WILKINSON COMMISSIONER, DIVISION OF OCCUPATIONAL LICENSURE Paul Graves Barnstable DPW RE: Barnstable Boat Ramp (A23-009) September 18, 2023 Dear Paul Graves, In Response to your August 23, 2023 request for an Advisory Opinion, the Architectural Access Board took up the question of parking and pedestrian access for Scudder’s Lane Boat Ramp aka Scudder’s Landing in Barnstable, Massachusetts. At its regularly scheduled September 11, 2023 meeting, after reviewing your submission as well as all relevant code sections, the Board voted to: FIND that 521 CMR does not have jurisdiction over the parking lot in question as the lot has less than 15 spaces, and FIND that as the proposed spending exceeds 30% of the assessed value of the property, 521 CMR 3.3.2 requires the site fully comply with all relevant provisions of 521 CMR, and as in addition to its proposed vehicular use the boat ramp is also serves as a pedestrian route with a prepared surface it meets the definition of a walkway in 521 CMR 5 and thus must comply with 521 CMR 22.
