The regularly scheduled Barnstable Licensing Authority Public Meeting was called to order at approximately
9:30a.m. on Monday, June 12, 2023 and was held at Barnstable Town Hall, 2nd Floor Hearing Room, 367 Main
Street, Hyannis.
Members Present: Larry Decker, Clerk; John Flores, Nancy Karlson-Lidman
Members Absent: David Nunheimer, Vice Chair; Max Mitrokostas
Staff Present: David Anthony, Director of Asset Management; Consumer Affairs Officer Chris Kelsey;
Erin Logan, Interim Deputy Director of Asset Management and Licensing
PUBLIC COMMENT – There was no public comment made.
NEW BUSINESS
1. (3) New Special One Day Licenses (SPEV-23-31, 39 & 40) – Beer Only
Three applications were filed by Cape Cod Maritime Museum, 135 South Street, Hyannis, to hold “History
on Tap”, a series of living history demonstrations with samples of local breweries to be held on: July 7,
2023 from 5 p.m. to 6 p.m., beer will be poured by Devil’s Purse; July 14, 2023 from 5 p.m. to 6 p.m., beer
will be poured by Cape Cod Beer; July 28, 2023 from 5 p.m. to 6 p.m., Bad Martha Beer will be pouring
the beer.
Sarah Murphy was present and described the events as historic demonstrations with beer being
served by local breweries.
MOTION: Karlson-Lidman moved, seconded by Flores, to approve this application as submitted.

2. New Special One Day License (SPEV-23-52) – Beer, Wine & Entertainment
An application was filed by Calmer Choice Cape Cod, 23F West Bay road, Osterville, for “Calmer Choice
Jukebox Dance” to be held at 145 Winter Street, Hyannis. Cape Cod Package Store will pour the beer and
wine.
There was no representation present.
MOTION: Karlson-Lidman moved, seconded by Flores, to approve this application as submitted.

3. (2) New Temporary Extension of Premise (SPEV-23-56 & 57)
Two applications were filed by King’s Grant Racquet Club Inc. dba King’s Grant Racquet Club, 12 Old Kings
Road, Cotuit for a temporary extension of premise onto the lawn of the licensed premise on the

following dates and times: 50th Anniversary Celebratory Clambake, on July 15, 2023 from 4 p.m. to 10
p.m. and “Cotuit Mosquito Yacht Club Fundraiser” on July 22, 2023 from 4 p.m. to 10 p.m.
Courtney Keyser was present to represent the applications. This is an extension of the current alcohol
license. Decker confirmed with Keyser that all pourers will be TIPS certified.

4. Amend Annual Wine & Malt Package Store License
An application was filed by MPG Corporation dba Garrett’s Family Market, 1617 Barnstable Road,
Centerville, to amend the licensed manager from Jasmine Kessie to James Couture.
James Couture and Megan Jacobs were present to present the application. Mr. Couture is currently the
District Manager for Garrett’s Family Market. Decker confirmed with Couture that once the proposed new
manager finishes up his training, he will take over. Karlson-Lidman confirmed that Couture has been trained
for three months (about 50 hours of training per week)

5. Amend Annual Club All Alcohol License
An application was filed by Hyannis Lodge #1549 B.P.O. Elks dba Hyannis Elks, 852 Bearse’s Way, Hyannis,
to amend the licensed manager from Richard J. Walker to Patrick Anastasia.
Donnie Desmaries is present on behalf of the Hyannis Elks; he holds and officer position. They did not renew
the contract of the last liquor manager. Anastasia is TIPS and BAP certified; he has worked at Luke’s Liquors.
MOTION: Karlson-Lidman moved, seconded by Flores, to approve this application as submitted.

6. Amend Annual Club All Alcohol License
An application was filed by The Tavern on the Fairway, LLC dba Tavern on the Green, 1460 Rt, 149,
Marstons Mills, to amend the licensed manager from William T. Hensley to Jill Jenkins.
Jill Jenkins was present to represent this application. Jenkins was a bar manager at a previous
establishment. Mr. Hensley will no longer be the establishment 40 hours per week which is why Jenkins will
be taking over.
MOTION: Karlson-Lidman moved, seconded by Flores, to approve this application as submitted.

7. Amend Annual All Alcohol Common Victualler License
An application was filed by Prova Brazil Steakhouse, LLC dba Torino Restaurant & Bar, 415 Main Street,
Hyannis, to amend the hours of operation on Sunday evenings from a 12 a.m. closure to a 1 a.m. closure.
Attorney Kenney is present to represent this application. He noted there was confusion as to the hours of
operation. Looking to be consistant with other establishments on Main Street, he has submitted this
application to change the closing hours on Sunday. Kelsey noted that in 2006 the town bylaws were
amended to implement a 1am-3am closure of all businesses. Kelsey proposed changing closing time in the
future. Kenney is asking for 1am closure. The reason for the change has passed and we need to look at the
fact that we are resort community. Flores suggests staying consistent and would like to see a 1am closing
time. Kelsey noted for the record that the bar managers are pushing back. Decker would ask that owners aim
for last call at 1245am.

