Dear Chairman Williams:
I thought perhaps you might require a file copy of
my comments regarding the theatre proposal presented to
the Board on April 30, 1975.
Primarily, my concern is with the number of people
concentrated within a small area, and the possibility,
however remote, of an aircraft accident. However, I do
recognize the number of people who at any given time would
be inside of buildings as close, if not closer, to any
active runways, i.e. , K-Mart,Drive in Theatre, Mitehell1,s
Steak House, Mildred ' s Chowder House.
Secondarily, the possible difficulties that could
develop, should at some time in the future, the theatre
owners or operators take objection to the noise associated
with and normally identified with the Airport.
I would think the notes and/or recordings made at the
hearing, would provide the necessary documentation, should -
at any time, the theatre operators refer to airport noise
as being a deterrent to their operation.

The Petitioner, Hyannis Cinema, ln,:.q has appealed to ,:she Board of Appeals and
petitions for a special permit to allow conversion of existing building to
three movie theatres at Route 132, Hyannis in a Business Toning District under
Section PA 10 of the Barnstable Z inOn g By—Law as revised December 18, 1974.

Margozian and Mr. !,evy of liyannis Cinema, Inc. Petitioner proposes to convert
existing stores at X—Mart Shopping Plaza to three mini cinemas, each with a
seating capacity of 320 for a total seating of 960. These will be open year
r und, 7 days a week, showing major films, festivals and foreign films. No
pornographic films will be shown. There are 1200 parking spaces on to us now and
more ",ould be added if necessary. These will be family type theatres. T'he
nl)'erhang- on the present building, w 11 be inclosed to form a lobby.
Richard Hodgkins, airport manager, stated that this is in a sound footprint of the
airport and that Petitioner should be aware that there will be noise problems
from the airport and that the airport will not take into consideration an complaints
as to this noise in futute.
Petiti,:ners stated that they would sound proof the building to prevent a noise
problem.
Chairman I-lilliams stated that a letter had been received from the Board of
Health in reference to a sewage problem, but this did not concern the Board of
Appeals decision on this. Petitioner stated that Hyannis Associates had agreed
to do whatever work necessary for the construction of this cinema but were
awaiting the necessary permit for the entertainment from the Board of Appeals.
There was no opposition.
The Board found that this was a routine application under Section PA 10 of the
Barnstable 'Zoning By Law. The Board found that there would be no derogation of the
Barnstable Zoning By—Law and that there would be no detriment is there is ample
parking and this is an allowable use in a business district. However, the Board
notes that, as stated at -,-he hearing, there -gill be a noise problem from the
airport and that the airport will continue to expand and that this theatre will be
constructed- in full knowledge of the Droblem- s associated with its close proximity
with the airport, Therefore, the Board voted unanimously to.,grant this application
r special permit,

We have advised representatives of the
theatre enterprise that prior to construction
of the theatre, the sewage system must be
approved by the State. To date they have not
received approval, nor has the Barnstable Health
Department given approval.
It is requested that you do not issue
any licenses until this situation is resolved.
