Atty. Richard C. Anderson represented the petitioner who seeks a special permit
to allow the construction of a 20-unit motel building at Main Street and
High School Road, Hyannis in a business and residence B-1 zoned district. This
new structure would be located on a two-acre parcel of land on which there now
exists a motel building containing 52 units. The 20 motel units as proposed, would
create a total of 72 motel units in two separate buildings. Atty. Anderson presented
a plan to the Board showing the location of the existing motel and the proposed
motel building. Application is made under Sec. P. (4) of the zoning by-laws which
permits construction of a new building to extend the non-conforming use on the same
lot. The existing motel has a non-conforming use inasmuch as it intrudes into the
residence B-1 district beyond the allowed 30 ft. A prior application for apartment
use on this lot was withdrawn since this would have created two uses differing in
use on the same lot which is not allowed under the zoning by-laws and would have
required the granting of a variance. The present request is for a special permit
to extend a non-conforming use and all of Section N. (Wotels) which lists the re-
quirements for this type of use, will be conformed to. Site coverage will be 28%
and the distance from the grade to the top of the roof of the new building would be
30 ft. The petitioner will provide 91 on-site parking spaces and the facade of the
new structure will be identical to the existing motel building. Jim Pendergast,
owner of this property, has allowed parking by the Catholic Church parishioners at
the site of the proposed motel building for more than 25 years and will continue
to allow this parking use in the off-season months. The. petitioner would provide
plantings on the easterly side of High School Road to diffuse head light glare
from penetrating into 'the Ratfield property. In addition, a living. fence of suit-
able natural plantings could be installed abutting Dr. O'Neil 's property on South
Street in order to shield the new motel building from his view. A land court bound
which is now missing between the Pendergast property and the O'Neil property will
be replaced. Atty. Anderson said that this use would not be detrimental to the
neighborhood and.would allow the petitioner to use this portion of his property in
a reasonable way.
John Rosario spoke in favor of the petition and no one spoke in objection. Atty.
Robert O'Neil, representing his brother Dr. O'Neil, asked that the fence plantings

and the land bound replacement as mentioned by Atty. Anderson, be conditions
of the granting of a special permit for the new motel building. The Board
took the matter under advisement and the hearing was closed.
The Board voted unanimously to grant the petitioner a special permit to allow
the construction of a 20-unit motel building as per plans submitted with the
filing and found that allowing the extension of a non-conforming use on the
same lot as permitted under Sec. P (4) of the zoning by-laws, would not be
detrimental to the neighborhood nor in derogation of the spirit and intent of
the zoning by-laws. The petitioner shall comply with all requirements of
Section N. (Motels & Hotels) and with the following restrictions:
1. A land bound shall be placed between the petitioner's
property and the abutting property of Dr. O'Neil
in accordance with the agreement made at the public
hearing.
2. A fence planting between the petitioner's property
and the abutting property of Dr. O'Neil shall consist
of upright red cedar trees, 5 ft. high at the time of
planting, spaced no more than 6 ft. apart, and this
planting shall take place at the earliest possible
time, weather permitting.
3. There shall be a fence planting identical to the
one between the petitioner's property and Dr. O'Neil 's
property at the southwest corner of the petitioner's
property for the entire distance at which it parallels
the property line of the.Ratfields on High School Road
and which is a distance of approximately 215 ft. t .
This 'planting shall take place at the earliest possible
time, weather permitting, and shall comply with the
requirements of Section I, paragraph 14 - Vision Clearance
Corner Lots.