8. Amend Annual All Alcohol Common Victualler License
An application was filed by Macaab, Inc. dba B&B Pizza, 10 Seaboard Lane, Hyannis, to amend the hours
of operation on Sunday evenings from a 12 a.m. closure to a 1 a.m. closure.
Christian Boutiette is present. He proposed to extend Sunday night closing time.

9. Amend Annual All Alcohol Common Victualler License
An application was filed by C & D Shamrock, Inc. dba 19th Hole, 11 Barnstable Road, Hyannis, to amend the
hours of operation on Sunday evenings from a 12 a.m. closure to a 1 a.m. closure.
Dave Cronan was present. He proposed to extend Sunday night closing time.
MOTION: Karlson-Lidman moved, seconded by Flores, to approve this application as submitted.

10. New Temporary Extension of Premise (SPEV-23-82)
An application was filed by Bread & Roses Bookshop and Café, Inc. dba Bread & Roses, 302 Main Street,
Hyannis for a temporary extension of premise at 284 Main Street, Hyannis, on July 7, 2023 from 5 p.m. to
8 p.m. for the First Friday’s event.
Ryan Ralston was present. Ralston advised that Bread & Roses would like to take park in the First Fridays
event by serving pre-packaged beer and wine. They have a full liquor license. Flores asked how the alcohol
will be contained. Ralston advised that no one will be permitted to leave the site with alcohol. Bill Ferrell of
Hyannis Film Festival was present and noted this is not meant to be a drinking event. Flores asked about
police detail.

PUBLIC HEARINGS
1. Amend Seasonal All Alcohol Common Victuller License – Alteration of Premise
An application was filed by Spanky’s Clam Shack, LLC dba Spanky’s Clam Shack & Seaside Saloon, 138 Ocean
Street, Hyannis for an alteration of premise to reduce the total number of seats from 161 to 155. New
premise description to read as follows: One story wood frame building with four entrances/exits & two
sliding-glass door emergency exits; 700 sqft kitchen, main dining room, bar area, and front breakfast area for
a total of 115 indoor seats. Outdoor patio with seating for 40. Total number of seats indoor and outside is
155. Total building approximately 4,000 sqft.
Jeff Spillman and Billy Moore were present. The number of seats on the alcohol license did not match the
Board of Health so they were present to bring their floor plan into compliance.

1. Renewal - Special One Day License (SPEV-23-78) – Beer & Wine
An application was filed by Historical Society of Santuit & Cotuit, 1148 Main Street, Cotuit, to hold “Taste
of Cotuit” event on July 22, 2023 from 6 p.m. to 9 p.m. Beer & Wine to be poured by Stephen Hemberger.
2. Renewal - Special One Day License (SPEV-23-55) – Beer, Wine & Entertainment
An application was filed by Centerville Public Library, 58 Main Street, Centerville, to hold “Summer
Celebration”, an annual fundraising event including a 4-piece band and beer & wine service, on August 5,
2023 from 5:30 p.m. to 8:30 p.m. Beer poured by Cape Cod Beer; Wine to be poured by Cape Cod Package
Store.
3. Renewal - Special One Day License (SPEV-23-47) – Beer, Wine & Entertainment
An application was filed by Love Live Local, 539 South Street, Hyannis, for the annual “Love Local Fest” to
be held at Aselton Park, Hyannis on September 24, 2023 from 10 a.m. to 4 p.m. Entertainment to include
live amplified music. Beer & Wine poured by The West End.
4. Renewal - Special One Day License (SPEV-23-41) – Entertainment Only
An application was filed by Dance Designs, 350 Kidds Hill Road, Hyannis, to hold “Onstage 2023”, on June
17, 2023 from 2 p.m. to 6 p.m., at the Barnstable Performing Arts Center, 744 West Main Street, Hyannis.
This is a live performing arts (dance recital) event.
5. Renewal - Special One Day License (SPEV-23-77) – Entertainment Only
An application was filed by New Life Ministries Inc., 58 Corporation Street, Hyannis, to hold “Praise Fest
2023”, an annual live performing arts (live gospel music) event to be held at Barnstable Performing Arts
Center, 744 West Main Street, Hyannis on July 23, 2023 from 7:00 p.m. to 10 p.m.
6. Renewal - Special One Day License (SPEV-23-79) – Entertainment Only
An application was filed by Cotuit Library Association, 871 Main Street, Cotuit, for “An Evening of Jazz”, at
Lowell Park, 10 Lowell Avenue, Cotuit, on August 24, 2023 from 4:30 p.m. to 6 p.m. Entertainment to
include live, amplified music.
7. Renewal - Special One Day License– Entertainment Only
21 applications were filed by Cape Arts & Entertainment (Cape Symphony), 2235 Iyannough Road Route
132 West Barnstable, for the following events to be held at the Barnstable Performing Arts Center, 744

APPROVAL OF MINUTES – no minutes for approval
LICENSING UPDATES
Hyannis Business Improvement District - Elizabeth Wurfbain was present and provided an update to the
First Friday’s events. The event was fairly successful. She hopes the event will bring people to Main Street to
shop and eat.
POLICE DEPARTMENT UPDATES
Officer Kelsey noted that the summer is going to be busy. They have dealt with several issues at nightclubs
and bars. The ABCC has also been out and found issues. Kelsey asks the authority to please take action on
any items that are bought before them.
