Dear Mr. Williams:
At a regular meeting of the Barnstable Planning Board held on
Monday, November 17, 1975, it was voted by the Board to allow under
section 20, Chapter 40A, the re-consideration of the application for
variance of Chester Redman, his attorney having stated that there is
new information to be presented, this together with your indication of
willingness to re-hear this application, is the reason for favorable
action by the Board.
The Board also voted to allow the re-hearing of "School 's Out
amusement center. Mr. Garnick, attorney for the petitioner having
stated that there is further information which will be made available,
and that there was a lack of communication with the first petition.

In a decision in May o, this year, the Board of Appeals allowed
ehool's Out to operate on Sundays through Labor Day weekend with
the understanding that if no prob,ems arose from this aunday operation,
this permit .could be extended indefinitely.
The time is fast, approaching when_a decision must be made regarding
this extension. Therefore, the Board would appreciate a report
from the Police Department as to whether or not there has been
any nrobkem at School's Out on Sundaes during this trial period.

Dear Mr. Williams :
As you are no doubt aware, Family Entertainment Center,
d/b/a School's Out, has been allowed to operate on
Sundays until September 12, 1976. The decision, which was
handed down by the Board of Appeals on May 5, 1976, does not
state in what manner School' s Out may extend this privilege.
I have been in contact with the manager of School' s .0ut,
Mr. Kline, and he informs me that there has been no difficulty
concerning the operation on Sundays- and would like to know
how we can facilitate this matter as easily as possible
in remaining in operation, as it appears that such operation
on Sunday has not been harmful to the Town in any manner
but has, in fact, been helpful as a source of entertainment.
Please contact me and .infarm me as to how to best proceed.
Your immediate attention and consideration on this matter
will be greatly appreciated.

The Petitioner, Family Entertainment Center, Inc. , has appealed to the
Board of Appeals and petitions for modification of seecial permit to
allow operation of coin-operated amusement center on Sunday at Route 132,
Hyannis in a Business Zoning District.
Attorney Gerald Garnick represented Petitioner. Since the change in
management of Petitioner, locus has been made to operate in a more
desirable manner, with constant adult supervision, machines in good
operating condition and good conduct of the players maintained. In
addition, there has been an increase in the number of business establish-
ments which are now open on Sunday in this shopping plaza, which reduces
the isolation of locus on Sunday. It is a hardship to the Petitioner to
be unable to open on Sunday and Petitioner's past performance warrants
giving Petitioner at least a trial period of operation on Sunday.
Juvenile Officer James Flynn of the Barnstable Police Department stated
that although he did not favor allowing this type of operation to open
on Sunday in this isolated location, to date, there have been no complaints
related to this' operation.
The Board found that it had originally imposed a restriction that Petitioner
could not be open on Sunday due to the isolated location, with few if any
stores open on Sundays in the plaza. 'However, there are now more businesses
and restaurants open near locus on Sundays and, due to Petitioner's record
of operation, the ,Board found that this reatriction could be removed on a
temporary basis in order to give Petitioner an opportunity to demonstrate
that the operation of this establishment in this location on Sunday would
not be dettimental to the area involved. Therefore, the Board found that
this would not be in derogation of the Barnstable Zoning By-Law and voted
unanimously to grant this special permit for operation on Sundays subject to
the following restrictions:
1) flours of operation shall be no earlier than 1 pm add no later
than 11, pm.
2) This permit shall be effective from date of issue to September
12, 1976, provided there is .no detriment to the area involved
due to this operation and further provided that if, during
this trial period, there is no detriment to the aria, this
permit may be extended on a permanent basis.
