Capetown Plaza LLC has applied for a Special Permit pursuant to Section 240-57 A. and C.
Circumstances Warranting Reduction of Requirements. The Applicant seeks to establish an
overall shopping center ratio for the property of 3.5 parking spaces per 1,000 square feet of
shopping center gross floor area. The subject property is located at 790 Iyannough Road, Hyannis,
MA, as shown on Assessor’s Map 311 as Parcel 092. It is located in the Business (B) and Highway
Business (HB) Zoning Districts.
Background
The subject property is a 26.72 acre lot with frontage on Iyannough Road and Airport Road in
Hyannis, MA. The lot contains six buildings containing a total of 207,461 gross square feet of
commercial use built in 1973.
The property has the benefit of many previous Zoning Board of Appeals actions, but the following
are variances and special permits which do not include signage:
Special Permit 1973-045 allowed the Family Entertainment Center.
Special Permit 1974-009 Family Entertainment Center change of hours of operation.
Special Permit 1975-032 allowed change of use to three movie theatres.
Special Permit 1976-023 allowed the Family Entertainment Center use on Sunday.
Variance 1989-013 allowed construction of a bank with drive through.
Special Permit 1989-014 allowed new bank building smaller in size.
Variance 1987-096 for setbacks.
Proposal & Relief Requested
Capetown Plaza LLC has applied for a Special Permit pursuant to Section 240-57 A. and C.
Circumstances Warranting Reduction of Requirements. The Applicant seeks to establish an
overall shopping center ratio for the property of 3.5 parking spaces per 1,000 square feet of
shopping center gross floor area. The subject property is located at 790 Iyannough Road, Hyannis,
MA.

The 26.72 acre lot consists of a multi-tenant shopping center which is in the process of being
redeveloped and modernized. The Applicant states the redeveloped center will have a mix of
tenants including retail, banking, and different types of dining. A key component of the centers
redevelopment includes improving and modernizing the parking areas, including landscaping,
improved storm water management, and improving the property’s curb appeal. New stand-alone
buildings are being designed on portions of the site currently occupied by unused parking
spaces/asphalt. These proposed buildings will enhance the sense of place within the center and
improve the aesthetic of the site from surrounding roadways.
Special Permit Findings
For all Special Permits, the Board is required to make general findings pursuant to § 240 -125(C).
The Board should review the evidence presented by the Applicant, staff, and members of the
public and, after weighing such evidence, is encouraged to articulate if and how the evidence
contributes to each of the required findings.
1. The application falls within a category specifically excepted in the ordinance for a
grant of a Special Permit.
2. After an evaluation of all the evidence presented, the proposal fulfills the spirit and
intent of the Zoning Ordinance and would not represent a substantial detriment to
the public good or the neighborhood affected.
3. A Site Plan has been reviewed and found approvable with conditions. (see letter
dated February 7, 2023).
Further, Section 240-125 (C) requires the Board to find that:
4. Such uses do not substantially adversely affect the public health, safety, welfare,
comfort or convenience of the community.
5. The Building and site design are consistent with Section 240-25.E, District-wide
design and performance standards applicable within the Highway Business District.
Further, Section 240-93 B. requires the Board to find that:
6. The proposed repairs, alterations and/or expansion are not substantially more
detrimental to the surrounding neighborhood.
Suggested Special Permit Conditions
Should the Board find to grant Special Permit No. 2023-021, a Special Permit to allow the overall
shopping center ratio for the property of 3.5 parking spaces per 1,000 square feet of shopping
center gross floor area at 790 Iyannough Road, Hyannis, MA,:
1. Special Permit No. 2023-021 is granted to Capetown Plaza LLC for a Special Permit
pursuant to Section 240-57 A. and C. Circumstances Warranting Reduction of
Requirements. The Applicant seeks to establish an overall shopping center ratio for the
property of 3.5 parking spaces per 1,000 square feet of shopping center gross floor area.
The subject property is located at 790 Iyannough Road, Hyannis, MA.
2. The site development shall be constructed in substantial conformance with the plan
package entitled “The Landing at Hyannis” dated July 31, 2023 by WS Development pages
1-11.
3. All Site Plan Review conditions of approval are hereby incorporated into this Decision.
4. The above-described redevelopment shall represent full build-out of the lot. No further
additions or accessory structures or additional uses shall be permitted without approval
from the Board.

5. This Decision shall be recorded at the Barnstable County Registry of Deeds and copies of
the recorded Decision shall be submitted to the Zoning Board of Appeals Office and the
Building Division prior to issuance of a building permit. The rights authorized by this
Special Permit must be exercised within two years, unless extended.
