklist shall be submitted to the Barnstable Conservation Division with the NOI application. 1. Requirements a. The applicant understands, unless they’ve instructed otherwise, they are applying both under the Massachusetts Wetlands Protection Act M.G.L. c.131,§40 and Chapter 237 of the Town of Barnstable General Ordinances. b. Attach a written narrative to the NOI application (WPA Form 3), available at: www.mass.gov/eea/agencies/massdep/service/approvals/wpa-form-3.html describing any project impacts and proposed mitigation as they relate to the following: 1) Any of the interests of Chapter 237 of the General Ordinances and the MassDEP Wetlands Protection Act M.G.L. 131, §40. 2) The performance standards contained in the MassDEP Wetlands Protection Regulations (310 CMR 10.00) 3) Chapter 704: Regulation Governing Activity in the 100-ft. Buffer Zone. 4) Chapter 703: Private Docks and Piers. 5) Any other applicable regulations (310 CMR 10.00 or as promulgated under Chapter 237 of the General Ordinances). c. For projects requiring mitigation plantings under Chapter 704 -3, 704-4, and 704-5, mitigation planting location(s) shall clearly be shown on landscaping planting plan. The planting plan shall include species list (chosen from the Town of Barnstable Conservation Commission approved planting lists), sizes, densities and/or quantities. The plan shall also provide area calculations between 0 to 50 and 50 to 100 separately for the amount of mitigation planting required, and the amount of mitigation planting proposed. e. Provide detailed, written street directions to the locus (site). f. Provide a copy of a U.S.G.S. locus map indicating the general area of the project site. g. Provide a check for the Town of Barnstable portion of the required filing fee. (The portion payable to the Commonwealth, see 7. e. below) h. Provide any other documentation, photographs, architectural renderings or other supporting data prepared by professionals competent in t he field which may be relevant to the application. 6. The site plan shall also show: a. All existing and proposed contours at 2-ft. minimum intervals (1-ft. preferred). b. Clear delineation of all existing and proposed structures and features. Building structures must be accurately dimensioned (fixed location) from property lines and wetland resource a reas. Plans shall provide sufficient detail to show all potential wetland impacts, mitigation, compensatory areas, engineered structures, utilities, landscaping, etc. within the area of jurisdiction. On complicated sites, existing and proposed conditions must be shown on separate sheets. c. Locus inset map of the site clearly showing its location relative to surrounding public streets. d. All wetland resource area flags by individual flag number (matched to the field) to clearly identify all resource areas on or within 100 feet of the work area. The individual who performed the flagging and date of flagging shall be identified on the plan next to the resource line. e. Section views showing changes in grade, cuts and fills. 7. SUBMISSION OF THE COMPLETED APPLICATION WITH PLANS: a. Provide a signed Permission to Access Property, Form PA. The form must be signed by the property Owner, or legal representative and submitted prior to NOI being docketed and application advertised . Notice of Intent Hyannisport Club Hyannisport, Massachusetts PROJECT DESCRIPTION 1.0 INTRODUCTION The Hyannisport Club (the Club) is proposing to increase the base elevation of the existing six (6) tennis courts, install subsurface drainage systems under the tennis courts, install four (4) new pickleball courts in the existing gravel parking lot, install a new Title V septic system, and install a new parking lot. The purpose of this project is to protect Hyannisport Club assets from flooding caused by storm surge and sea level rise. In addition, the current on-site sewage disposal system that serves the Tennis Club is inadequate for the proposed facility. For more information, please refer to the attached Site Plans. This application is being submitted in accordance with the Massachusetts Wetlands Protection Act and the Town of Barnstable Wetlands Protection By-law. 2.0 SITE DESCRIPTION The property located off Marston Lane contains the Hyannisport Club Golf Course and Tennis Club with tennis pro shop, seating, parking, and tennis courts. The Site contains the gravel parking area with a shed, tennis courts, stands, decks, and pro shop building abutting the golf course and golf course maintenance facility. The wetland resource areas and areas of conservation jurisdiction on or adjacent to the Site are protected under the Wetlands Protection Act and the Town of Barnstable’s Wetland Protection Bylaw include: • Land Under Ocean (Halls Creek) • Salt Marsh • Bordering Vegetated Wetland (BVW) • Coastal Bank • Riverfront Area associated Hall’s Creek; Tidal (RFA) • Land Subject to Coastal Storm Flowage (Zone AE, El. 13) 3.0 PROPOSED ACTIVITIES The purpose of this application is to authorize the following proposed activities: New Tennis Courts – The proposed project consists of increasing the base elevation of the existing tennis courts by approximately 3 feet. There will be no change to the footprint of the tennis courts. The tennis courts are partially located within the 200’ Riverfront Area and within the 100’ buffer zone to wetlands. However, as mentioned above the new tennis courts will be in the same footprint as the existing tennis courts so no new disturbance will result from the new courts. Raising the elevation of the courts will improve the resiliency of the Site thus protecting newly installed courts for future generations. Additionally, a large subsurface drainage system (CULTEC) will be installed beneath the courts to improve stormwater treatment on Site. Trench drains will also be installed along the southern edge of the courts and an infiltration basin will be added at the western end of the courts. These features will significantly