Williams, Chairman Barnstable Board of Appeals Hyannis, Massachusetts Dear Joe: Recently I returned to - your office the Approved decision in the matter of the Family Entertainment Center for the K-Mart Shopping Plaza.. I concur with you in your view that the Board of Appeals has within its power the right to impose 11safeguards and conditions" in connection with its granting of a Special Permit. It is my view that Sec. Q-2(b) of the Town -of Barnstable Zoning By-law relating to "Special. Permits for Exceptions" incorporates the language of Mass. General Laws Ch. 40A, and in so doing thereby incorporates the language con- tained .in General Laws Ch. 40A, Sec. 4 which states in v ' pertinent part as follows: The zoning by-law or ordinance may provide that exceptions may be allowed to the regulations and restrictions contained therein, which shall be i applicable to all of the districts of a particular r class and of a character set forth in such ordinance or by-law. Such exceptions shall be in harmony with the general purpose and intent of the ordinance or by-law and may be subject to general or specific rules therein contained. Board of Appeals C rm Heroe, o TOWN OF BARNSTABLE i SIMSTM : BOARD OF APPEALS 397 MAIN STREET HYANNIS, MASSACHUSETTS 02601 Appeal No. 1974-9/Family Entertainment Center - Facts & Decision -- Page 3 The Board found that the request for a change in the evening hours until 11 pm was reasonable in view of the Pact that there are certain other businesses in the area which are open until that time. The Board felt there would be no detriment to the zoning area nor to the public good nor derogation of the Barnstable Aoning By-Law by allowing this. However, the Board Pound that there would be a potential detriment to the public good if children under the age of 16 were allowed on the premises until closing; therefore, the Board imposes the following safeguards and conditions with regard to the extension of time: 1) No child under the age of 16 shall be allowed on the premises, unless accompanied by a parent or guardian, aer 8 pm. The Board further found that the portion of the application asking for a s Sunday opening could be detrimental to the area involved by having the center open at a time when not many of the other shops would be open, The Board stood by its original decision not to allow any opening on Sunday. The Board also reserves the right to review this decision should any incidents of public nuisance arise due to this change of hours.