The Board voted unanimously to allow the petitioner to withdraw without prejudice
in accordance with Atty. Richard Cain's written request.
1980-64 Hyannis Inn Motor Hotel
The Board voted unanimously to allow the petitioner to extend a non-conforming use
on the same lot by permitting the construction of a 20-unit motel building as per
plans submitted with the filing,and found that allowing this special permit under
Section P . . (4) of the zoning by-laws, would not be detrimental to the neighborhood
nor in derogation of the spirit and intent of zoning. This special permit is re-
stricted as follows a land bound shall be placed between the petitioner's property
and the abutting property of Dr. O'Neil in accordance with the agreement made at
the public hearing. Fence planting between the properties of Dr. O'Neil and the
Ratfields shall consist of conically shaped cedar trees to be 5 ft. high at the time
of planting and to be spaced no more than 6 ft: apart. This planting shall take
place at the earliest possible time, weather permitting.
1980-65 Samir Barber
The Board voted unanimously to grant the petitioner a special permit to allow the
construction of a residence/art gallery at Stevens Street and Pleasant Hill Lane,
Hyannis in accordance with the plans submitted with the filing. This special permit
is granted under Section P. (4) of the Barnstable zoning by-laws. The Board found
that the petitioner's proposal would upgrade the neighborhood by replacing an unsound,
decrepit building,with an attractive residence/art gallery. The former use of this
property was residential with varied business uses and the petitioner's use will not
be more detrimental than the prior existing use.
1980-66 Daniel Sullivan
The Board voted unanimously to grant the petitioner a variance in accordance with
the plans submitted with the filing, to construct a 9-unit condominium building on
Pontiac. . . St.. , Hyannis. a portion of which will extend into the residence B zone 8 ft.
on the westerly side of the lot and 10 ft. on the easterly side of the lot. The
parking area will intrude 10 ft. on the westerly side of the lot and 12 ft. on the
easterly side of the lot. The Board found that the shape of this lot, the zoning
restrictions under.Section M. of the zoning by-laws, the highly developed commercial
uses_ in the immediate vicinity-.of the locus,cause this parcel of land to be unuseable
in that portion of the lot 'zoned for single-family residences, for. the purpose for
which it is zoned.. In.addition, the Board found that condominium use i.e. , residential
use, in both the business zoned and residentially zoned portions of this lot would be
far less detrimental than the allowed commercial uses in the business zoned portion
of the property. Therefore, allowing the petitioner a variance for condominium use is
in keeping with-the spirit and intent of the zoning by-laws. Construction shall be
in accordance with.: the 'plans submitted and cited in the decision. Copy of the decision

1980-64 Hyannis Inn Motor Hotel, Inc.
Atty. Richard C. Anderson represented the petitioner who seeks a special permit
to allow the construction of a 20-unit motel building at Main St. and High School
Rd. , Hyannis in a business and residence B-1 zoned district. There now exists
a motel complex on a parcel of land containing approximately two acres and the
petitioner seeks to use the rear portion of this parcel for the construction of
the new motel building. The existing motel bldg. contains 52 units and the 20
units as proposed, would create a total of 72 motel units in two separate buildings.
A plan was presented to the Board showing the location of the present motel and
the proposed 20-unit motel building. Jim Pendergast is the owner of this property,
and is applying under Sec. P. (4) of the zoning by-laws for a special permit to
extend the present non-conforming use on the same lot by either an addition or
construction of a new building and the petitioner's proposed motel building is
allowed.under this section of the zoning by-laws. There now exists a non-conforming
use in the residence B-1 zone inasmuch as the existing motel building intrudes
into this zone beyond the allowed 30 ft. There was a prior application for apartment
use in this same area but the petition was withdrawn. This would have created two
uses differing in use on the same lot which is not allowed under the zoning by-laws.
The present request is for a special permit to extend a non-conforming use and all
of Section N. (Motels) which lists the requirements for this type of use, will
be conformed to. Site coverage will be 28% and the distance from the grade to the
top of the roof will be 30 ft. The petitioner will provide 91 on-site parking
spaces and the facade of the new structure will be identical to the existing motel
building. The petitioner has allowed parking by the Catholic Church at the site
of the new motel building, for more than 25 years and the church may still use this
area for parking in the off season months. There would be oa ionfs on the easterly
side of High School Road to diffuse head light glare from e at ie d property.
A living fence of suitable natural plantings could be installed abutting Dr. O'Neil's
property on South Street in order to shield the building from his view. A land
court bound.which is now missing between the Pendergast property and the O'Neil
property will be replaced. John Rosario spoke in favor of the petition and no one
spoke in objection. Atty. Robert O'Neil, representing Dr. O'Neil, asked that the
fence plantings and the land bound replacement as mentioned by Atty. Anderson,be
conditions of the granting of a special permit. The Board took the matter under
advisement.
1980-65 Samir Barber
Atty. Richard C. Anderson represented the petitioner who had made previous application
to the Board for a variance to allow residential/art gallery use at Stephens
St. and Pleasant Hill Lane, Hyannis, in a residence B zoned district. The decision
on this appeal .which was filed on September 17, 1980, denied the application and
the Board found that variance conditions did not exist at this site. The present
application is for a special permit under Section PA (4) in the zoning by-laws, for
exactly the same relief that was sought under the prior application for a variance.
This property was owned by Thomas Greene who lived in the house and conducted a
furniture restoration business from the premises in addition to wig making for