improve stormwater management on Site and can only be installed if the courts are raised in elevation. New Pickleball Courts – Four new pickleball courts are proposed on Site as well. There is an open order of conditions (SE3-5544) for the Hyannisport Club to construct additional tennis courts overtop of the existing gravel parking area to the east. The Hyannisport Club is now proposing to install four pickleball courts in the same footprint as the approved tennis courts and parking area. A subsurface drainage system (CULTEC) is proposed beneath the pickleball courts, along with a trench drain along the southern edge of the courts. The new pickleball courts are proposed within the 200’ Riverfront Area and within the 100’ buffer to wetlands. However, as Notice of Intent Hyannisport Club Hyannisport, Massachusetts mentioned above the Hyannisport Club has an open OOC to construct tennis courts and parking area in this location. Switching the purpose of the courts from tennis to pickleball will not increase the overall impact footprint compared to the already approved tennis courts and parking area. New Parking Lot – A new parking lot is proposed to the east of the new pickleball courts within an area of existing maintained lawn. Another subsurface drainage system is proposed beneath the new parking lot. This will help capture and treat stormwater runoff from the parking lot. The proposed parking lot is located within the 50-100’ buffer to wetlands. However, the new parking lot is proposed within an area of maintained lawn, so no vegetation clearing is required. The FEMA Flood Zone in this location is elevation 12, as such a portion of the proposed parking lot will fall within Land Subject to Coastal Storm Flowage. New Title V Septic System – Due to the increase in number of tennis and pickleball courts the existing septic system for the tennis pro shop needs to be upgraded. As such a new Title V septic system is proposed. The septic tank and leaching field are entirely located outside of conservation jurisdiction but the pipe that connects the pro shop to the septic tank will pass through the local 50’-100’ buffer zone to top of coastal bank. The existing septic system will be pumped, filled, and abandoned. Please refer to sheet C-101 of the project plans for a table of impacts to jurisdictional resource areas and additional project details. 4.0 ALTERNATIVE ANALYSIS Alternative analysis for this project consists of: “No-build” Option: The “No-build” option would leave the proposed project area as-is. The existing tennis courts would remain at a lower elevation and be subjected to potential flooding more frequently which would damage the courts and render them less resilient. The subsurface drainage systems, trench drains, and infiltration basin would not be installed and therefore stormwater management on Site would not be improved. The existing courts are aging and in need of replacement, a no build option would eventually render the courts not usable. This would not meet project goals or improve the environment. “As Proposed” Option: The “As Proposed” option will allow the construction of new tennis courts, pickleball courts, septic system, and parking lot. This will improve the function of the Site as a recreational facility for the Hyannisport Club. The proposed project will significantly improve stormwater management on Site. The upgraded septic system will reduce nitrogen leaving the Site and the upgraded septic system will be located further from wetland resource areas than existing. This is option is best suitable as it meets the needs of the Club, while causing minimal new disturbance. In addition, it provides an overall environmental betterment, while minimizing new impacts. “Over-build” Option: The “Over-build” option would include additional clearing and grading to expand the parking facilities. The expanded parking option was considered but reduced to what the course felt was the minimum needed for this project. This option would disturb additional resources areas and buffer zones that are unnecessary to obtain the needs of the course. Additional parking is only needed a few times a year for larger tournaments. The Club can utilize Notice of Intent Hyannisport Club Hyannisport, Massachusetts existing parking around the facility to accommodate the overflow when needed. As such, this option would exceed the Club’s needs and the parking area size was reduced. 5.0 MITIGATION To mitigate for impacts within the 0-50-foot Buffer Zone to BVW, 3,284 sf of mitigation planting area is proposed near the parking area in the northern edge of the Site. This mitigation planting areas will include 23 Eastern Red Cedars (Juniperus virginiana) and 33 inkberry shrubs (Ilex glabra). All plants installed are to be a minimum of 1 gallon in size, and/or sized per the Conservation Commissions requirements. Please see the proposed plan for mitigation planting area for more information. Roll-off containers will be located in the existing parking lot and used to remove all debris from the Site. Any debris getting into the wetland will be removed by hand, as needed. A line of erosion controls will be installed between the limit of work and the adjacent resource areas. Work will be scheduled for the fall when activity at the course and courts is reduced. Please note that the applicant is committed to mitigate impacts and to improve the protection of buffer zones to natural resource areas throughout the property. As part of other projects, the Hyannisport Club has mitigated over 6 acres of maintained turf lawn to expand buffer zones and Salt Marsh to compensate for anticipated sea-level rise whenever possible. Historically, the applicant has not delayed naturalizing areas of the course to gain a credit for the associated restoration (tying it to a proposed new project). This mentality is part of the organization’s drive to maintain the natural resource areas surrounding and within the property boundaries.
